WITNESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable consideration paid by the party of

particularly described on Schedule A attached hereto and made part hereof.
This deed is being made pursuant to a Resolution made by the Southold Town Planning Board on March 14,2023 which approved the
within lot line modification(See Schedule B attached).
TOGETHER with all right,title and interest,if any,of the party of the first part of,in and to any streets and roads abutting the above-
described premises to the center lines thereof;TOGETHER with the appurtenances and all the estate and rights of the party of the first
part in and to said premises;TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part,in compliance with Section 13 of the Lien law,covenants that the party of the first part will receive
the consideration for this conveyance and will hold the right to receive such con-sideration as a trust fund to be applied first for the
purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before
using any part of the total of the same for any other purpose.
The word"party"shall be construed as if it read"parties"whenever the sense of this indenture so requires.

Suffolk and the State of New York. More particularly described as follows;
Beginning at a point located N 47°-48'-00" E 25.00 feet from the southeasterly terminus
of Old Paradise Point Road;
Running thence N 72°- 05'-57" E 57.71 feet a point;
Running thence S 471- 51'-00" E 91.55 feet to the face of a wooden bulkhead located
along Peconic Bay;
Running thence along said bulkhead S 47°- 24'-09" W 50.21 feet to point;

Dear Mr. Herman:
The Southold Town Planning Board adopted the following resolution at a meeting held
on Monday, August 7, 2023:
WHEREAS, in October 2022, the applicant submitted a Resubdivision application for
review by the Southold Town Planning Board; and
WHEREAS this Resubdivision proposes to transfer 5,183 s4. ft. from SCTM#1000-81-1-
24.3 to SCTM#1000-81-3-1.4_ The land being transferred is unbuildable and will not
convey any new development potential; and
WHEREAS, that the Southold Town Planning Board granted a Conditional Final Plat
Approval upon the map entitled "Proposed Lot Line Change for Elyse James and John
Sinning, ET AL," prepared by Kenneth Woychuck Land Surveying, PLLC, dated August
30, 2017, and last revised October 12, 2022 with the following conditions:
1. Install concrete monuments at each new property corner.
2. Notify the Planning Board when the monuments have been installed so that an
inspection can be made; and
