Southeld Town Board -/4- July 10, 1973 When the property was purchased from Sacred Heart Church they wanted te retain a strip of property for a recreational area and a ball field. They have an elementary school. They wanted to get rid of the property te the north and also this property here (indicating map), and retain for themselves a recreational area and a ball field. The Church owns ~00 feet north ef the subject property. The back portions of the property were virtually landlocked. There was practically no ingress or e~Tees from the back portions, so, in negotiations with the applicant, the Church insisted that the applicant construct a road runni~ west directly into the church property se they would have access to their ball field off Griffiz%g Street. They negotiated and retained a recorded easement efa 60t strip of land from the intersection of Griffin~ Street and Schoolhouse Road. It was felt that the applicant should agree to construct that road in conformity with the Southold Town specifications m-4 they gave a bond for $8,000 to the Sacred Heart Church as part of title cleeingo In addition, I haYe a bend to the Town of Southold. If tho application is granted, it will be bonded te the Town ef Southold in the amount of construction costs, which is $8,000. Also, the church in its easement agreed that they would deed to the Town a 20 foot strip en the northerly portion se a hundred foot turn-a~eund could be effected. Southold To~n Board -~- July lO, Initially the church was well aware that the applicant intended to make application to expand its business property to include the portion which is shown by the hatch marks on that map. It was proposed that business be expanded to the rear portion of the property. They put in the mortgage and understood that when applicant regraded the property that Leisure Greens~ Inc. would construct a 6 foot cyclone fencer and in addition to a 6 foot cyclone fence the applicant would have to pl~ult a hedger probably yewsr to provide landscaping- a lal~dscaped buffer between the rear ~nd the play~Tound area. The applicant must do this. As shown in the orange colort that portion of applica~ltts property is presently zoned Light Business. ¥iew~ng it demonstrates that itts 15 feet below the existing road level of Grilling Street and would have to be filled. It w~ll haYe to be reg~ded in order to bring it up to the highway~the applicant intends to censtruct a small shopping center there. Because of the nearness to the highw~yt it would be ~ammed in so the property would have to be regraded. M~st of the fill will come from applicant's remaining property. To the north there is high rise land owlled by the applicant ~nd alse a higher portion of land in back of thisr and the idea w~s to re.fade that to bring it up to ~Tade level of Grilling Street. Alsor Suffolk County recon~ends that when you build a shopping plaza you have approximately 7 acres. That is recommended as opposed to the existing 3 acres that the applicant has~ which is ~other reason for the additional four acres. They feel you can provide all the parki~ necessary with a minimum of 7 acres. The applicant could build pretty much what Seutheld Town Board -6- July 10, 1973 it intends te build if the cha~e of zone is granted but the applicant proposes to set it back so he won't have to construct on filled property so that a~yene could come on to the property rather than parking on Griffin~ Street. It is a 60 foot road. Tc shew what the applicant proposes te do with the prepertyo.. the scale of the tax ~p is 1"=100I, This is 1"=50t. I have blown up the part showin~ what the &pplic~nt intends to do. The idea w~uid be to locate the retail shoppil~ center off the r~ad so that people could park on applic~ntls property and the service area would be to the rear of the p~operty. The Suffolk County Plan~n~ Commission recommended that the Beard take into consideration that a suitable buffer and l~ndscapin~ be between the eehe~l ~Teunds a~d the property of the applicant. Th/s has been provided for in the m~rt~a~e recsrded on April 2nd. Applic~nt must construct a cyclone fence and put in suitable pl~ntin~s as a buffer. The S~uthold Town Plann~ Bo~rdWs recommendation of May 8, 197~ be~z the question as to whether the request is the hi~hezt and best use of this land. The Pl~nn~n~ Bos~d suggests iris peer pl~n~n~ te have a p~rki~ ~rea between the playground ~nd the school area. I don~t know what that me,ns except they ma7 be su~estin~ that the buildin~ be located closer to the school rather than set toward the center of the property. I disagree with their reasoning. The church felt it w~s adequate when they ne~otiated the contract ~ passed title. As to their statement that it would require extensive gradings that is an understatement. The part that is presently zoned "B" Light is unbu~ldable unless Southold Te~n Beard -7- Ju~y 10, 1973 a lot ef fill is put on there. Wh~t the applicant ~ants to do is clean it up ~nd improve the property. The further comment of the Planning Board t~t the topo~aphy is ~suited... if this is se vhy ts the front p~t zoned 'B' Light. I do hereby petition the 'Toxvn Board of the Town of Southold to change, modify and amend the Building Zone Ordinance of the Town of Southold, Suffolk County, New York, including the Building Zone Maps heretofore made a part thereof, as follows: From "A" Residential and Agricultural District to "B" Light Business District Such request is made for the following reasons: Presently your petitioner is the owner of a three acre parcel of land on the westerly side of Griffing Street. This three acre parcel is presently zoned "B" Light Business District. This parcel is 783 feet long and has an average depth of 175 feet. Although the parcel conforms to all the existing zoning require- ments for the construction of retail stores, due to its size and shape, the parcel is not conducive to the construction of attractive retail stores and still have adequate space for offstreet parking and other amenities that are desirable for a modern retail shopping area. The petitioner is requesting that the parcel described in paragraph 1 of this petition which consists of 4.022 acres be zoned as "B" Light Business District so that when combined with petition- er's other land already zoned "B" Light Business, the two parcels will total 7.125 acres and have a depth of bOG feet. This will allow for a more orderly development of the area as seen from the attached Sketch of Proposed Development Plan marked Exhibit 3. It is your petitioner's intention if the re-zoning is approved, to erect a small attractive retail neighborhood shopping area that will be an asset to the Cutchogue community. The larger parcel will leave ample room for parking and attractive landscaping to set off the buildings. As seen from Exhibit 3, the northerly 60 feet of the combined parcel is being proposed as an extension of School House Road. This road will be developed simultaneously with the development of the parcel in accordance with the Town of Southold Highway Specifications and will be eventually dedicated to the Town when the required assessed valuation has been obtained. An application is being made simultaneously herewith to the Town Board for approval of the proposed highway layout. The property is bounded on the south, west and north by land of the Sacred Heart Church upon which is located the church and elementary school. The Sacred Heart Church is in favor of the pro- posed change of zone in that they are selling the parcel described in paragraph 1 of the petition. It is the Sacred Heart Church's intent to re-locate the recreational facilities on the westerly and northerly boundaries, of the premises which are the subject of this application. The parcel is bounded on the east by other land of your petitioner which is zoned "B" Light Business and which parcel will be developed simultaneously with the parcel which is the subject of the change of zone. Immediately across Griffing Street the property is zoned "B-l" General Business District most of which is currently vacant, however, on the southerly portion there is located the Cutchogue Post Office which is currently expanding its facilities.
