AMENDMENT NO.40
NOTICE IS HEREBY GIVEN, that after a public hearing held
pursuant to the requirn~nts of law, the Building Zone Ordinance
(including the Building Zone Map) of the Town of Southold,
Suffolk County, New York, was duly amended at a regular meeting
of the Southold Town Board held on January 26, 1961, as follows~
1. By changing from "A"

District to "B" Business District the following described
property~
Ail those certain tracts or parcels of land,
situate, lying and being at Mattituck, in the Town
of Southold, County of Suffolk and State of New
York, and more particularly bounded and described
as follows:

the northerly line of Sound Avenue with the westerly
line of Cox Neck Road and running thence westerly
along the northerly line of Sound Avenue 450 feet~
thence northerly at right angles to said line of
Sound Avenue 350 feet, more or less; thence

We believe that
although the total acreage is greater than we like 'to
recommend, nevertheless 'the acreage in individual ownership
are reasonable and it seemed advisable to extend the
zone
on the south side of the highway to the Long Island Lighting

Company easement because it has been proposed that
additional storages be erected .on some of t.his property
extending to the south.
It would seem ~ us that this
would be the most practical use of this land, and, further,
that if Southold Town is to remain in the potato business
it is advis~bie that additional sto~age facilities,
either public or Private be provided.
"It should also be noted that the Long Island Lighting
Company substation constitutes a non-conforming uae and it
should be included in this "B" Business DistriCt as outlined in
the map dated December 6, 1960 by Otto W. Van Tuyl. The

Pylko property approximately opposite the subst&tion on the
south side of the road is also a non-conforming use to the
extent that three families occupy the house., and the barn
has been used'-as a carpenter shop for a considerable period."'

there. You .have other places already now being used
for business, zoned as a section of residences, but are
non-con forming uses.

business was turned dow:o by the same Board. at one time,.
and we did have a meeting on it, and they never, did .solve
the thing ye't, or answer what was going 'to happen to the
building.
I. think the majority of the neighbors are fine.

This change' that I t~ave Just read, the propose~d change,
is a change in the ordinance as far as trailer camps are
concerned.
.~d to better acquaint you with it,~ prior to
now and in order to establish a trailer camp, no individual
would have fi.wed land. It was e.xpected thgre .~' would be
some change
to .industrial and we have felt, and the Planning
Board has felt, this is not good faith. Also someone could
have a piece of ground changed to industrial and use it
for a 'trailer camp for a short period and. then sell that
land for anything allowed in industrial.
As far as
industries, they could move into that piece of land and
that might be-readily harmful to houses or' other construction.
So I will read you the Planning Boa~d's recommendation on
this change.

WHEREAS, the property in the vicinity of the intersection of Sound
Avenue, Middle Road and Cox Neck Road at Mattituck, in the Town of
Southold is presently zoned "A" Residential and Agricultural, and
WHEREAS, after due consideration and after members of the Town
Board and the Planning Board of the Town of Southold have visited this area
and are of the opinion that certain property in this area should be rezoned
from "A" Residential and Agricultural to "B" Business District in view of the
fact that there is a need for additional business zones in this area.

"The entire Planning Board has visited this property
and we have discussed it thoroughly.
We believe that
although the total acreage is greater than we like to
recommend, nevertheless the acreage in individual ownership
are reasonable and it seemed advisable to extend the zone
on the south side of the highway to the Long Island Lighting

Company easement because it has been proposed that
additional storages be erected o~ some of this property
e×tending to the south. It would seem ~ us that this
would be the most practical use of th~s land, and, further,
that if Southold Town is to remain in the potato business
it is advisable that additional storage facilities,
e~ther public or private be provided.
"It should also be noted that the Long Island Lighting
Company substatio~ aonstttutes a non-conforming use and it
should be included in this "B" Business District as outlined in
the map dated December 6, 1960 by Otto W. Van Tuyl. The
Pylko property approximately opposite the substation o~ the
south side of the road is also a no~-co~forming use to the
extent that three families occupy the house, and the barn
has been used as a carpenter shop for a considerable period."

We have a building there, a non-conforming
business was turned down by the same Board at one time,-

I think the feeling of the Planning Board was that this
area is best used for business because of its location.
You have a triangle in the middle there where you have
certain businesses already established.

arguments for and against.

Mattituck.
I am one of the property owners involved in this, and I
have a potato house here on part of this property. I am
in favor of the change in zone, and I think it would benefit
the community.
I have been interested personally and Ed
Jazombek, on account of the fact he is sick, he would not
come, and he said he would like to be noted as in favor.
MR. PAPIMH:
I have a business and it is non-conforming
and I would like to see it changed to business. If I ever
wanted to sell my business I could not do it because I
could not get a mortgage on it, and it is very important

don't like to see a warehouse there.

to make that a thrnughway or main road of some kind, has
any provision been made for the set back, or if they
make these changes will they be able to build right up
to the line, and will it have to be revamped agaim?

I can say this: any plans
the county or state may have have been conveyed to the
Planning Board, and they have in each instance where
anyone has asked for a building permit along that road,
advised them of the fact the plan is to widen the road.
They would like it if they moved their building back,
and if they did not move it back, it would have to be
moved.

This change that I have just read, the proposed change,
is a change in the ordinance as far as trailer camps are
concerned.
And to better acquaint you with it, prior to
now and in order to establish a trailer camp, no individual
would have fixed land. It was e×pected there~~ would be
some change
to industrial and we have felt, and the Planning
Board has felt, this is not good faith. Also someone could
have a piece of ground changed to industrial a~d use it
for a trailer camp for a short period and then sell that
land for a~ything allowed in industrial.
As far as
i~ndustries, they could move into that piece of land and
that might be readily harmful to houses or other construction.
So I will read you the Planning Board's recommendation on
t]ais change.

Residential and Agricultural District to "B" Business on the Town
Board's own motion, property in the vicinity of the intersection
of Sound Avenue, Middle Road and Cox Neck Road, Mattituck, it is
hereby
RESOLVED that the Planning Board recommend to the Town Board
~his change of zone from "A" Residential and Agricultural District
to "B" Business District on the following described property..
Ail those certain tracts or parcels of land, situate, lying
and being at Mattituck, in the Town of Southold, County of Suffolk
and State of New York, bounded and described as follows:
PARCEL 1. Beginn/ng at the intersection of the northerly
line of Sound Avenue with the westerly line of Cox Neck Road
and running thence westerly along the northerly line of Sound

The entire Planning Board has visited this property and we
have discussed it thoroughly. We believe that although the total
acreage is greater than we like to recommend, nevertheless the
acreage in individual ownership are reasonable and it seemed

advisable to extend the zone on the south side of the highway
to the Long Island Lighting Company easement because it has been
proposed that additional storages be erected on some of this
property extending to the south. It would seem to us that this
would be the most practical use of this land and, further, that
if Southold Town is to remain in the potato business it is
advisable that additional storage facilities, either public or
private be provided.
It should also be noted that the Long Island Lighting Company
substation constitutes a non-conforming use and it should be
included in this "B" Business District as outlined in the map
dated December 6, 1960 by Otto W. Van Tuyl. The Pylko property
approximately opposite the substation on the south side of the
road is also a non-conforming use to the extent that three
families occupy the house and the barn has been used as a carpenter
shop for a considerable period.
