Nicholas Krupski,Vice President e`er I® P.O.Box 1179 Eric Sepenoski Southold,New York 11971 Liz Gillooly v, Telephone(631) 765-1892 Elizabeth Peeples Fax(631) 765-6641 couffm BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD February 18, 2025 David Bergen Sol Searcher Consulting PO Box 1008 Cutchogue, NY 11935 RE: SCOTT & PATRICIA PASKEWITZ 105 FLEETWOOD ROAD, CUTCHOGUE SCTM# 1000-137-4-8 Dear Mr. Bergen: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, February 12, 2025 regarding the above matter: WHEREAS, Sol Searcher Consulting on behalf of SCOTT & PATRICIA PASKEWITZ applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated February 2, 2024, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: increasing public access; including pier line on submitted plans; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on February 12, 2025, at which time all interested persons were given an opportunity to be heard, and, 2 WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the project complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project.as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVE the application of SCOTT & PATRICIA PASKEWITZ.to construct a fixed catwalk consisting of a landward 4'x6' set of stairs with two handrails to a 4'x43' catwalk ramp constructed with thru-flo decking with 4"x4" posts to a 4'x38' catwalk constructed with thru-flo decking with 8" pilings for a combined 4'x87' catwalk; install a swim ladder at the end of the catwalk; with the existing oversized path to be reduced via natural grow to a width of 4' which is to be maintained; and as depicted on the site plan prepared by David Bergen and Ken Quigley, received on February 13, 2025, and stamped approved on February 14, 2025. Permit to construct and complete project will expire three years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of$50.00 per inspection. (See attached schedule.) Property Owners: Scott& Patricia Paskewitz Dear Trustees: I (the undersigned) and my wife Jane McGoldrick residing at 1255 Waterview Drive, Southold NY 11971 are against the building of this proposed residential dock or any other new water structures on Goose Creek in the town of Southold. A Piling Dock will damage the wetlands (sea grasses, plants, fish, shellfish and water quality) of this property and connected Goose Creek. A 97' dock will be.a navigation hazard for all current Goose Creek homeowner/boaters. Personal to us and based on past history of 1475 Waterview Dr. (see complaints filed with Southold Town Police), Noise Ordinances will be violated with increased boat traffic, music and large unsanctioned party/gatherings by the youths associated with said property. Last, as a Goose Creek waterfront property owner for 15 years, when Jane and I purchased our.lot, we paid a significant $ premium in order to have a home with a dock. The idea of requesting approval for a dock (after the fact), compromises and devalues the investment. Also, we believe the Trustees approval of any new dock structures will significantly increase future requests. A precedent will be set. SCTM# 1000-78-7-20 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the as-built is INCONSISTENT with LWRP Policy 6.3 and, therefore, INCONSISTENT with the LWRP. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems 6.3 Protect and restore tidal and freshwater wetlands. The applicant has not demonstrated the following dock standards pursuant to § 275-11. Construction and operation standards have been met. The pier line is not shown, and the plans are deficient. (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water-dependent activities; Private dock structures extending into public waters decreases the public use of bottomlands and the nearshore area. [5] Whether the dock will cause degradation of surface water quality and natural resources; The construction of dock structures in these areas results in the loss of littoral and marine habitats. The introduction of CCA (a pesticide) treated materials in a living ecosystem is detrimental to life within the system. [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts; and The alternative use of seasonal moorings in areas of low biological productivity and with adequate water depths is a better option to accommodate vessels requiring greater water depths. [12] Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. Mr. Mike Kimack,the Agent at the,time, was working to obtain NYDEC approval when he passed. The Paskowitz's hired me to complete the permitting process with the NYDEC. Unfortunately the NYDEC process has stretched out to the point of time where the Trustee permit expired. The attached proposal includes the seaward limitation conditioned by the Trustees in their previous approval of 42 feet, plus amendments required by the NYDEC. As the new structure will be conditioned to be limited to non-motorized vessels as per the NYDEC,we have now included a kayak slide.
