I will open this hearing by reading the
NOTICE OF HEARING ON PROPOSAL TO AMEND ZONING
ORDINANCE- Pursuant to Section 265 of the Town Law and Article IX
of the Building Zone ordinance of the Town of Southold, suffolk
County, New York, public hearings will be held by the Southold Town
Board at the office of the Supervisor, 16 South Street, Greenport,
New York, in said town on the 9th day of July, 1963, at 7:30 o'clock
in the evening of said day, on the following proposals to amend the
Building Zone Ordinance (including the Building Zone Maps) of the Town
of Southold, suffolk County, New York.
"1. By changing from "A" Residential and Agricultural District
to "B" Business District the following described property:

"Gentlemen: This is to certify that the following action was
taken by the Southold Town Planning Board on June 11, 1963:
"In the matter of the petition of Joseph Riccardo and Jack
Driscoll for a change of zone from "A" Residential and Agricultural
District to "B" Business District on certain real property situated
at Mattituck, New York, and more particularly bounded and described

with agents for the petitioner and adjoining cemetery association
and feel it is reasonable.
"The purchaser has expressed a willingness to deed the cemetery
association 10 feet along the easterly line of petitioner's property
provided it is maintained in woods at all times. We feel that this
is insufficient buffer zone between the residential zone represented
by the cemetery association and a business zone. We feel that the
new owners should be required to maintain 10 ft. also in woods which
would provide a 20 ft. buffer zone.

SUPERVISOR ALBERTSON: Is there anyone present who wishes to
speak in favor of this proposed change of zone?
WILLIAM WICKHAM, ESQ.; I would like to take just a moment to
speak on behalf of the petitioners. There has always been some
question in my mind why this was left in an "A" Residential zone
when the zoning ordinance was adopted because on three sides the
adjoining property has been zoned commercial. Perhaps it was in
deference to the cemetery being there, I don't know, but I do think
we have to recognize the fact this is becoming more and more a
commercial area.
I think there are several reasons why it would be beneficial to
have this zoned commercial. ~e first, of course, being the area is
commercial now, that all village or hamlet business sections have
to have somewhere to expand and Mattituck seems to be expanding
in that direction. The physical aspects of the particular parcel
I do not know if you have examined it recently, but the contour is
very uneven. There are some low and even swampy spots in the back
and I think it would be almost impossible to develop that property
in a residential way. To develop it is going to cost a tremendous
lot of money. The trees will have to be taken down in order to level
that throughout. That is, to take it down on the road side and bull d
up on the back side and eliminate the holes and swampy areas.
I do not want to dwell on the suggestions of the Planning Board
as to a buffer zone since I was in on some of the conversations and
also had a talk with one of the cemetery association this morning.
In a way I think the cemetery might like to have expanded in that
direction, also I have questioned their thinking in wanting to do
it. They are still planning to try to buy the Husing property
in back. I question that move, but that, of course, is their
own problem. I~ppen to be a trustee of the Cutchogue Cemetery
Association and I know the trustees have been impressed with the
increasing number of applications that have come in in the last few
years not only from people coming out here but people from the
Mattituck Area who are coming down to Cutchogue in preference to
buying cemetery plots in Mattituck. In other words they recognize
the fact this cemetery is in an area that may not be to their
liking for purchase of plots and Cutchogue is off the beaten path
and much more desirable.

As to the buffer zone. The purchasers are perfectly willing
to deed a 10 ft. strip to the Cemetery Association to be used as a
buffer zone with a stipulation that it not be used for burial
purposes but as a barrier or buffer between the cemetery and the area.
We can't insist that the trees stay there because it might not be
to the liking of the cemetery people to maintain and care for them.
We would insist that it not be used for cemetery purposes. The
owners would also be willing to have, as long as the property remains
commercial, that there be a 30 ft. setback between the new line and
the buildings. In other words that would be a setback altogether
of 40 feet from the property line.
SUPERVISOR ALBERTSON: Is there anyone present who wishes to
speak against this application?
(There was no response.)
SUPERVISOR ALBERTSON: Is there anyone else present who wishes
to speak in favor of this application?
MR. STANLEY SLEDJESKI: The members of the cemetery association
were very much satisfied if they would have a 10 ft. strip and 30 ft.
setback. They were perfectly satisfied if it would stay that way.
SUPERVISOR ALBERTSON: Anything further ?

close the hearing at this time for the further deliberation of the
Town Board.
