NOTICE /~ HEREBY GIVEN that a meeting of the Town Board of the
Town of Southold, Suffolk County, New York, held on the 22nd day
of March, 1977, the Town Board enacted the following amendment
to the Town Code entitled "Code of the Town of Southold" together
with the Building Zone Map forming a part thereof as follows, to
wit:
Amendment No. 105 amends the Code of the Town of Southold by
changing from "A" Residential and Agricultural District to "B-I"
General Business District the property of Joseph C. Cornell
situated at Peconic, New York, and more particularly bounded and
described as follows:
BEGINNING at a concrete monument set on the southerly line
of Middle Road at the northeasterly corner of land of Helmut Hass
and the northwesterly corner of the premises herein described;
running thence easterly on a curve to the left, having a radius
of 5789.58 feet, a distance of 108.73 feet to a concrete monument
and land of Suffolk County; running thence along said land of
Suffolk County, two courses: (1) S. 25° 22' 40" E. 200.0 feet to

CHANGE OF ZONE APPLICATION #2~2 - JOSEPH C. CORNELL
A public hearing was held at the Supervisor's Office, 16 South
Street, Greenport, New York, at 3:30 p.m. on the application of
Joseph C. Cornell for a change of zone from A Residential
Agricultural District to B-1 General Business District. The
property is located at Peconic, New York and has the following
adjacent property owners.
North - Middle Road (CR27)
East - County of Suffolk
South - County of Suffolk
West - Helmut Hass
Present at the hearing were:

Councilman Homart read the notice of public hearing. He presented
proofs of publication from the Suffolk Times and the Long Island
Traveler-Watchman. He presented a sworn statement that the
notice was posted on the Town Clerk's Bulletin Board in the Town
Clerk's Office. The following letter from the Southold Town
Planning Board %under date of December 14, 1976 was read:
Gentlemen:
The following action was taken by the Southold Town Planning
Board at a regular meeting held December 6, 1976.
RESOLVED to recommend to the Southold Town Board denial of
the application of Joseph C. Cornell for a change of zone from
"A" Residential and Agricultural District to "B-i" General
Business District on property located on Middle Road (CR 27),
Peconic for the following reason:
This property does not meet the minimum square footage as
required for B-1 zoned property as set forth in the Bulk and
Parking Schedule of the Code of the Town of Southold.
The following letter was presented from the Suffolk County Dept.
of Planning signed by Gerald G. Newman, Chief Planner and dated
January 6, 1977.
Dear Ms. Terry:
Pursuant to the requirements of Sections 1323 to 1332 of the
Suffolk County Charter, the Suffolk County Planning Commission on
January 5, 1977 reviewed the above captioned application and
after due study and deliberation Resolved to approve it for local
determination.

Supervisor: You have heard Councilman Homan read the legal notice
and that we have the proof of publication, both from the Long
Island-Traveler o£ Southold and the Suffolk Times of Greenport.
It has been posted on the Town Clerk's Bulletin Board, the position
of the Southold Town Planming Board recommending denial, the
position o£ the Suffolk County Planning Board indicating leaving
it to local determination. At this time, I will entertain anyone
that wishes to speak in favor of granting this application.
Joseph Cornell: The reason I would like to speak for it is just
in the past week or two you have already, the Planning Board has
already approved an application for Helmut Haas on the adjoining
property and it already has an addition put on it. This is non-
conforming property. However, on the east side of my property,
we also have the County garage. To hold this to a residential,
this isn't likely, there isn't anything you can do there, build a
house or anything else. You have more or less an industrial site
on one side of me and a nonconforming business on the other side.
It's not going to change the area or hurt the area, by any means.
You can't put a house between~ well, a rose between two thorns, shall
I say it that way? That's why I am speaking on behalf o£ that.
What else I can say about it, I don't know~ but one's industrial
and the other is noncon£orming and right inbetween the two o£ them
is residential.
Supervisor: Thank you very much. Anyone else wish to speak in
£avor of this application, that it should be granted? Anyone
wish to speak in opposition? Opposing this application? Anyone
wish to speak into the record their feelings on it? Either for or
against or questions?
Gladys Csajko: I don't know what Mr. Cornell wants to do with it.
What he has there already or what?
Supervisor: That's not for us to ask. The question comes to us,
do you want to grant a B change and if we say yes, everything that
the code allows to go into B-l, he can put.
Ms. Csajko: I was just curious if he already had something there.
Supervisor: I£ he wants to answer that~ he can but you can't hold
him to it. He could change his mind and go in some other direction.
William Pell III: The County, what did they say?
Supervisor: Local determination. In other words, let Southold
Town make their own decision.
Mr. Pell: Is this the way they operate all the time?
Supervisor: No, most of the time, they take a position one way
or another.
Mr. Pell: What was their reason why .......
Supervisor: And, also, I notice something else missing. They

once in awhile say local determination subject to and they give
two or three things they would like to see that applicant do.
Mr. Pell: The County didn't state why?
Mr. Homart: Do you want to hear the County's report again?
Mr. Pell: No.
Supervisor: Any other questions? Has everyone had the opportunity
to speak on this application that wishes to be heard? Hearing
none, I will call the hearing to a close and the board will make
a decision at the proper time. Thank you.

INSTRUCTIONS FOR SUBMITTING ZONING ACTIONS
Pursuant to Section 239 L & M of General Municipal Law
Any person wishing to apply for amendments to the zoning ordinance; change of zone; special
exceptions or special permits; variances to the zoning ordinance, whose property lays within 500 feet
of:
1. Town Boundary line
2. Village Boundary line
3. State Park
4 County Park
5. State Road
6 State Parkway or expressway
7. County Road
B. County Parkway
9. County Drainage Channel
10 State Public Building
11. County Public Building
must submit the following:
Six copies of the proposed action (application); accurate description of the property by meetes
and bounds; nature and reasons for requesting the change, variance or special exception; name
and address of applicant, firm or corporation having an interest in the property; 6 copies of an ac-
curate map to scale, and drawn to the requirements of the Suffolk County Planning Commission as
follows:
A. All property owners within 500 feet of the boundary of the parcel which is subject to the zoning
action shall be shown.
B. All existing buildings within 200 feet of the boundary of the parcel which is subject to the zonir~g
action shall be shown and their use indicated.
C. The parcel shall be described with accurate boundary data giving bearings and distances, and shall
form a closed figure.
D. Three copies of the map shall be submitted to the County Planning Commission with the notice
and shall be considered part of the notice. (This is done by the Town agency concerned).
E Zoning classification of the surrounding area shall be shown.
F. Name and address of person making map shall be shown.
G. Scale--Smallest scale permitted will be 1"-200 ft., scale shall be selected so as to insure clarity.
Size--Maps shall be 8~,/2'' x 11" or 11" x 17" when measured on the outer edges. There shall be
a ½" border on all sides of the drawing.
All maps shall have a locality sketch which may be copied from the local zoning map of recent date.
J. The name, of applicant and his address shall be indicated on the map.
K. Line indicating the boundary of the jurisdiction of the Suffolk County Planning Commission shall
be shown (this line shall be 500 feet when measured at right angles to and parallel with parcel
to which zoning action has been considered)
L. The nature of the zoning action shall be indicated.
M A suitable title shall be placed on the map for purposes of identifying the application.
N. The Village and Town must be indicated in the title.
O. North Point shall be indicated by on arrow.
P. All maps shall be prepared in o neat and professional manner.
All maps will be checked by the staff of the Suffolk County Planning Commission and evidence
of gross errors or inaccuracies will be cause for rejection. Rejection of a map will be considered
lack of proper notification.
R. Map requirements may be varied upon written approval of the Suffolk County Planning Commis-
sion in those cases where unusual circumstances may arise, provided the request is submitted prior
to the submission of notice to the commission.
All applications will be processed as soon as possible by the Town of Southold after they are clear-
ed by the County Planning Commission. A minimum of 30 days after receipt and acceptance by the
County Planning Commission is required before the Town can act.
