Martocchia Supervisor of Town of Southold 16 South Street Greenport~ H.Y. 11944 Re: Application of Abe Goldrich for change of zone Dear Mr. Martocchia: If this change of zoning is denied, I will have been dreadfully wronged, i do not believe that a misinformed group of voters should influence you in coming to an incorrect decision in this matter. Primarily, you are supposed tolconsider only one matte~ -- the welfare of the Town of Southold -- and that is all. Actually, when you come right down to the nitty gritty, any business establishment in this area, whether built like the Taj Mahal or a Colonial Mansion, would meet with someone's disapprovals be it a competitive merchant or a neighbor who did not want the traffic. So~ be that as it may -- the fact remains that a mumber of years ago when this particular parcellwas zoned business it was decided by the Town Planning Board and so res~ated at each and every occasion since then that the proper, correct a~d needed depth of every parcel zoned "B~' business should be 200 feet deep, and this strict policy has continued to be maintained whenever the occasion arose. Secondly, we are not here to decide if I am a speculator or an investor or an improver -- nor what my motives are, nor what my profit is. Nobody asks the "nays" how much profit they will make when they sell their houses or building lots. The Town Board certainly is not interested in my costs° They are interested only in what I do with the property. Remembering all the time that the Town still, in one way or another, controls what is built eventually on this property, we must now consider who will be hurt most by ~ "low grade" developer, be it myself or anyone else. Since both contigual neighbors ~re presently zoned "B'~ business and since they did not appear against me, let us consider the next party to be hashed by a downgrading. Lo and behold it is myself m with seven acres of residential building lo!ts. It is most natural that my own property would be the one most !i~ely affected and ten times as greatly (with many homes possible therleon) as a resident living anywhere from 600 feet to a mile or more away. Thirdly, the "possiblm traffic lentrance" on the strip behind Mazarewski and Hoffey presently existsl (always subject to Town approval) and so traffic therefrom would not be greatly affected - possibly only increasing congestion of traffic on 27A if there were not sufficient parking area in the possibly proposed ~evelopment. --2-- Nobody has suggested that perhaps I might wish to build and improve -- the records show that, contrary to statements made a~ the Town Board Meeting and as George Wetmore and Lewis Realtors will attest, I have only purchased and improved and never sold at "tremendous" profits. In fact, I took the $1,800 rather than go through a court condemnation proceeding. If you have ever experienced this type of litigation you know how difficult it is. Be that as it may and the fact that 1/4 of an acre of business property value far exceeds $1,800, it has no bearing on this question as, likewise~ neither does my cost or other.personal reasons that I may have had. The facts remain: 1o There is 300 feet by 162 feet of "B" business property there now, in spite of the fact that all those that appeared took the attitude that it did not exist. 2. I am the one most closely affected by a downgrading. 3o It is a Town practice to allow 200 feet for business zoning and all "B" businesses in the area are so zoned, in fact, some run to 300 feet deep. 4. The Town still retains control of the types of business, quality of construction and means of access. 5. Kenney~s Road is actually not affected in any way whatsoever by the additional footage to the rear of my own property. 6. I do not seek any additional money from the Town -- true~ the property value will increase, but it will be to the Town's benefit likewise if the planning cormnission feels that a deep setback in construction adds to the aesthetic qualities. I refer you to the Town Planning Board who probably have many other reasons for this 200 foot figure. I do hereby petition the Town Board of the Town of Southold to change, modify and amend the Building Zone Ordinance of the Town of Southold, Suffolk County, New York, including the Building Zone Maps heretofore made a part thereof, as follows: By changing from '/tn Residential and Agricultural zone to "B" Business zone an area equivalent to that taken by the County.: of Suffolk by condemnation so as to provide petitioner with an -area depth of 200 feet with a frontage of 300.66 feet zoned "B" Business zone as existed immediately prior to condemnation. 3. Such requestis made for ~efollowlng reasons: Prior to the condemnation proceeding, petitioner owned premises having a frontage of 300 feet on the northwesterly side of Middle Road (County Road 27A) zoned as "B" Business to a depth of 200 feet. The Suffolk County Condemnation took away a depth of approximately 36 feet and petitioner seeks the zone change in order to place him in the same position as he was in prior to the condemnation.
