SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a 29,260 sq. ft. irregularly shaped parcel located in an R-40 zoning district. The property has a road frontage of 204.44 feet along Vanston Road, then turns southeast for 186.94 feet, then it turns southwest for 170.00 feet to Wunneweta Road, with a road frontage of 101.06 ft as it returns to Vanston Road. The property is improved with a single-family,two-story residence and a two-story garage with apartment on the second floor, as shown on the survey by Nathan Taft Corwin III, L.S., last revised April 17, 2024. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-122; and the Building Inspector's September 20, 2024 Notice of Disapproval based on an application for a permit to legalize "as built" alterations to an existing"as built"accessory apartment in an accessory building and to construct a deck addition to the existing accessory building;at, 1)alterations and additions to a nonconforming building containing a conforming use creates a new nonconformance or increase in the degree of nonconformity; located at: 1235 Wunneweta Road, Cutchogue NY. SCTM No. 1000-104-12-12.2. RELIEF REQUESTED: The applicant requests a variance to legalize an"as-built"deck and"as built"alterations to the accessory building. A non-conforming use may not be enlarged, and the deck increases the non-conformity of the accessory garage located in the front yard. ADDITIONAL INFORMATION: This accessory apartment exists currently under ZBA#7036SE dated March 20, 2017. The ownership of the property changed thereby extinguishing the special exception. The current owner wants to use the accessory apartment for a parent of the owner. The accessory garage currently exists under a ZBA variance # 5073 dated March 8, 2002, granted to construct a garage in a non-conforming front yard location. As per owners' testimony at the public hearing, the occupant of the second-floor apartment will be their mother, who uses a wheelchair, and the exterior staircase and second floor deck/balcony are necessary for the installation of a chair lift Page 2,January 23,2025 #7977, Spahidakis—Area Variance SCTM No. 1000-104-12-12.2 to permit wheelchair accessibility. A neighbor of the property spoke at the hearing about runoff from the property due to large amounts of soil on site, and was satisfied by the owner/applicant that a resolution was forthcoming in the spring season. A stop work order was issued by the Building Department for stormwater control and work done on the principal dwelling and accessory building without permits. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 9,2025, at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The accessory garage currently exists under ZBA variance#5073 dated March 8, 2002, and Certificate of Occupancy # Z29346 dated April 8, 2003. The stair and deck/balcony in question is on the rear of the accessory garage which will not be seen by the public from the principal front yard, Wunneweta, on the subject corner lot. Although it will be visible from the secondary front yard, Vanston Road, it meets the code required front yard setback and there is ample room to install evergreen screening to create visual privacy. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue, other than an area variance. Due to the fact that the garage is in a non-conforming location, any addition to this structure would require variance relief for increasing the nonconformity. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 100%relief from the code. However, the existing accessory garage has been in place legally for a number of years, along with the accessory apartment on the second floor,without adverse impact.Moreover,the accessory structure with exterior staircase and second story balcony/deck entry to the apartment is compliant with all setbacks and lot coverage code requirements 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions of this board. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of the deck/platform area for maneuvering a wheelchair to the second-floor apartment while preserving and protecting the character of the neighborhood and the health, 'safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Lehnert,seconded by Member Steinbugler,and duly carried, to GRANT the variance as applied for and shown on the plans drawn by Kehl Design Associates and signed and sealed by John J. The applicant must apply to the Building Department for a building permit for the "as built" improvement(s)within 90 days of the date of this decision and submit same to the Office of the Zoning Board of Appeals,or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a building permit in the time allotted. 2. The applicant must obtain a Certificate of Occupancy from the Building Department for the "as built" improvement(s)and submit same to the Office of the Zoning Board of Appeals within 12 months of this decision or submit a written request for an extension to the Board of Appeals setting forth the reason(s) why the applicant was unable to obtain a Certificate of occupancy in the time allotted. 3. The deck and stairs shall remain open to the sky,and not covered or enclosed in any way. 4. The"As-built"deck shall not be converted to habitable space.
