pre-submission meeting request at the site.

We actually received it in this morning's mail. Your letter has a subject line of Administrative Amendment
Request. This type of request is not a Pre-Submission request. Please confirm that you understand there is to be-no
Administrative Amendment and that this is strictly a Pre-Submission meeting to discuss things with the Board of
Trustees prior to your Trustee Wetland Permit application.
Also, please be advised that none of any previous fees submitted for any prior reason can be used towards the
$2,500.00 Wetland Permit as-built demolition application, as per Town Code Ch. 275. The only fee permitted is the
current$150.00 Pre-Submission Inspection that is to be slated for January 9, 2024 to which the$150.00 inspection'fee
can be used towards the$2,500.00 only if the Wetland Permit application is submitted within six months of the date of
the Pre-Submission request, and as per Town Board Resolution 2023-376.

Regarding your question, Ch. 275 does not have an "as-built demolition" code/section. Under 275-7 Fees,there is the
code that if something is considered to be done beyond the scope of a Trustee permit or without a Trustee permit it is
considered as-built and the application fees are then doubled. Also under Article III Administration and Enforcement,
discussed work beyond or without a Trustee permit.The determination of demolition or as-built demolition is through
the Building Dept., however, at times this Board may determine a project a demolition without the determination
from the Building Dept.which they have determined in past projects.

I am aware of this project and the amendments made to the original Wetland Permit. The Board is aware of the
situation and unanimously agreed that this is now considered and as-built and a new wetland permit must be applied
for. If you wish to speak to them, you would do this via a Pre-Submission site inspection to further discuss
things. This is an inspection prior to applying for a new Wetland Permit. If you are available on January 9, 2024 you
still have time to submit a Pre-Submission request to meet them at the property that day. If you would like to do this
you would have to submit updated authorization forms (see attached) and you can write a letter asking to meet with
the Board at the location for the reason of... The fee is$150.00 however,that$can be used towards the application
fee if you apply within six months. Please give us your cell number so that the Board can call you as they are on their
way. This meeting would be early in the morning, possibly their first stop as January has a short agenda. You would
need to be at the site by 8:30am.
If you would like to do the Pre-Submission, please submit the authorizations,your letter, the fee, and a copy of the
site plan for the file no later than Thursday,January 4, 2024.

1 did get a call from the contractor last week regarding this, I was hoping the building department
would be sending a formal notice. I am not sure if you have been involved with this project before,
but we've already been before the zoning board and the twice for the trustees. I think I would like to
speak with the board prior to having the.hearing, do they prefer setting up conferences or would an
email chain suffice? Please let me know, and thank-you.

You may have heard that the Town Building Dept. performed a site inspection and discovered work being
performed outside the scope of the Building Dept. permit which triggered this project now being considered
an as-built demolition by Town Code. Because this project has now been determined to be an as-built
demolition a new Trustee Wetland Permit application must be applied for the demolition of existing(list all
details & dimensions) and construction of new(list all details of new and dimensions). Also, because this is
considered and as-built situation the Wetland Permit application fee is doubled($2,500.00). A new Trustee
Wetland Permit needs to be issued prior to the Building Department issuing their new Building Permit.

SUBJECT: Administrative Amendment Request Kadillak Residence

Dear President Goldsmith and Members of the Board,
The Southold Building Department recently inspected our project.During their inspection they decided the project now
qualifies as an as-built demolition by the Town Code. I have searched for a section of the Town Code relating to as-built
demolitions,but have not found a reference to this term.I would assume they are referencing the 50%market value in§280-4
Demolition definition. If that is not the case,please let me know which section of the code references as-built demolitions and
I will appropriately amend this letter to address that section.
Since my last request for an administrative amendment on October 3rd,2023,we have not altered our project scope. Our plans
for the project and the I/A septic system filed with the county are identical to the last set you reviewed.
Our administrative amendment on Oct. 3td,2023 requested an overhang of 18" on the front side of the dwelling to be more
aesthetically pleasing and increase the second-floor bedroom size. On April 4th 2023 we requested an amendment to our
approval in order to replace the foundation due to conditions the contractor discovered while the work was in progress.At
that time the Board requested additional clarification,and I addressed this in a letter dated June 29th,2023 in which I explained
the 50%market valuation method is detrimental to home owners,construction costs have skyrocketed,and if the projects
were filed separately the values.would fall below the 50%threshold. Our original application was for a second story addition'
and renovation of the first floor.At that time we were not required by the building department to seek a Trustee's permit.
The current project meets or exceeds all current NYS 2020 building codes,including the energy code.We are not changing the
footprint of the original dwelling,and we are upgrading the septic system to an I/A system to comply with the Town's
wastewater management program.This request by the building department to seek an additional permit from the Trustee's
appears unjust,as my client has spent$2,250 in zoning department fees, $850 in building department fees,and$1,500 in
Trustee's fees for an addition that did not change the footprint of the dwelling.Being that the scope of work has not changed
since the last amendment to the Trustee's permit that was issued,I feel that this should be treated as an Administrative
Amendment.However,if the board does not agree and will require me.to appear before them,we would ask that instead of
paying the$2,500 dollar fee,that the$1,500 already paid to the Trustee's be deducted from the new fee.
