A Certified copy is enclosed. Please prepare an official report defining the Planning Department's recommendations with regard to the proposed Local Law and forward it to me at a suitable time in order to allow sufficient time for the Town Board to review it before the public hearing. This proposed local law will also be transmitted to the LWRP Coordinator for his review. The date and time for the public hearing is 4:30 P.M.,Tuesday, March 4, 2025 respectfully. Born Deputy Town Clerk Enclosures RESOLUTION 2025-107 ADOPTED DOC ID: 21043 THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO. 2025-107 WAS ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON JANUARY 21, 2025: WHEREAS,that there has been presented to the Town Board of the Town of Southold, Suffolk County,New York, on the 21" day of January, 2025, a Local Law entitled "A Local tears, in rclatlon to Aiucn(imetits to Cha t,cr 280 Z()nin ' now therefor be it RESOLVED that the°rown Board of the Town of Southold will hold a public hearing on the aforesaid. Southold Town I4all, 53095 Main load, Southold,New York, on the 4tn day of March, 2025 at 4:30 PM., at which time all interested persons will be given an opportunity to be heard and be it RESOLVED that the Town Board of the Town of Southold requests that the Planning Board prepare a report and recommendations on the proposed Amendments, including SEQRA and LWRP report and recommendations; and be it further RESOLVED that the Town Board of the Town of Southold requests that the Suffolk County Planning Commission prepare a report and recommendations on the proposed Amendments. The proposed Local Law entitled, "A Local Liam, in relation to Amendments to Chapter 28C1 Zoning,reads as follows: LOCAL LAW NO. 2025 A Local Law entitled, "A Local Law in relation to Amendments to Chapter 280 Zoning" BE IT ENACTED by the Town Board of the Town of Southold as follows: I. Purpose - The purpose of this local law is to further define lot recognition. Il. Chapter 280 of the Code of the Town of Southold is hereby amended to include the underlined words and remove the struck through words as follows: § 280-9. Lot recognition. A. A lot created by deed or Town approval shall be recognized by the Town if any one of the following standards apply-and4f-tlw-lots--ii- -not-n -e : (1) The identical lot was created by deed recorded in the Suffolk County Clerk's office on or before June 30, 1983, and the lot conformed to the minimum lot requirement(s) set forth in Bulk Schedule AA' as of the date of lot creation. (2) The lot(s) in question is/are approved by the Southold Town Planning Board. Resolution 2025-107 Board Meeting of January 21, 2025 (3) The lot(s) in question is/are shown on a subdivision map approved by the Southold Town Board prior to June 30, 1983. (4) The lot(s) in question is/are approved and/or recognized by formal action of the Board of Appeals prior to June 30, 1983. (5) The lots have merged pursuant to the provisions of§ 280-10 of this Chapter. B. All lots which are not recognized by the Town pursuant to the above section shall not receive any building permits or other development entitlements. C. All lots are subject to the merger provisions of§ 280-10. D. All lots merged pursuant to §280-10 but which fail to meet bulk requirements shall nonetheless be recognized as a finer ed lot. I1I. SEVERABILITY If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid. IV. EFFECTIVE DATE This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law.
