Gillispi¢, Jr., Chairmen Robert Bergen Herbert I~osenberg Charles Gregonis, Jr. Serge Doyen, Jr. MINUTES SOUTHOLD TOWN BOARD OF APPEALS October 12, 1961 A regular meeting of the Southold Town Board of:Appeals was held 7:30 P.M., Thursday, October 12, 1961, at the Town Clerk Office, Main Road, Southold, New York. Present: Messrs. Robert W~ Gitlispie, Jr., Chairman, Robert Bergen, and Herbert Rosenberg. PUBLIC ~MRARING: Appeal No. 413 - 7:30 P.M. (E.D.S.T.), upon application Of Jesse and Marion Monselt, Box 44, North Cape May~ New Jersey, for a variance in accordance with the Zoning Ordinance, Article X, Section 1000A, for permission to divide property and sell less than prescribed by the Ordinance. Location of property: east side Bailey Avenue, Greenport, New York, bounded north by R. Stakey, east by right-of-way, south by G. Tuthill and west by Bailey Avenue. Fee paid $t5.00. The Chairman opened the hearing by reading application for a variance, legal notice of hearing and affidavit attesting to its publication in the official newspaper. ERNEST RADFORD, East Marion, New York: I would like to speak in favor of it. I can't add much more than is on the petition. I might point out that the lot in question could be built on because it is a single lot. Most of the lots in the area are of equal size. However the lot owners on either side each wish to purchase half of this lot thereby eliminating the possibility of another house being built in this area. THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) THE CHAIRMAN: I believe this would improve the area. This application is for a variance to permit the division of a 60 foot lot which lies between two residences. After investigation and inspection the Board finds it would be an unnecessary hardship to deny this application. The reasons stated in the appeal are factual. The purchase of additional land to increase open area is comp~ely in harmony with the spirit, intent, and purpose of the ordinance as it has been conceived. On motion of Mr. Gillisp~e, seconded.by Mr. Bergen, it was RESOLVED that Jessie and Marion Monsell be granted permission to divide lot on the east side Bailey Avenue and sell to adjacent property owners. vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. On motion of Mr. Bergen, seconded by Mr. Rosenberg, it was RESOLVED that the minutes of the meeting of October 5, 1961 be approved as submitted. (E.D.S.T.), Upon application of William Wetmore, a/c Y. Y. Hwang, Bay Shore Road, Arshamomaque, Greenport, New York, for a variance in accordance with the Zoning Ordinance, Article III, Section 307, for permission to reduce side yard setback. Location of property: east side Bay Shore Road, Arshamomaque, Greenport, New York, Lot No. 77 on Amended Map A of Peconic Bay Estates. Fee paid $15.00. The Chairman opened the hearing by reading application for a variance, legal notice of hearing and affidavit attesting to its publication in the official newspaper. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? WILLIAM WETMORE~ may Shoze Road, Arshamomaque, New York: All of the lots in that area are small and the houses are close. This house is further back from the road than the house next to it and many of the houses have garages on the street line. I am going to raise the house up two feet and then I will put in a bulkhead on the Bay side. MR. ROSENBERG: How many feet will be between this houss and the Hendry house after the addition is put on? MR. WETMORE: 12 feet. MI{. BERGEN: WRy can't the house be straightened on the lot when it is raised? MR. WETMORE: Because it would be out of line with the patio that was erected tast year and the porch. They are both concrete and are placed in conformity with the house at the present time. THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) Southold Town Board of Appeals -4- October 12, 1961 After investigation and inspection the Board finds that this is a unique situation. This residence was built on an angle on a lot originally 45 ft. by 178 ft. Due to erosion much of the bay end of the~.ot has disappeared and at the present time the residence is surrounded by water at extreme high tides. The present owner would like to attempt rehabilitation of this property provided a small bedroom can be added. He intends building a sea wall and raising the house two feet and filling the land. Several adjacent properties have been able to protect their homes by means of sea walls. If the wall is built and the land raised this property will conform with the two residences to the south. The variance is sought-to enable a reduction of the side yard at one point. No other part of the lot can be used for this purpose without complete remodeling. A cesspool and drainage field precludes the use of the lot on the north side. This residential area consists in the main of summer cottages many on undersized lots with insufficient side and front yard areas. The Board feels that in this particular case it would be both a practical difficulty and unnecessary hardship to deny this variation. The neighboring properties and general neighborhood would not be adversely affected. The rehabilitation of this property would enhance the appearance of the vicinity. The plot map and building addition plan is made part of this finding. On motion of Mr. Rosenberg, seconded by Mr. Gillispie, it was RESOLVED that William Wetmore, a/c Y. Y. Hwang be granted permission to reduce southerly side yard setback on property of Y. Y. HWang, east side Bay Shore Road, Arshomomaque, Greenport~ New York, Lot No. 77 on Amended Map A of Peconic Bay Estates. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen~ and Mar. Rosenberg. On motion of Mr. Bergen, seconded by Mr. Rosenberg, it was Southold Town Board of Appeals -5- October 12, 1961 RESOLVED that the Board of Appeals set 7:30 P.M. (E.D.S.T.)~ Thursday, October 26, 1961, Town Clerk Office, Main Road, Southold, ~w York as time and place for hearing upon application of Emilie Haunstetter, Bay Avenue, Mattituck, New York, for a special exception in accordance with the Zoning Ordinance, Article IV~ Section 408, for permission to erect and maintain directional sign on the property of John Skuro, south side Route 25, Mattituck, New York, bounded north by Main Road, east by District 9, south by Ann Skuro and west by Marlene Lane. Vote of the Board: Ayes:- Mr. Gitlispie, Mr. Bergen, and Mr. Rosenberg. It was further RESOLVED that legal notice of hearing be published in the official newspaper on Friday, October 20, 1961. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. The next meeting of the Southold Town Board of Appeals will be held 7:30 P.M., Thursday, October 26, 1961 at the Town clerk Office, Main Road, Southold, New York. Meeting adjourned at 8:45 P.M.
