Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. The subject parcel is a corner lot.The northerly property line measures 100 feet and is adjacent to Wells Avenue,The easterly property line measures 206.42 feet„the southerly property line runs 41.47 feet along the wetlands then dips further south 86.26 feet along a wooden bulkhead then moves southwest. 16.10 feet along a bulkhead in disrepair,,then southwest 10.08 along the same bulkhead in disrepair,then southwest 14,42 feet along the same bulkhead in disrepair,the property move northerly 21.58 feet under a concrete bridge and then the northerly property line continues for a total of298,19 feet adjacent to Oaklawn Avenue. '"file lot is improved with a one-and one-half story frame dwelling with a detached two car garage. There is a wood deck in the rear east corner attached to the dwelling. There is a wooden dock at the southeast portion of the property adjacent to Jockey Creek. The wooden bulkhead at the southwest portion of the lot is in disrepair. There are wetlands on the southerly property adjacent to Jockey Creek as shown on the survey prepared by Nathan Taft Corwin 111, LS and dated April 27,2020. The proposed construction, on this nonconforming 22,099 square feet lot in the R-40 Zoning District is not permitted pursuant to Article XXIII Section 280-124 which states; lots measuring 20,000-39,999 square feet in total size require a front yard setback of 40 feet and a minimum side yard setback of 15 feet. The plan shows the front yard setback at 26.5 feet(Oaklawn Avenue)and minimum side yard setback of 7.8 feet The existing two-car garage will be demolished and a two-car garage will be attached to the home facing Wells Avenue reducing the current setbacks. A full second story will be built by adding dormers and changing the roof lines as shown on Site Plan drawings by Robert Stromski,Architect, dated December 20,2020. ADDITIONAL INFORMATION: Because of the proximity of the wetlands and Jockey Creek to the subject property, and the condition of the existing bulkheads,the applicant will be required to seek approval from the New York State Department of Conservation and the Southold Town Board of Trustees. Approval by the Suffolk County Department of Health Services is required for a Septic System. The applicant is also installing an in-ground swimming pool proposed in a code conforming location. A stop work order was issued on March 11, 2021 by the Southold Town Building Department for no permit to cut into the foundation and install a window. The matter has been remedied. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 5,2021 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 267-b b 5 . Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This is a waterfront community, and the applicant wishes to enjoy the waterfront views along with the water activities used by the other residents of the community. This residence is older and the new owner would Iike make modern changes as many others in the neighborhood have done. 2. Town Law 267-b 3 b The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance,since the parcel has a waterfront and two front yards and the existing house has a non-conforming setback. 3. Town Law 267-b b 3 . The variances granted herein are mathematically substantial, representing 33.75relief from the code for front yard setback and 48% relief from the code for side yard setback. However,the setback which is the other front yard on Wells Avenue requires no variance and is the applicant's architectural front yard.The front yard on Oaklawn Avenue is not utilized as a front yard,but rather a side yard. The proposed additions will not exceed the existing footprint on the Oaklawn Avenue side. 4. Town Law 267-1b b 4 . No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the Suffolk County Health Department for the new septic system. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. However, a corner lot poses a problem for the applicant as the code includes two front yards making variance relief the only option for setback relief 6. Town Law 2U67-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and alterations of their dwelling while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. RESOLUTION OF THE BOARD:In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Acampora,seconded by Member Weisman(Chairperson), and duly carried,to GRANT the variances as applied for,and shown on the on the Site Plan dated December 29,2020,and Architectural Drawings dated December 20,2020, prepared by Robert Stromski,Architect. SUBJECT TO THE FOLLOWING CONDITIONS: 1.The applicant shall get the necessary approval from the Southold Town Board of Trustees and the New York State Department of Environment Conservation for wetlands and bulkhead repairs. 2.The applicant shall have Suffolk County Health Department approval for the new septic system. 3. Prior to receiving a building permit, the owner(s) of the subject property cited herein must sign a statement acknowledging: a.That the applicant(s)have read this determination and understand the limits of the variance relief granted herein; b. That the applicant(s)will immediately contact the Building Department if a demolition,as defined by Section 280-4 of the Town Code,' occurs during construction, or any construction undertaken in any other way exceeds the scope of the approvals granted herein,or the issued building permit; c.That the applicants are aware that the Zoning Board of Appeals retains jurisdiction until the issuance of the Certificate of Occupancy and has the right, after a public hearing,to modify, suspend or revoke such approvals or any term or condition thereof or to impose thereon one or more new conditions, pursuant to Article XXV, Section 280-141 of the Town Code.
