Te[eoho~e SO $-2660 MINUTES SOUTHOLD TOWN BOARD OF APPEALS September 28, 1961 A regular meeting of the Southold Town Board of App-eals was held 7:30 P.M., Thursday, September 28, 1961 at the Town Clerk Office, Main Road, Southold, New York. There were present: Messers. Robert Bergen, Herbert Rosenberg and Charles Grigon~s, Jr. Absent: Messrs. Robert W. Gillispie, Jr., and Serge Doyen, Jr. PUBLIC HEARING: Appeal No. 408 - 7:30 P.M. (E.D.S.T.), upon application of The Orient Central Cemetery Association, Orient, New York, for a special exception in accordance with the Zoning Ordinance~ Article III, Section 300, Subsection 6B, for permission to extend the existing cemetery, Location of property: north side Orchard Street, Orient, New York, bounded north by-W. Y. Terry, Jr., east by Jagger Estate, south by Orchard Street and west by other land of The Orient Central Cemetery Association. No fee required. Southold Town Board of Appeals -2- September 28, 1961 Mr. Rosenberg, Acting Chairman, opened the hearing by read- lng application for a special exception, legal notice of hearing, affidavit attesting to its publication in the official newspaper and affidavit of Town Clerk relative to posting Amendment No. 45. MR. ROSENBERG: Is there anyone present who wishes to speak for this application? MR. IRVING L. PRICE, Jr., Greenport: The Orient Central Cemetery Association with an eye to the future has contracted to purchase additional acreage from the adjoining property owners at what the Orient Central Cemetery Association finds to be a very advantageous p~ice. With the so-called population explosion the Central Cemetery Association believes that now is the time to secure this additional room for burials in the future. There is a strong possibility that this land and other land will not be available in the future and now is the time to take advantage of it, and the Association has the funds. Of course, if we receive the Board of Appeals' approval we still are subject to the approval of the Board of Supervisors, Town Board, County Planning Board and State Health Department. We are complying with all 12 items in the Ordinance. This property is vacant, it is becoming uneconomical as far as farming is concerned. Since it is an extension of the present cemetery it will not prevent the orderly and reasonable use of adjoining property. The safety, health and welfare of the Town ._will not be affected because it will only be an extension of the present use as it has been there many many years. MR. ROSENBERG: Are there any residences on this adjoining property? MR. PRICE: No, this is only a small part of a large tract of vacant land. We are only taking a little over four acres of the large tract. MR. ROSENBERG: Do you recall when the original cemetery was established? MR. PRICE: No, but I am sure it has been there over 100 years. Southold Town Board of Appeals -3- September 28, 1961 After investigation and inspection the Board finds that this non-profit cemetery association which has besn in operation for many years in this smalI farming community has the opportunity to secure additional land. In that way the residents may continue to have their own burial ground. This cemetery is located well away from a main road and is in the midst of farms which have been operated by the same families for many generations. The Board has found no objections to this expansion, quite the contrary. There is full compliance with the standards or requisites set forth in the Ordinance and the Board feels that no conditions are necessary and thatthe right to the exception exists. On motion of Mr. Bergen~ seoonded by Mr. Grigonis, it was RESOL ED that the Orient Central Cemetery Association be granted permission to extend the existing cemetery. Vote of the Board: Ayes:- Mr. Rosenberg, Mr. Bergen, and Mr. Grigonis. On motion of Mr. Bergen, seconded by Mr. Rosenberg, it was RESOLVED that the minutes of the meeting of September 7, 1961 be approved as submitted. Vote of the Board: Ayes:- Mr. Rosenberg, Mr. Bergen, and Mr. Grigonis. On motion of Mr. Grigonis, seconded by Mr. Bergen, it was RESOLVED that the minutes of the meeting of September 25, 1961 b~ approved as submitted. Vote of the Board: Ayes:- Mr. Rosenberg, Mr. Bergen, and Mr. Grigonis. Southold Town Board of Appeals -4- September 28, 1961 On motion of Mr. Bergen, seconded by Mr. Grigonis, it was RESOLVED that the Board of Appeals set 7:30 P.M. (E.D.S.T.), Thursday, October 12, 1961, Town Clerk Office, Main Road, Southold, New York as time and place for hearing upon application of Jesse and Marion Monsell, Box 44, North Cape May, New Jersey, for a variance in accordance with the Zoning Ordinance, Article X, Section 1000A, for permission to divide property and sell less than prescribed by the Ordinance. Location of property: east side Bailey Avenue, Greenport, New York, bounded north by R. Stakey, east by right-of- way, south by G. Tuthill, and west by Bailey Avenue. Vote of the Board: Ayes:- ~r. Rosenberg, Mr. Bergen, and Mr. Grigonis. On motion of Mr. Grigonis, ~econded by Mr. Bergen, it was RESOLVED that the Board of Appeals set 7:45 P.M. (E.D.S.~.), Thursday, October 12, 1961, Town Clerk Office, Main Road, Southold, New York, as time and place for hearing upon application of William Wetmore, a/c Y. Y. ~wang, Bay Shore Road, Arshamomaque, Greenport, New York, for a variance in accordance with the Zoning Ordinance, Article III, Section 307, for permission to reduce side yard set- back. Location of property: east side Bay Shore Road, Arshaomomaque~ Greenport, New¥ork,~Lot No. 77 on Amended Map A of Peconic Bay Estates. Vote of the Board: Ayes:- Mr. Rosenberg, Mr. Bergen, and Mr. Grigonis. PUBLIC HEARING: Appeal No. 409 - 7:30 P.M. (E.D.S.T.), upon application of James Wasson, Peconic Bay Boulevard, Laurel, New York, for a variance in accordance with the Zoning Ordinance, ArticleIII, Section 303~ ~nd Article X, Section 1000A~ for permission to reduce frontage and use as a single lot. Location of property: north side Peconic Bay Boulevard, Laurel, New York, bounded north by Marguerite Wasson, east by Edward Booth, south by Peconic Bay Boulevard, and west by Marguerite Wasson. Fee paid $15.00/ Mr. Rosenberg, Acting Chairman, opened the hearing by reading application for a variance, legal notice of hearing and affidavit attesting to its publication in the official newspaper. Southold Town Board of Appeals -5- September 28, 1961 THE CHAIRMAN: Is thereanyone present who wishes to speak for this application? (There%as no reponse.) THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) Th~s Appeal No. 409 concerns the realignment of two adjoining lots. One of these lots was developed in 1904 prior to the establishment of Peconic Bay Boulevard, and the other in 1920. As noted in the appeal the purpose of the realignment is to place the driveway on the proper lot and would increase the west lot frontage of 95 feet while reducing the easterly lot to 90 feet. After investigation and inspection the Board finds that there exists an unnecessary hardship as the property about to be sold would not have a driveway with its present frontage. At this time the two properties are used by the same family. This is a unique situation and the character of the neighborhood would not be changed. On motion of Mr. Bergen, seconded by M~r. Grigonis, it was RESOLVED that James Wesson be granted permission to reduce frontage and use as a single lot property located on the north side Peconic Bay Boulevard, Laurel, New York. Vote of the Board: Ayes:- Mr. Bergen, Mr. Rosenberg, and Mr. Grigonms. The next meeting of the Southold Town Board of Appeals will be held 7:30 P.M., Thursday, October 5, 1961.
