The variances granted herein are mathematically substantial, both variances represent 100% relief from the code. However, due to the location of a freshwater wetlands in the rear yard, no accessory structures can be placed within the 100 feet setback. Therefore,any proposed accessory structures must be placed in the front yard. Moreover,the applicant's representative testified at the hearing that the Board of Town Trustees informed the applicant that they would not approve a pool in the conforming rear yard due to adverse environmental impacts to the wetlands.By locating the pool in a front yard,the pool is no longer within the Trustee's jurisdiction 4. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood.
