Dear Ms. Moore:
The Planning Board has reviewed the concept plan dated January 30, 2025 entitled
"67925 CR 48 Greenport Site Plan", submitted for the Lazy Fish Farm on Lot 19 of the
Rock Cove Estates Major Subdivision and has agreed that the plan meets the filed
Covenant and Restrictions (SCC Liber D00012106 Page 575). No amendments are
required if the concept plan is implemented as proposed.

Dear Chairman Rich:
We thank Mark Terry and Brian Cummings for meeting me and my clients
John Hughes and Caroline Fish yesterday. In accordance with the Declaration of
Covenants and Restrictions made February 12, 2001we ask for written
authorization to proceed with their farming operations on Lot 19.
My clients intend to operate a farm as described in paragraph 2 of the C&R's:
"the use and development of that portion designated as "Open Space Easement
Area" to farming operations and activities including but not limited to normal and
customary farming operations.
The farm plan focuses on crops that do not require a lot of tilling, plowing, etc.
but they will need to undertake mowing, pruning, irrigation, and harvesting.
The land will be allocated in the following way (Attached is a schematic of the
agricultural planting plan):
1. Peonies will be planted on about 3 acres because these plants are long lived,
generally require low maintenance, and have a short harvesting season in the
spring.
2. Annual cut-flowers will be planted on about 1-2 acres, and these will be
changed each year and will require soil preparation each year. These may
also be rotated with other annual crops such as vegetables, herbs, etc.
Harvest time will vary depending on the crop.
3. Fruit trees will be espaliered on about 0.5 acre because these are long-term
crops that can be managed in a small space and are harvested in the fall.
4. Raspberries will be trellised on about 0.5 acres because these are long-term
crops that can be managed in a small space and are harvested in the fall.
Prior to undertaking the farming activities within 100' of the freshwater
wetlands the applicants will obtain Southold Town Trustees permit.
Addressing the C&R's:
Paragraph 3. a) the applicants are contract vendees and awaiting your letter
authorizing the proposed farming activities to close on the title and begin the
farming operations. A conservation plan prepared by Suffolk County Soil and
Water was updated and submitted to the Board on January 15, 2025.
b) No re-grading is proposed, the agricultural operations will maintain the
natural contours of the land.
c) No topsoil, loam, sand, gravel, rock or minerals will be excavated or
removed except for what is customary and necessary in agricultural operations.
d) Good Farm management practices will be maintained, and erosion of the
land will be minimized.
e) Only farm vehicles are expected in the open space.
f) standard farming activity will be conducted on the property. Removal of
trees will be required to the extent necessary to conduct farming operations.
g) no liquid or solid waste, etc. will be permitted on the property.
h) no signage or advertising is anticipated to commence the farming
operation.
Paragraph 4. a) the drainage easement is not on lot 19, nevertheless, it shall not be
obstructed by the farming operation.
Paragraph 5. The use of the open space for agricultural purposes will be private,
subject to reasonable inspection by the Town for compliance with covenants.
Paragraph 6. Access to the agricultural lot is from Homestead Way.
John Hughes and Caroline Fish shall conduct normal and customary farming
operations, including preparation of the land for cultivation, mowing, pruning,
irrigation, and harvest. Converting the land from fallow to farmable land (e.g.,
mowing, tilling, soil amendment). Preparing the farmable land for planting (e.g.,
digging, plowing, trellising etc.) Erecting a barn, fencing, greenhouses (high
hoops), and a gate for securing equipment to be stored on the preserved farmland

Dear Michael:
My clients John Hughes and Caroline Fish wish to farm the above parcel,
and a current survey of the parcel is required. The surveyor has advised us that he
cannot complete the survey unless the perimeter of the lot is made accessible. I am
attaching the 2003 survey prepared for a prior owner. I highlighted it in yellow
where neighbors appear to have cleared and installed fences. The parcel was
cleared previously but is now heavily overgrown.
In accordance with our meeting with yourself and our contractor, Gerard
Orientale, Soundside Landscaping Inc., we advised you that we need to clear the
underbrush around the perimeter of the property to prepare a survey. No trees will
be cut down. You requested a letter with a copy to the Planning department, the
Trustee's and Town Attorney's office (code enforcement).
Mr. Orientale found that clearing the property line for the purposes of
surveying will require in some areas heavy-duty brush cutting equipment. He also
found that neighbors installed property line fences and dumped yard waste behind
their fence and piled the yard waste onto the subject property. The dumping has
continued for many years and now would require a small bulldozer to remove or
push away from the property line the yard waste which has piled up behind the
fence and along the property line.
The equipment capable of clearing the brush will clear an area from 5 feet
(width of the equipment) to 15 feet (connected vines & shrubs), depending on the
degree of dumping and vegetation. This step is for surveying purposes only.
This parcel has a "pond" depression which according to previous soil and
water surveys is fed by groundwater. We had Cole Environmental inspect and
flag the area they could access by land and with drones. The wetlands are, at the
closest point, more than 160' to any property line. Therefore, any activity along
the property line for the purpose of preparing a survey is not in the Trustee's
jurisdiction. I met with the Trustees and the Trustees acknowledged that their
involvement is not required for this purpose.
Please note that once the survey is prepared, we will return to the Trustees
and Planning Board to address the farm use and prepare the land for cultivation
and planting.
In anticipation of calls from the neighbors inquiring as to any activity on the
property, we are notifying your office as well as the Planning Department, the
Trustees and Town Attorney's office.
