I will open the hearing by reading the
legal notice.
Pursuant to Section 265 of the Town Law and Article IX of the
Building Zone Ordinance of the Town of Southold, Suffolk County,
New York, public hearings will be held by the Southold Town Board
at the office of the Supervisor, 16 South Street, Greenport, New
York, in said town on the 23rd day of March, 1961, at 7:30 o'clock
in the evening of said day, on the following proposal to amend the
Building Zone Ordinance (including the Building Zone Maps) of the
Town of Southold, Suffolk County, New York.

February 27, 1961, Gentlemen: This is to certify that
the following action was taken by the Southold Town Planning
Board on February 21, 1961:
In th~ matter of the proposed change of zone from "A"
Residential and Agricultural District to "B" Business District
on the Town Board's own motion on property of Martin Filla, William
J. Baxter and Procan, Inc., and John J. McManus property, which

is described as follows:

this as it was previously read in the legal notice.)
RESOLVED that the Planning Board recommend to the Town Board
that this change of zone from "A" Residential and Agricultural
District to "B" Business District be made on the Town Board's
own motion.
Members of the Planning Board have visited the site and are
of the opinion that the project proposed by William J. Baxter and
Procan, Inc. will greatly benefit the community, as well as provide
jobs for the local residents.
With relation to the Filla property,
Mr. Martin Filla has a large potato storage building and facilities
for grading and marketing potatoes and a "B" Business District
would be particularly suitable.
The amall 60 ft. front parcel in
the name of McManus should also be included in this change of zone
so that the entire area would be included in the "B" Business
District.

I represent Mr. Baxter and Mr. Filla in making
these applications.
Mr. Baxter is a member of the firm of Baxter
Brothers who have their executive offices at 68 West Street, New
York City.
They are investment counselors and they have a tremendous
mailing list for their daily and weekly reporting. Presently, in
order to get these reports out they are renting two floors at 73
Pearl Street.
They have been unsatisfied and dissatisfied for a
number of years due to the exorbitant rents and also the labor
supply was none too good. For the last few years they have had
a limited mailing operation in New Suffolk and Cutchogue as an
experiment and it has proved so successful that they want to
locate their whole operation out here. They would like to find
a place fair lyclose to Mattituck because that is a good business
section and they have made efforts to find available places.
This site satisfied the firm well because it is fairly close
to Mattituck, and the size is very satisfactory.
It has a point
of having a frontage on two roads so that with trucking and so
forth, that operation would be handled from Elijah Lane.
I want to dwell on the building. I have plans here which
I would like to present to you people to look at.
We contemplate
putting a building 40 x 120 up. This would be set on the back
part of the parcel so there would be sufficient area between the
building and the back line for parking. The building would run
parallel with the Main Road and would face west and the back
would be on Elijah's Lane and that would be where the trucking
would be done. The interior will be very modern and we feel
lighted to take care of equipment and machines. The equipment
will all be brought out from New York. It is not printing equipment.
Mimeographing and multilithing, small pieces by themselves, operated
by one man each, and quite quiet. No noise involved in the operation
at all.

The employment you should be interested in.
They intend not
to bring any help from New York at all. It is all going to be
hired here.
There will be steady employment for ten to 15 persons
of various ages, and then in peak time considerable extra..
They
wuuld be high school or any age for that matter.
The postage as far as the post office is concerned will be
fabulous.
Since the operation started in New Suffolk there has
been a tremendous increase in the Cutchogue Post Office.
The
figures are as follows: before the operation started the sales
in Cutchogue amounted to 14,000 to 16,000 per year and they are
now running over 100,000. There were two or three employees in
Cutchogue and there are now five. The post office has been raised
to first class from third class. Also by giving some business to
Mattituck they can change the classification there.
For the local situation I would like to present its aspects
as far as the Town is concerned. I think you people will agree
with me, and I am quite determined on the subject that we are
desperately in need in Southold Town of commercial and industrial
enterprises.
Since

was taking place. It has been very difficult to find a location
that is in operation; as a matter of fact it is impossible.
We
not only need these people to come out and give employment, we
need space. There are not too many firms that would go to the
effort that we have given to try to locate a place and go to the
efforts of changing a zone. We have a great many people in Southold
Town who need employment and I do not like to see the stream of
cars going west in the morning and coming back at night. They do
bring a lot of the payroll to Southold, but not enough. A lot
are leaving permanently and not coming back.
For that reason it gives me a great deal of pleasure to present
this petition to you in hopes that it will be one of many bringing
bus in ess and people to Southold Town.
Along with th is application we have Mr. Filla's application
for a change of zone.
It was brought out in the preliminary notices
and report of the Planning Board that Mr. Filla already has a large
warehouse or barn which he uses in connection with his potato
storage and potato sales.
He is branching out considerable and
has contracted to purchase the Kruk farm to the west and in doing
so he would like to be in a position not only to sort and grade
and sell his own potatoes, but also to purchase others. His
operation was in existence before zoning came into effect and I
might also point out that since zoning went into effect the Baxter
parcel was a non-conforming use.
Of course it has not been used
for some years now, and as far as that operation is concerned the
old building will be demolished and just the new one stand in
addition to the parking facilities that he has mentioned.

tables and chairs, etc.

the setup of the proposed use, the driveways and the building.

A petition was received from Procan, Inc.,
William Baxter and Martin Filla requesting a change
of zone of certain property sitated on Main Road,
Mattituck, and more fully descr, ibed in said petition
from "A" Residential and Agricultural District to "B"
Business District. This request left a 60 ft. section
zoned as "A" Residential and Agricultural District,
therefore it was the opinion of the Town Board to zone
all of this section as "B" Business District. The
original petitions of Procan, Inc. and William Baxter
and Martin Filla are in the files in the office of
the Planning Board at Southold, New York.
You are instructed to prepare an official report
defining the conditions described in the petition and
determine the area so effected with the recommendation
of your Board.

I understand that Mr. William J. Baxter of the Baxter
Economic Research Bureau who now operates at the James
'Dean place,Main Road,Cutchogue,N.Y. is seeking a variance
for the old G.I. Tuthill home in East Mattituck,N.Y. This
residence was formerly the ~illa Madeline,a restaurant,I
believe.
Mr. Baxter is requesting this variance in order that he
may move from the James Dean place to the Tuthill residence,
prepare his research findings there as he did at the Dean
place,print these findings,and put them into the large Baxter
Economic Research Bureau mailings. These mailings have been
emanating from this office for several years now and have
become an integral part of the gross receipts of this office.
Consequently,the receipts from these mailings are vital to
this office. The loss of them would affect not only the
employment of several persons in hire here but the category
of the office as well.

mailings assures me that no one in the vicinity of
the old G.I. Tuthill home would suffer from or be

This application is made in conjunction with the applica-
tion of William J. Baxter dated November 26, 1960 and P~ocan, Inc.
My parcel adjoins the Procan parcel on the north, is
shaped and also fronts on the Main Road for 70 feet adjoining
land of Kruk on the west. It is a portion of my farm which
extends northerly to the Long Island Railroad. This particular
parcel, however, contains a large potato warehouse on the portion
fronting on Eli JahSs Lane together w~th a building for housing
help. ~ne contour of the remainder of the parcel ma~e s it
andest~.able for farming purposes. I have been storing potatoes
in the warehouse and grading them for shipment. I should like,
however, to have a change of zone so that I may warehouse, grade
and ship on a commercial basis. No change in character of the
neighborhood would result since the warehouse and help buildings
have been there for some years.

I, WILLIAM J. BAXTER, residing at Nassau Point, Suffolk Count
New York, join in the Petition of Procan, Inc. for a change of
zone f~om "A" Residential District to "B" Business District for
property on the north side of Main Road, Mattituck, New York. I
have entered into a contract for the purchase of this property
subject, however, to the change of zone as requested.
At present my business rents two floors at 73 Pearl Street,
New York, New York, for multigraphing and mailing. The lease
expires on A~ril 1, 1961 and it is my intention to transfer this
part of my business to this section. I should like to have a
location near Mattituck since for this wor~ I would hire from
twenty to twenty-five persons, many of which can be of high school
age. If the operation is successful more people will undoubtedly
be hired.
It is my further intention either to remodel t~ present
building or to erect a new one. May I point out further that notz
only would a substantial number of people be employed but all
postage would continue to be purchased through local post offices.
Already £.~e~,:- the small operation carried on now, the post office
has been raised to second class.
It would be greatly appreciated if the Board would render a
decision on this matter as promptly as possible since, as above
stated, the lease on the premises at 73 Pearl Street, New York,
New York, expires on April 1, 1961 and considerable work and
construction would have to be completed by that time.
