Gillis~i¢, Jrt, Chelrm~n Robert Bcrscn Herbert Rosenbcr~ Cherles Gre~onis, .Jr. Ser~ Doyen, Jr. MINUTES SOUTHOLD TOWN BOARD OF APPEALS August 24, 1961 A regular meeting of the Southold Town Board of Appeals was held 7:30 P.M., Thursday, August 24~ 1961 at the Town Clerk Office, Matin Road, Southold, New York. There were present: Messrs. Robert W. Gillispie, Jr., Chairman, Robert Bergen, and Herbert Rosenberg. Absent: Messrs. Charles Grigonis, Jr., and Serge Doyen, Jr. PUBLIC HEARING: Appeal No. 405 - 7:30 P.M. (E.D.S.T.), upon application of Thomas Jurzenia, Silvermere Road, Greenport, New York, for a special exception ~n accordance with the Zoning Ordin- ance, Article IV, Section 408, for permission to erect and maintain a directional sign on the northeast corner of property of George Teltes, South side Route 25, west of Greenport, New York. Fee paid $15.00. The Chairman opened the hearing by reading application for a special exception, legal notice of hearing and affidavit attesting to its publication in the official newspaper. Southold Town Board of Appeals -2- August 24, 1961 THE CHA~: On the application for a building permit the sign is described as being 6 ft. by 10 ft. Thee original dimension is to be retained but the shape is to be squared. The original sign was in the shape of an arrow and it is to be changed to a rectangular shape. In June 1960 the applicant was granted permission to erect~a sign with the Sound Shore Motel on the corner of Chapel Lane and North Road and the applicants old sign on that corner was to be removed immediately upon erection of the new sign. That sign was not removed until a week ago. This application is now made to re-erect that sign. Investigation reveals that in the mile before you reach Silvermere Road to the west there are now four signs directing travelers to the Silver Sands~3Motel. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? (There was no response.) BERGEN: Is there anything any member of the Board wishes I think the four signs within ~ mile is sufficient. MR. ROSENBERG: He left the illegal sign up for almost 14 months. As you say, four signs within one mile is aboUt two signs more than we normally permit. The man has two signs on the North Road in addition to the four signs within a mile on the South Road. THE CHAIRMAN: Is there anything else anyone wishes to say in connection with this application? (There was no response.) This application No. 405 is for a special exception to relocate present sign. The sign in question was authorized April 30, 1959. On May 26, 1960 this applicant applied to the Board of~Appeals for permission to remove the sign and to replace it by a small panel sign to be used in conjunction with anothermotel establishment. This was granted with the condition that the original sign be removed before the small sign w~s erected. Southold Town BOard of Appeals -3- August 24, 1961 The small sign was erected. The ~applicant did not remove the large sign and has consistently refused to remove it until a few days before the present hearing. The sign was removed in order that it might be remade to a larger sign. He now asks to remove the illegal sign to a new location. proposes to place this illegal sign on a main road where at the present time he maintains four signs within one mile. He Directional signs have been authorized within limits at cross roads to guide travelers. This Board finds after inspection and investigation that no cross road directional sign is involved and the application is to continue use of an illegal sign continuously maintained for over 14 months. The Board further finds that the public convenience and welfare and justice will not be served and the legally eStabliShed or permitted use of the neighborhood property and adjoining use districts will be permanently or substantially injured and the spirit of the Ordinance will not b~ observed, therefore On motion of Mr. Gill±spie, seconded by Mr. Rosenberg, it was RESOLVED that ThomasJurzenia be denied permission to erect a sign on the property o~ George Telles, south side Route 25 west of Greenport, New York. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. Mr. and Mrs. Arthur~Antonison, Laughing Waters, Southold, appeared before the Board of Appeals for an irfDrmal discussion. Mr. and Mrs. Antonison own a piece of property 85 ft. by 110 ft. with a cottage on it. Recently they purchased another parcel 125 ft. by 110 ft. adjoining in Mrs. Antonison's name. They would like to take some land from the new lot and add it to the old lot. The Board advised that if they divided the property properly there would be no need for a variance. Corp., South Oyster Bay Rod, Bethpage, New York, for a variance ~in accordance with the Zoning Ordinance, Article III, Section 300, for permission to use property for a temporary restricted installation. Location of property: private road, north side of land of B. D. Latham Estate, Orient, New York. Fee paid $15.00. The Chairman opened the hearing by reading application for a variance, legal notice of hearing and affidavit attesting to its publication in the official newspaper. ~ CHAIRMAN: Is there anyone present who wishes to speak for this application? MR. GEORGE KLAUS, Electronics Engineer, Grumman Aircraft: The Reason why Grumman needs this variance is because the property is unique as it is a piece of property that presents a site where we can have a path with aircraft many miles away from the site. The type of communication will be between the air~raft and the telemeter van on the property. We will be testing the basic characteristics of the antenna, gathering data relative to the communications link between radar and aircraft. This pro~ect has a very low power level. We cannot tolerate any interference, and the test will in no way interfere with T.V. and F.M. There are only a few spots on Long Island. This one and one in Sag Harbor. From this site we have 300 to 400 miles of free water to the Atlantic. The only other site available is down in Florida. THE CHAIRMAN: What ~ the area of land you are renting? MR. tfLAUS: 209 ft. by 209 ft., one acre. The first lease was for five or six months but the project was a little late getting started and it looks like we will have to extend it to a total of one year. THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) THE CPLAIRN~%N: Are there any other questions? (There was no response.) Southold Town Board of Appeals -5- August 24, 1961 This Appeal No. 406 is for the temporary use of land to main- tain a radio telemetering truck and ground equipment to be used for conducting radio test work for military aircraft being produced by Grumman for the United States Government. Telemetering is best conducted in an area free from interference and for this particular project at or near a shore line. The location of the truck and equipment on the furthermost easterly point of land on the north shore of Long Island on or about the northerly side of open farm land, approximately 55 acres, is the most advantageous site for the operation. This is a classified project and directly concerned with national security. This being a proprietary project and not governmental the applicant is required to observe the conditions of the Ordinance involved in this matter. After investigation and inspection the Board finds an unnecessary hardship would exist if the temporary use of the land for the stated purpose would be denied. Tppographically this property is unique for the project and will be the only operation of its kind on Long Island. The character of the district would not be changed by the temporary location of this mobile scientific laboratory. On motion of Mr. Gillispie, seconded by Mr. Rosenberg, it was RESOLVED that Grumman Aircraft Engineering Corp. be granted permission to use property located on the B. D. Latham Estate, Orient for a temporary restricted installation. This variance is granted to permit this operation during the period of the present 5 month lease and any extension to complete unfinished test provided the final termination date does not exceed t2 months from the date of this resolution. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. Southold Town Board of Appeals -6- August 24, 1961 Mr. Edward Taborsky or'Eastern T.V., Mattituck, appeared before the Board of 3Appeals for an informal discussion relative to erecting signs on the roof of the place of business he now rents at the corner'of Old Main Road and Marlene Lane. He would like to erect two signs on the roof advertising Zenith and Hotpoint. He would not have a ground sign. The Board stated that he would probably not be permitted two roof signs, but they would go to Mattituck and look at his building and further discuss the situation with him. On motion of Mr. Gillispie, seconded by Mr. Bergen, it was 10, RESOLVED that the minutes of the meeting of August/1961 be approved as submitted. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. On motion of Mr. Rosenberg, seconded by Mr. Bergen, it was RESOLVED that the Board of Appeals set 7:30 P.M., Thursday, September 7, 1961, Town Clerk Office, Main Road, Southold, New York as time and place for hearing upon application of Astrid Heuer, Bray Avenue, Mattituck, New York, for a variance in accord- ance with the Zoning Ordinance, Article III, Section 303, and Article X~ Section 1000A, for permission to reduce frontage and use as a single lot. Location of property: west side Bray Avenue, Mattituck, New York, Lots No. 95 and 96 on map of George t. Tuthill & ors. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. It was further RESOLVED that legal notice of hearing be published in the official newspaper on September 1, 1961. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg.
