after a public hearing held pursuant

SUPERVISOR ALBERTSON: It is now 7:30 and I will open the hearing by
reading the legal notice.
"NOTICE OF HEARING OBI PROPOSAL TO AMEND ZONING ORDINANCE.
Pursuant to Section 265 of the Town Law and Article IX of the Building Zone
Ordinance of the Town of SouthoId, Suffolk County, New York, public hearing wiII
be held by the SouthoId Town Board at the Office of the Supervisor. 16 South Street,
Greenport, New -fork, in said Town on the 30th day of June 1964, at 7:30 o~clock
in the evening of said day, on the folIowing proposal to amend the Building Zone
Ordinance (including the Build£ng Zone Maps) of the Town of SouthoId, Suffolk
County, New York.
I. By amending Article III, Section 300, of said Ordinance by adding a new
subdivision 4A, to read as follows:
4A. Stables and riding academies, when authorized as a

to be Section 1000B, to read as follows:
Section 1000 B - No dwelling shall hereafter be erected or altered
in any district unless provisions shaII be made therein for not less
than eight hundred and fifty (850) square feet of space within the
exterior of the foundation walls at ground level excIusive of a garage,
carport, carpark, open porch or terraces, or other extensions
outside the body of the house. Provided, however, that fifty (50%)
percent of the habitable area of the second story may be used and
applied to the area requirements of the first floor.
Not withstanding anything hereinabove to the contrary ~he area
of the second floor shall be included in computing the area of the
total habitable area when the finished floor of the second story has
a clear headroom of not less than seven and one-half (7-I/2) feet
with knee walls of not less than five (5) feet and when the second floor
is serviced by a permanently placed stairway.
The provisions of this section shall not apply to dwellings Iocated
within a tourist camp as defined in the SouthoId Town Ordinance
providing for the regulation of tourist camps, house trailer camps,
house trailers or similar establishments when a permit for such
tourist camp has been issued by the Town Board pursuant to the
provisions of said Ordinance.
Any person desiring to be heard on the proposed amendments should appear at

Southold Town Planning Board at a mee[ing held on June 9, 1964: In/he matter
of the proposal of the Southold Town Board to amend the Building Zone Ordinance,
the Planning Board favorably recommends to the Town Board the following
amendments: (Amendments not read) The Planning Board finds that the
changing of times and demands of the Town have increased to the point where we
feel that the proposed changes in the Ordinance are necessary. The Planning
Board feels that these changes are in the public interest of the Town of Southold.
Respectfully submitted, John Wick_ham, Chairman."
SUPERVISOR ALBERTSON:

At this time we will ask any of those in favor
(Cutchogue) Mr. Chairman and Members of the
Board. I am definitely in favor of a changing of the Zoning Ordinance to admit
the operation of golf courses in a residential area. What I am worried about is
how the Zoning Board of Appeals will handle these exceptions. Is there going to
be any norm or is it going to stand on each case on its merits.
SUPERVISOR ALBERTSON: I think this will be governed by the thinking of
the Board of Appeals which up to this point has been pretty much what is best
for the Town of Southold.
MR. CRON: I appreciate this but most of these applications are going to
apply to golf courses in residential areas where the golf course will be surrounded
by private residences which, in most cases, is going to bring about objections.

SUPERVISOR ALBERTSON: If I had to speak for them I would say (that they
will consider all objections and act in the best interests of the Town. )
MR. CRON: We will go on record as being in favor of the Zoning Ordinance
amendments.
SUPERVISOR ALBERTSON: Anyone else ?
RUSSELL CASE: (Cutchogue) I would like to go on record as being in favor.
SUPERVISOR ALBERTSON: Anyone else wish to be heard in favor of. Anyone
in opposition toy Anyone wish to be heard one way or the other2
MR. CRON: How soon after the enactment can we proceed to make a special
exception ?
SUPERVISOR ALBERTSON: I will let the Town Attorney answer that.
ROBERT W. TASKERt ESQ.: Ten days after publication of the enactment of
the changes.
SUPERVISOR ALBERTSON: Anyone else wish to be heard one way or the
other, if not, we will close the hearing at this time for the further deliberation of
the Board.

V. By amending Article X of said ordinance by adding thereto a
new section to be Section 1000B, to read as follows:
Section 1000B- No dwelling shall hereafter be erected
or altered in any district unless provisions shall be made
therein for not less than eight hundred and fifty (850) square
feet of space within the exterior of the foundation walls at
ground level exclusive of a garage, carport, carpark, open
porch, or terraces, or other extensions outside the body of
the house. Provided, however, that fift~ (50%) percent of the
habitable area of the second story may be used and applied
to the area requirement of the first floor.
Notwithstanding anything hereinabove to the contrary the
area of the second floor shall be included in computing the
area of the total habitable area when the finished floor of the
second story has a clea~ headroom of not less than seven and
one-half (7½) feet with knee walls of not less than five (5)
feet and when the second floor is serviced by a permanently
placed stairway.
The provisions of this section shall not apply to dwell-
ings located within a tourist camp as defined in the Southold
Town Ordinance providing for the regulation of tourist
camps, house trailer camps, house trailers or similar
establishments when a permit for such tourist camp has been
issured by the Town Board pursuant to the provisions of said
Ordinance.
The Planning Board finds that the changing of times and demands
on the Town have increased to the point where we feel that the
proposed changes in the Ordinance are necessary. The Planning Board
feels that these changes are in the public interest of the Town
of Southold.

At a meeting of the Town Board of the Tovzn of Southold held at the
Supervisor~s Office, Greenport, New York, on the day of May, 1964,
WHEREAS, this Board desires to amend the provisions of the
Building Zone Ordinance of the Town of Southoid as hereinafter set forth,
NOW, THEREFORE, BE IT RESOLVED~ that the Town Clerk of the
Town of Southold be and he hereby is authorized and directed to transmit to
the Planning Board of the Town of Southold a certified copy of this resolution
together with a request in writing to said Planning Board instructing said
Planning Board to prepare an official report with its recommendations on
said proposed amendments pursuant to the provisions of Article IX,
Section 900 of the Building Zone Ordinance of the Town of SouthoId~ said
proposed amendments being as follows, to wit:
I. By amending Article III~ Section 300 of said Ordinance by adding
a new subdivision, to be subdivision 4A, to read as follows:
4A. Stables and riding academies, when authorized
as a special exception by the Board of Appeals as herein-
after provided.
II. By amending Article III, Section 300, subdivision 5 of said
Ordinance to read as follows:
5. Clubs, fraternity houses and golf courses, when
authorized as a special exception by the Board of Appeals
as hereinafter provided.
III. By amending Article IV, Section 400, subdivision 5 of said
Ordinance to read as follows:
5. Offices, banks and financial institutions.
IV. By amending Article IV, Section 400, subdivision 10 of said
Ordinance to read as follows:
10. Storage houses, express carting or hauling offices
or stations, ice manufacturing, yards for storage and sale
of coal and building materials.
V. By amending Article X of said Ordinance by adding thereto a new
section to be Section 1000B, to read as follows:
