LLC Summit Estates - Cape May II Lot No. 23, Two Story Victorian East Marion, New York Dear Mr. Boufis: This letter has been issued in continuation of our April 28, 2003 letter. This issuance was in reference to the situation that had occurred at the front (East) and rear (West) garage walls and the suggested solution to the described problem. The April 28, 2003 tetter had instructed the Contractor as to the method of the required foundation repair. This repair work was necessary due to the fact that, as you are aware, the bearing for the footing became undermined (washed out) during recent rains and inclement weather. The extent of the washout is construed to have been minor and has subsequently been corrected or ameliorated by the Contractor. Based j upon our recent review of this situation, the Contractor has removed all of the inadequate soil, de-watered the trench as required, supported and shored the footing/foundation walls where required, and installed additional formed concrete tight to the existing concrete work and on virgin non disturbed soil for adequate bearing. At this juncture since the concrete work has set, the Contractor must now back fill the perimeter garage wall. This back filling cannot proceed without the Town's Approval/Acceptance of the work- It is therefore requested that since this method or approach to the amelioration has been found adequate for the intended purpose, to provide adequate bearing and stability at these two walls, that, the Town grant the Contractor authorization to back fill the described area.
