of the Southold Town Board held on
May 24, 1966, as follows'
i I. By amending ARTICLE IV B of i
~said Ordinance by adding a new sec-~

SECTION 442 -- Notwithstanding ~
any other provisions of this .article,
a building or a combination of
buildings .containing retail stores,

mercantile establishments, offices,
banks and ,financial institt~tions,,
commonly known as shopping
centers, may be erected or altered in
the "B-2" Business District, subject,
however, to the following require-
ments.
1. The lot area shall be not less
' than one (1) acre.
2. At least twenty-five .(25) per.
cent of the lot area shall be land-
scaped with grass and plantings.
3. The required front 'yards shall
be not less than twenty-five (25)
feet except that where the property
in the vicinity is partly built up
with permanent buildings and an.
average setback line has been estab-
lished, no buildings . shall 'pro-:
ject beyond the line of the average
setback so established.
4. The required side yards shall
be not less than twenty-five (25)
feet.
5. The required rear yard shall be
not less than twenty-five (25) fee. t.
6 Parking shall be provided, in
offstreet paved parking areas which

Moved by Justice Tuthill; seconded by Councilman Demarest;
WHEREAS, the Town Board on its own motion proposed a change of
the Building Zone Ordinance of the Town of $outhold, Suffolk
County, New York, and
WHEREAS, the said petition was referred to the Planning Board for
its official recommendation and report, and
WHEREAS, the Town Board pursuant to due notice thereof, held a
hearing on May 13, 1966 at which time all interested persons

SUPERVISOR ALBERTSON: I will open the hearing at this time by
reading the legal notice of hearing.
"Pursuant to Section 265 of the Town Law and Article IX of the
Building Zone Ordinance of the Town of Southold, Suffolk County,
New York, public hearings will be held by the Southold Town Board
in the Office of the Supervisor, 16 South Street, Greenport, New
York, in said Town on the 13th day of May, 1966, at 7:30 o'clock
in the evening of said day on the following proposals to amend the
Building Zone Ordinance (including the Building Zone Maps) of the
Town of Southold, Suffolk County, New York.
"1. By amending ARTICLE IV B of said Ordinance by adding a new
section thereto to be Section 442, to read as follows:
"SECTION 442- Notwithstanding any other provisions of this
Article, a building or a combination of buildings containing retail

ORDINANCE
Pursuant to Section 265 of the Town Law and Article
of the Building Zone Ordinance of the Town of Southold,
Suffolk County, New YOrk, public hearings will be held by
the Southold Town Board in the Office of the Supe~isor,
16 South Street,. Greenport, New York, in said Town on the

financial institutions, commonly known as shopping
centers, may be erected or altered in the "B-2"

plantings.
3. The required front yards shall be not less

Gentlemen:
This is to certify that the following action was taken by the
Southold Town Planning Board at a regular meeting held on April 5,
1966:
In the matter of the proposal of the Southold Town Board to
amend the Building Zone Ordinance to provide requirements for the
erection of shopping centers to provide Rat building permits be
required for the erection or addition to all buildings and that a
minimum lot area be required for each family occupying a dwelling
unit, it is hereby
RESOLVED that the Southold Town Planning Board recommend to the
Southold Town Board the following amendments:
I. By amending Article IV B of said Ordinance by adding a new
section thereto to be Section 442, to read as follows:
SECTION 442 - Notwithstanding any other provisions of
this Article, a building or a combination of buildings containing
retail stores, mercantile establishments, offices, banks and
financial institutions, commonly known as shopping centers,
may be erected or altered in the "B-2" Business District, subject,
however, to the following requirements:
1. The lot area shall be not less than one (1) acre.
2. At least twenty-five (25%) percent of the lot area
shall be landscaped with grass and plantings.

vicinity is partly built up with permanent buildings and
an average setback line has been established, no buildings
shall project beyond the line of the average setback so
established.
4. The required side yards shall be not less than
twenty-five (25) feet.
5. The required rear yard shall be not less than
twenty-five (25) feet.
§. Parking shall be provided in offstreet paved parking
areas which shall providefor one (1) parking space, three
hundred thirty-four (334) square feet in area, for each one
hundred (100) square feet of sales floor area of office
floor area in each building.
7. Ail rainfall and storm water accumulated on the
premises shall be returned to the ground within the boundaries
of the premises.
II. By amending Article VII, Section 703, of said
Ordinance to read as follows:
SECTION 703 - No building shall be erected or added
to until a permit therefor has been issued by the Building
Inspector.
III. By amending Article X of said ordinance by adding
thereto a new section to be Section 1008, to read as follows:
SECTION 1008 - Notwithstanding any other provisions of
this Ordinance, no multiple dwelling shall be erected, altered
or used which does not provide a lot area of at least
twelve thousand five hundred (12,500) square feet for each
family or dwelling unit.
It is the opinion of the Planning Board that these amendments
are in the best interest of Southold Town.

to require that no multiple dwellings shall be erected, altered or
used unless they provide a minimum lot area for each family or
dwelling unit. You will note that I have left; blank the exact number
of square feet required for each family or dwelling unit. .At the
meeting, it wa~ ~ugge~ted that not m~ve than three family or dwelling
units be permitted on an aere of land. However, in looking at the

ordinance, I find that a one-family dwelling can be constructed
on an area of 12,500 square feet, and a two-family dwellin~
may be constructed on an area of 25° 000 square feet by special
exception permit. If it is proposed to limit the number of units
to three per acre, this would mean that the ~quare foot area for
each family unit would be 14, 520 square feet, which is greater
than required for' a one or two-family dwelling. I have therefore
left the amount of ~quare foot area blank ~n order that the matter
can be fu~h~r discussed at the next meeting of the Town Board.

WHEREAS, this Board believes it in the public interest that the
Building Zone Ordinance of the Town of Southold be amended to provide
