Tourist Camps Amend. #40NOTICE OF OF ZONING AMENDMENT ORDINANCE AMENDMENT NO.40 NOTICE IS HEREBY GIVEN, that after a public hearing held pursuant to the requirn~nts of law, the Building Zone Ordinance (including the Building Zone Map) of the Town of Southold, Suffolk County, New York, was duly amended at a regular meeting of the Southold Town Board held on January 26, 1961, as follows~ 1. By changing from "A" Res idential and Agr icul tufa i District to "B" Business District the following described property~ Ail those certain tracts or parcels of land, situate, lying and being at Mattituck, in the Town of Southold, County of Suffolk and State of New York, and more particularly bounded and described as follows: PARCEL _!. Y. ): Why do they want to change this property to business at this time? I mean is a new application or anything put 7 in for any typ® of buminess going in th®~? SUPERVISOR ALBERTSON: I can tell you this, that in that a_~ea you .have some businesses that are already there. You .have other places already now being used for business, zoned as a section of residences, but are non-con forming uses. They a~e used as business but they a~e not -- We have a building there, a non-conforming business was turned dow:o by the same Board. at one time,. and we did have a meeting on it, and they never, did .solve the thing ye't, or answer what was going 'to happen to the building. I. think the majority of the neighbors are fine. SUPERVI..SOR ALBERTSON: To finish what I started to say, I think t:'~e feeling of the Planning Boerd was that this .area is best used for business because of its. lo-e. atton. You have a triangle in the middle there where you have certstm businesses already es'tablished. You' re 'not here as a Town Poard tonight to answer questions on this. This is set up a.s a hearing. What we are interested in doing, we have to, according to the rules, hear' both arguments foX'. and against. MARTIN SUTER: Sin c e the county and/or state is planning to make that a throughway O~ main road of some kind, any provision been - made roi, the set back, or if they make these changes will they be able to build right up to the line, and will it b~ve to be revamped again? SUPERVISOR ALBERTSON: I can say this: any plans the county or state may have have been conveyed to the Planning Boa~, and they have in each instance where anyone ha S asked for a building pe rmi t a 1 ong that road, advised them of the fact the plan is to widen the road. They would like it if they moved their building back, and if they did not move it back, it would have to be moved. lO AnythI~g furtheP on this change of zone? This change' that I t~ave Just read, the propose~d change, is a change in the ordinance as far as trailer camps are concerned. .~d to better acquaint you with it,~ prior to now and in order to establish a trailer camp, no individual would have fi.wed land. It was e.xpected thgre .~' would be some change to .industrial and we have felt, and the Planning Board has felt, this is not good faith. Also someone could have a piece of ground changed to industrial and use it for a 'trailer camp for a short period and. then sell that land for anything allowed in industrial. As far as industries, they could move into that piece of land and that might be-readily harmful to houses or' other construction. Y.): Why do they want to change this property to business at this time? I mean is a new application or anything put 7 in for a~y type of business going in there? SUPERVISOR ALBERTSON: I can tell you this, that in that area you have some businesses that are already there. Y,..ou have other places already now being used for business, zoned as a section of residences, but are ~.~ou-confo rming use s. They are used as business but they are not -- MR. (ZYPKO): We have a building there, a non-conforming business was turned down by the same Board at one time,- and we did have a meeting on it, and they never did solve the thing yet, or answer what was going to happen to the building. I think the majority of the neighbors are fine. SUPERVISOR ALBERTSON: To finish what I started to say, I think the feeling of the Planning Board was that this area is best used for business because of its location. You have a triangle in the middle there where you have certain businesses already established. You're not here as a Town Board tonight to answer questions on this-,~, This is set up as a hearing. What we are interested in doing, we have to, according to the rules, hear both arguments for and against. If you have some indications against this change we would like to hear it so we could better decide this case. I guess I have nothing to say on that. SUPERVISOR ALBERTS ON: Anyone else with to be heard in .opposition to this change? (There was no response.) SUPERVISOR ALBERTSON: For the benefit of the gentlemen who just came in we are in to the change of that piece of property in Mattituck, and I am asking if anybody here is in opposition to this. Y.): I reside in Mattituck. I am one of the property owners involved in this, and I have a potato house here on part of this property. I am in favor of the change in zone, and I think it would benefit the community. I have been interested personally and Ed Jazombek, on account of the fact he is sick, he would not come, and he said he would like to be noted as in favor. MR. PAPIMH: I have a business and it is non-conforming and I would like to see it changed to business. If I ever wanted to sell my business I could not do it because I could not get a mortgage on it, and it is very important (9 it be changed. MARY PYLK0~: I am rot against the business but I don't like to see a warehouse there. MR. BULLOCK: We are in favor of the change. SUPERVISOR ALBERTSON: Anyone else to be heard in favor of? MARTIN SUTER: Since the county and/or state is plannimg to make that a thrnughway or main road of some kind, has any provision been made for the set back, or if they make these changes will they be able to build right up to the line, and will it have to be revamped agaim? SUPERVISOR AI~ERTSON: I can say this: any plans the county or state may have have been conveyed to the Planning Board, and they have in each instance where anyone has asked for a building permit along that road, advised them of the fact the plan is to widen the road. Richmond, Town Clerk. This change that I have just read, the proposed change, is a change in the ordinance as far as trailer camps are concerned. And to better acquaint you with it, prior to now and in order to establish a trailer camp, no individual would have fixed land. It was e×pected there~~ would be some change to industrial and we have felt, and the Planning Board has felt, this is not good faith. Also someone could have a piece of ground changed to industrial a~d use it for a trailer camp for a short period and then sell that land for a~ything allowed in industrial. As far as i~ndustries, they could move into that piece of land and that might be readily harmful to houses or other construction. The entire Planning Board has visited this property and we have discussed it thoroughly. We believe that although the total acreage is greater than we like to recommend, nevertheless the acreage in individual ownership are reasonable and it seemed Page 3 - Recommendation to Town Board advisable to extend the zone on the south side of the highway to the Long Island Lighting Company easement because it has been proposed that additional storages be erected on some of this property extending to the south. It would seem to us that this would be the most practical use of this land and, further, that if Southold Town is to remain in the potato business it is advisable that additional storage facilities, either public or private be provided. It should also be noted that the Long Island Lighting Company substation constitutes a non-conforming use and it should be included in this "B" Business District as outlined in the map dated December 6, 1960 by Otto W. Van Tuyl. The Pylko property approximately opposite the substation on the south side of the road is also a non-conforming use to the extent that three families occupy the house and the barn has been used as a carpenter shop for a considerable period.
