legal notice.
Pursuant to section 265 of the Town Law and Article IX of the
Building Zone Ordinance of the Town of Southold, Suffolk County, New
York, public hearings will be held by the Southold Town Board at the
office of the Supervisor, 16 South Street, Greenport, New York, in
s aid town on the 29th day of November 1960, at 7:30 o'clock in the
evening of said day, ~n the following proposals to amend the Building

Board which appears in the file: This report is dated November2nd.
Gentlemen:
This is to certify that the following actionwas taken by the
Southold Town Planning Board at their regular meeting on Tuesday,
November 1, 1960:
In the matter of the petition of William A. Davis for a
change of zone from "A" Residential and Agricultural District to
"M" Multiple Residence District on certain real property situated
on the southwest corner of Fourth Street and Main Street, New
Suffolk, New York, and more particulary bounded and described as
follows:
I will not read the description as it is the same as the
one rea~ in the legal notice.
RESOLVED that the Planning Board recommend to the Town Board
that this change of zone be made from "A" Residential and Agricultural
District to "M" Multiple Residence District, on the property of
William Davis at New Suffolk, ~ew York.
Three members of the Planning Board have visited the location
and have talked to influential residents and we feel that the
village of New Suffolk has been in a depressed economic condition
and in our opinion there is no future in the old style boarding
house, which this property has been for many many years; therefore
we feel motel type accomodaticns offer the best chance for economic
revival.
The Board has considered the possibility of changing to "M"
Multiple Residence District a larger area than this property, but
our final decision has been that in this case it would probably be
best to change this property alone in view of the fact that it
represents the western most edge of the boarding house area and is
separated from Fifth Street by a substantial area of open land
which has been planted in grass and flowers and maintained as a
park for many years. Finally, it is our opinion that the owner
of this property is showing goog faith and intentions in that
he has already commenced to repair and beautify this place.

for the following reasons: is as follows:
The property already used as a boarding house with a 2 family
cottage - I would like to change as follows:
Leave the two family cottage as is. Get rid of restaurant type
kitchen and dining room. Put in new bathrooms and kitchenette units
to make efficiency apartments with quarters for my own family. The
third floor is to be closed off at this time which has been used as
a dormitory. We feel it is a fire hazard and should not be used
until fire escape or some other arrangements can be made.
The apartments would be more advantageous to both the community
and myself. Although this is primarily a summer business,the guests
would stay for longer periods of time making my business steadier than
a boarding house which is mostly daily or week-ends. Th~ community
would benefit because my guests would buy local products from local
stores where the boarding house would buy wholesale as much as possible.
The guests would also use local restaurants frequently. Ail in all
this seems to fit the needs of people interested in the community
either as guests or residents. (signed) William A. Davis.

The property already used a. a boarding house with a 2 family cottage -
I would like to change as follows=
Leave the two family cottage as is. ......
Get rid of restaurant type kitchen and dining room.
Put in new bathrooms and kitchenette units to make efficiency
apartments ~ with quarters for my own family.
The third floor is to be closed off at this time which ha. been used
as a Aormitory..',~: We feel it is a fire hazard and should not be use~
until fire escape or some other arrangements can be ma~e.
The apartments would be more advantageous to both the conmaunity and
myself. Although this is primarily a summer business', the guests
would stay for longer periods of time ma~ing my business stea~ier than
a boarding house which is mostly' daily or week-en~s. The community
would ben&fit because my guests woul~ buy local Products and from
local stores where the boarding house would buy wholesale aa much as
possible. The guests would also use local restaurant's frequently.
Ail in all this seems to fit the needs of people interested in the
community either as guests or residents.

Southold Town Planning Board at a regular meeting held Tuesday,

In the matter of the petition of Frank Pumillo, Cutchogue,
New York, for a change of zone from "A" Residential and Agricultural
District to "B" Business District on the remainder of his property,
located southerly from an existing "B" Business District, Mattituck,
New York, and more particularly bounded and described as follows:
I will not read the legal description as it was read previously.
RESOLVED that the Planning Board does not recommend the change
of zone from "A" Residential and Agricultural District to "B" Business
District as shown on map of property made for Frank Pumillo at
Mattituck, New York, compiled from several surveys July 28, 1959
by Otto W. Van Tuyl & Son.
The Plannning Board does not believe it is in the best
interest of the Town of Southold to have a motel in connection with
a bar and grill. In addition, this would be out of character with
the existing immediate adjacent residential area.

3. Such request is made for the following reasons: The
southerly part of my property which I am asking to be rezoned is
an irregularly shaped parcel with which I can do nothing under an
A Residential Zone. It is impossible to subdivide or to put one
residence on due to the northerly part being zoned B and since it
has no frontage on any roadway.
If permission is granted to rezone this to B Zone it is my
intention to erect attractive motel units which will not only
improve the location but be a needed asset to the village.
SUPERVISOR TUTHILL: Is there anybody who wishes to be heard
in favor of the proposed change in zoning?
WILLIAM WICKHAM, ESQ., Mattituck; New York: I am a little
suprised and would like to~ke exception to the recommendation of
the Planning Board. This property was purchased from the Huttenlocher
family two years ago and does have a house on the front portion of
it and it is almost entirely in a commercia~ district. On that same
side of the street, on the south side of the Main Road, is commercial.
The westerly part of the Skuro property is entirely commercial; on
the east side is commercial for a good distance back. The only part
that is residential is the back yards of some of the people on Bay
Avenue. It is impossible under the present zoning setup to do any-
thing with the property other than perhaps rent the house on the
north part which is 200 feet. The lots run there at such an angle
that it would impossible to get a depth of 200 feet and if you
wanted to change the house into a commercial venture there would
not be adequate property. He is stuck with all the back end of
his property and it is impossible to put up any residence there
and also impossible to put up any commercial building. He did
have in mind putting up motel units and that idea was sponsored
almost exclusively of people who were seeking accomodations when
they were in the restaurant. Time after time he would give
telephone numbers and the motels would be filled. If you frown
on the idea of having motel units in there you should look at
the zoning restrictions making him have a parcel of land he can
not use and the only use it can be put to is if it is zoned
commercial. There is no other restaurant along there and we
might as well not kid ourselves thinking it can be used for
any residential purpose. As far as it hurting residential property
it is the back end of property on Bay Avenue and those lots are
very deep.

This is to certify that the following action was taken
by the Southold Town Planning Board at a regular meeting held
Tuesday, October 4, 1960:
In the matter of the petition of Frank Pumillo, Cutchogue,
New York, for a change of zone from "A" Residential and Agri-
cultural District to "B" Business District on the remainder of
his property, located southerly from an existing "B" Business
District, Mattituck, New York, and more particularly bounded
and described as follows:
BEGINNING on the boundary line dividing said premises and
land of Skuro 200 feet southerly from the monument on the south-
erly side of Main Road marking the boundary line between said
lands; running thence southerly along said land of Skuro and
along land now or formerly of Abitz 242.32 feet to a monument
and land of Shewell; running thence in an easterly direction

RESOLVED that the Planning Board does not recommend the
change of zone from "A" Residential and Agricultural District
to "B" Business District as shown on map of property made for
Frank Pumillo at Mattituck, New York, compiled from several
surveys July 28, 1959 by Otto W. Van Tuyl & Son.
The Planning Board does not believe it is in the best
interest of the Town of Southold to have a motel in connection
with a bar and grill. In addition, this would be out of
character with the existing immediate adjacent residential
area.

2. I do hereby petition the Town Board of the Town of Southold to change, modify and
amend the Building Zone Ordinance of the Town of Southold, Suffolk County, New York,
including the Building Zone Maps heretofore made a part thereof, as follows: The northerly
200 feet of said parcel is zoned "B" Business.
I request the Town Board to extend "B" Business zone southerly to
cover all of said parcel, the portion to be extended being described
as follows:

Road marking the boundary line between said lands; running thence south-

3. Such request is made for the following reasons:
The southerly part of my property which I am asking to be
rezoned is an irregmlarly shaped parcel with which I can do
nothing under an A Residential Zone. It is impossible to sub-
divide or to put one residence on due to the northerly part
being zoned, B and. since it has no frontage on any roadway.
If permission is granted to rezone this to B Zor. e it is
my intention to erect attractive motel untis which will not
only improve the location but be a needed asset to the
