Re: A Local Law in relation to "A Local Law in Relation to Accessory Building Exemptions"
The proposed action has been reviewed by New York State Department of Environmental Conservation
regulation 6NYCCRR Part 617 State Environmental Quality Review, and it is my determination that
pursuant to Part 617.5(c)(26), the action is "continuing agency administration and management" and,
therefore a Type II action not subject to review.
617.5(c)(26) "routine or continuing agency administration and management, not including new
programs or major reordering of priorities that may affect the environment;"

Re: Local Waterfront Revitalization Coastal Consistency Review "A Local Law in Relation
to Accessory Building Exemptions"
The Local Law in Relation to Accessory Building Exemptions was reviewed to Chapter 268,
Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront
Revitalization Program (LWRP) Policy Standards. Based upon the information provided to this
department, the proposed action is recommended as CONSISTENT with the LWRP.
Pursuant to Chapter 268, the Town Board shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO. 2024-649 WAS
ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON
JULY 16,2024:
RESOLVED that the Town Board of the Town of Southold hereby amends resolution#2024-
586, adopted at the July 2, 2024 regular Town Board meeting to read as follows:
WHEREAS there has been presented to the Town Board of the Town of Southold, Suffolk
County,New York on the 2nd day of July 2024, a Local Law entitled "A Local Law in Relation
to Accessory Buildings and Structures", now,therefore, be it
RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the
aforesaid Local Law at the Southold Town Hall, 53095 Main Road, Southold New York on the
41�#271h day of August, 2024 at 440 7:00 p.m., at which time all interested persons will be
given an opportunity to be heard and be it further
RESOLVED that the Town Board of the Town of Southold requests that the Planning Board
prepare a report and recommendations on the proposed zoning, including SEQRA and LWRP
report and recommendations; and be it further
RESOLVED that the Town Board of the Town of Southold requests that the Suffolk County
Planning Commission prepare a report and recommendations on the proposed zoning;
This proposed "Local Law in Relation to Accessory Buildings and Structures", which reads as
follows:
Local Law No. 2024
I. Purpose - The purpose of this local law is to allow for accessory structure exemption.
II. Chapter 280 of the Code of the Town of Southold is hereby amended to include the
underlined words and remove the struck through words as follows:
§280-15 Accessory Buildings and Structures
In the Agricultural-Conservation District and Low-Density Residential R-80, R-120, R-200 and
R-400 Districts, accessory buildings and structures or other accessory uses shall be located in the
required rear yard, subject to the following requirements:
G. Accessory structures, that have a Certificate of Occupancy or equivalent, located in a
rear yard or in a waterfront front yard,which are rendered partially or completely in a

side yard, due to additions or alterations to a single-family dwelling, shall be exempt from
this requirement.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.
