Van Tuyl & Son 10/12/76 CHANGE OF ZONE APPLICATION #230 - CUTCHOGUE POLISH DEMOCRATIC CLUB A public hearing was held at the Supervisor's Office, 16 South Street, Greenport, New York at 7:30 p.m. on the application of the Cutchogue Polish Democratic Club for a change of zone from "A" Residential and Agricultural to "B" Light Business. The property is located at Cutchogue, New York and has the following adjacent property owners. N - Long Island Railroad E - Sacred Heart Cemetery S - Wilhelmina Kaelin W - Depot Lane Present at the hearing were: Supervisor Martocchia Justice Surer Justice Demarest Councilman Rich Councilman Homan Councilman Homan read the notice of public hearing. He presented proofs of publication from the Suffolk Times and the Long Island Traveler-Watchman. He presented a sworn statement that the notice was posted on the To%rn Clerk's Bulletin Board in the Town Clerk's Office. The following letter under date of July 26, 1976 from the Southold Town Planning Board was presented. This letter was addressed to the Town Board. Gentlemen: The following action was taken by the Southold Town Planning Board at a regular meeting held August 2, 1976. RESOLVED to recommend to the Southold Town Board APPROVAL of the request for change of zone from "A" Residential and Agricultural District to "B" Light Business District, as shown on amended petition of the Cutchogue Polish Democratic Club, Inc. The change of zone to "B" Light Business District is in conformity with the development plan and there is "B" zoned property immediately adjacent as well as across the street from this property. Muriel Brush, Secretary Supervisor: You have heard Councilman Homart read the notice, what the applicant is applying for AR to B - Business, the location of the property, that it was properly advertised in the town's official papers, posted on the Town Clerk's Bulletin Board and, also, the recommendation of the Southold Town Planning Board recommending approval. Is that correct? Councilman Homan: That is correct. Supervisor: At this time, we will open the floor to anyone that wishes to speak for the Democratic Club. This would anyone that #a3o -a- lO/la/76 wishes to speak in favor, at this point. Does anyone wish to speak in favor of granting this change? Mr. John Case: I am the only one from the Polish Democratic Club that will speak on behalf of the club, the Cutchogue Polish Democratic Club. I will say this. Originally, when the property was bought, it was bought to build a hall on it. That's when we bought it but it was way back in the 30's and things got a little bad, we come into the depression and we didn't build. But, that's what the property was originally bought for, to build a hall on it, the Cutchogue Polish Democratic Hall. That's all I can say on that. I am the only one here. There was supposed to be another man here but he didn't show up. Mr. Zaveski was supposed to come down. I guess he's asleep. He worked too hard digging potatoes. Supervisor: Does anyone else wish to speak in favor? Has everyone had the opportunity to speak in favor of this application? Hearing no one else, does anyone wish to speak in opposition? Eva Smith: We would like to know what kind of light business. It was residential and we would like to keep our lane as residential. You can't very well go by the business across the street. That was opened in 1912, a long time before the zoning came in. Supervisor: Anyone else wish to speak in opposition? Mary Kaelin: Yes, I am opposed to it because I don't know what light business includes, but if there is some factory put up there, it is going to decrease the value of our property if we want to resell. Supervisor: Light business would not handle that part. Judy, could you bring me out the zone book what fits into light business. Mr. Schriever brought his book up to the supervisor for his use. Supervisor: These are some of the tb_%ugs that could qualify: professional or governmental offices, banks, financial institutions, retail stores, restaurant, bake shop on the premises, laundromats and service stores. Those are the type of things that could go there. Justice Suter: No manufacturing would be permitted. Mary Kaelin: Trucking business? Supervisor: No. Anyone else wish to speak in opposition? Mary Kaelin: Did I understand you to say that there was business adjoining that property? Supervisor: I didn't say that. Somebody else said it. Justice Surer: It's in the notice. The Planning Board in their recommendation states that there is business across the street #230 -3- 10/12/76 and across the tracks. Mary Kaelin: Across the tracks, not adjoining this property, the railroad adjoins. Councilman Homan: According to the map that I have in the £ile, there is a "C" zone directly to the north, that is the railroad property. There is a "B" zone right across the street which would be the restaurant. Again, north of that is a "C" zone. Mrs. Smith: The business across the street is only part of it and there are a good many homes across the street facing that. Supervisor: Blue Top is closer. Anything else you would like to add? Anyone else wish to speak in opposition? Mary Xaelin: They have the property listed as Amelia Kaelin. They have an error there, the Kaelin property to ~le south. In the paper, it was Amelia. It should be Wilhelmina and Mary. Supervisor: That is residential, right? Mary Kaelin: Yes. Supervisor: The property to the south is residential property. Mary Kaelin: Why do we have zoning if it can be changed so readily? Supervisor: Everyone has the right to try for something else. Whether it is granted is another story. In other words, if every- thing was firm, we would not need an Appeals Board. We could dismiss them. We have to have these different agencies to give everybody the full latitude to apply for different things. Being granted is another story. Mary Kaelin: It has been recommended by the Planning Board, right? Supervisor: By the Planning Board, not our Board. wish to speak in opposition? Anyone else Sophie Cybulski: I'll speak in opposition. I just do not like to have a change. I would rather have it residential. Supervisor: Do you live in that area? Mrs. Cybulski: Just across the street, not opposite, but opposite the Kaelins. I wouldn't want to see a business come in there. Supervisor: Anyone else? Last call for anybody that would like to speak in opposition. Hearing none, is there anybody that would want to discuss it either way? Has everyone had the opportunity to give their imput for this application for zone change?
