Re: LWRP Coastal Consistency Review for Town of Southold Development Rights on Land
Owned by D&S Hayfield, L.L.C.
SCTM 1000-108.-3-1
The proposed acquisition is for a development rights easement on part of the property, consisting of
approximately 15.08f acres (subject to survey) of the 17.25±acre parcel.
The action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed
action is CONSISTENT with the Policy Standards and, therefore, is CONSISTENT with the
LWRP.

Re: SEQR Review for Purchase a Development Rights Easement on Property Owned D&S

The proposed acquisition is for a development rights easement on part of the property, consisting of
approximately 15.08± acres (subject to survey) of the 17.25± acre parcel.
The proposed action has been reviewed by New York State Department of Environmental Conservation
regulation 6NYCCRR Part 617 State Environmental Quality Review, and it is my determination that pursuant to
Part 617.5c(39), the action proposed is a Type II action and,therefore, not subject to SEQRA review.
61 7.5(c)(39) "an agency's acquisition and dedication of 25 acres or less of land for
parkland, or dedication of land for parkland that was previously acquired, or acquisition
of a conservation easement;"
