The parcel is developed with a one-story wood-frame dwelling with wood deck along the roadway, a wood deck at the rear of the house,a bilco-style basement access and a small shed (which the applicant has since removed), as shown on the survey prepared by Kenneth M. Woychuck,Licensed Land Surveyor,and last revised May 21,2024. ADDITIONAL INFORMATION. The applicant provided architectural drawings including the proposed site plan, existing floor and demolition plans, proposed floor plans, existing and proposed elevations, and section, labeled ZBA-01 through ZBA-5 prepared by Anthony M. Portillo, Registered Architect and dated June 17, 2024. These documents illustrate the dwelling currently has a front yard setback of 29.3 feet from the roadway with an attached deck that is presently 13.8 feet setback from the roadway,along with existing side yard setbacks of 2.4 feet and 15.5 feet respectively. The following Certificate of Occupancy covers improvements on the subject parcel: 4Z-6674 dated September 12, 1975 covering a private,one-family dwelling per ZBA#1254. #Z-19576 dated December 11, 1990 covering addition and foundation to an existing dwelling. #Z-20120 dated July 30, 1991 covering an existing deck addition. #Z-27039 dated April 13,2000 covering an addition to an existing dwelling. Prior Zoning Board of Appeals relief was granted in file #1254 dated August 20, 1970, subdividing a larger lot containing the Hamilton Cottage Colony of nine(9)bungalows and `common' area into nine(9) independent lots plus a `common' area for all homes to share as part of a home owner's association. The subject parcel is the beneficiary of that decision. Before the public hearing, the applicant presented an analysis of front yard setbacks of adjacent properties along Bailie Beach Road varying from+/-2 feet to+/-98 feet. Those developed lots with a dwelling closest to the roadway are similar bungalows,part of the original Hamilton Cottage Colony. According to Town records,the dwelling is unheated. The applicant confirms that the proposed alterations and additions to the existing house when completed will not exceed the allowable Gross Floor Area of 2,100 square feet. As proposed,the dwelling will contain 1,128 square feet. The applicant stated that parking is in the rear of the subject lot,behind the house, and accessed via the `common' area owned by the homeowner's association. The applicant proposes to install a Suffolk County Board of Health- approved Innovative and Alternative Onsite Wastewater Treatment System(I/A OWTS). The public hearing was closed subject to the receipt of examples of Zoning Board of Appeals prior relief granted for the immediate area relative to excessive lot coverage and a copy of the SCDHS approval for installing the Innovative Advanced(I/A)OWTS. On October 7,2024 the applicant provided the Board with an analysis of two area homes: 1172 Bailie Beach Road (SCTM: 1000-99-3-11.2)with a suggested lot coverage of+/-23%and 1690 Bailie Beach Road(SCTM: 1000-99- 3-11.14) with a suggested +/- 28% lot coverage. No public records or prior Board relief was included with this analysis to support the estimated lot coverage. Additionally,at this time,the applicant also provided the Board with a Suffolk County Department of Health Services approval#R-24-1124 dated September 9,2024 for the installation of the I/A OWTS per plans labeled SP-101.00 and SP-102.00 prepared by Anthony M.Portillo,Registered Architect and dated July 19, 2024. No member of the public spoke in favor of or against this application. Page 3,October 17,2024 97952,Glover SCTM No. 1000-99-3-11.18 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 3,2024 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1 Town Law t267-bQ)(.b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Bailie Beach Road follows Mattituck Inlet on the east shore and residential development is primarily limited to the east side of the roadway. The majority of homes in the general area were developed either before Zoning or in the mid/late twentieth century. The neighborhood is mixed in character ranging from substantial waterfront residences to attractive upland homes and small bungalows,similar to the applicant's,all with varying setbacks and lot coverage. The expansion ofthe front deck(as proposed,not attached to the dwelling)by 42 square feet and the expansion of the rear of the dwelling to accommodate enlarged bedrooms and a mud room (with the removal of a rear wood deck), will not be discernable to those passing by or using the roadway, since the proposed front yard setback of 11 feet is not that dissimilar to the current 13.8 feet front yard setback, which is further mitigated by the grassy, Town-owned, shoulder along the roadway. Additionally, the applicant proposes to maintain the existing, as built, single side yard setback of 2.4 feet which creates the need for additional relief as the combined side yard setback as proposed will be 16.8 feet where 25 feet is required. Again, these setbacks are proposed to best reflect current conditions,and few people will be able to discern any substantial change. The proposed residence will remain small in scale and despite having excessive lot coverage of 24.3%,few will be able to recognize the substantiality of this overage,given the home owner association lands behind the subject parcel,the meandering roadway and the varying lot sizes of neighboring parcels. 2. Town Law§267-b( )(b)( ). The benefit sought by the applicant cannot be achieved by some method,feasible for the applicant to pursue, other than an area variance. Almost any alteration to the existing dwelling will require some form of Zoning Board of Appeals relief given the lot size and the siting of the original dwelling with pre- existing, non-conforming front, side, and combined side yard setbacks. Furthermore, if the applicant proposed to add a second story vs. a lateral addition which requires lot coverage relief,undoubtedly, Sky Plane relief would be necessary given the lots width and the structures close proximity to the lot line. 3. Town Law 267-§Q 3 , The variances granted herein are mathematically substantial, representing 68.6% relief from the code relative to a reduced front yard setback of 11 feet where the code requires a minimum front yard setback of 35 feet; 32.8% relief from the code relative to a reduced combined side yard setback of 16.8 feet where the code requires a minimum combined side yard setback of 25 feet; and, 21.5% relief from the code relative to excessive lot coverage of 24.3%where the code limits improvements to a maximum of 20%lot coverage. However, the applicant proposes alterations and additions to their dwelling to update the home,modestly improving it to meet current needs including enlarged bedrooms,the addition of a mud room,and the expansion of the front porch by 42 square feet(squaring it off)while maintaining the original structure. As a result of these additions and alterations, the value of which exceeds the current construction value of the bungalow,the project has been deemed a demolition by Town Code. 4. Town Law, 267-b b 44 . No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood, The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and install a Suffolk County Department of Health Services approved Innovative and Alternative Onsite Wastewater Treatment System (I/A OWTS). The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Torun Law 267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and alterations deemed a demolition, including a front yard setback of 11 feet, a combined side yard setback of 16.8 feet, and excessive lot coverage of 24.3% in order to accommodate expansion of existing bedrooms,the addition of a mud room,and the expansion of the front deck while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Planamento,seconded by Member Dantes,and duly carried, to GRANT the variances as applied for, and shown on the Architectural Drawings labeled ZBA-01 through ZBA-5 prepared by Anthony M.Portillo,Registered Architect and dated June 17,2024.
