PO Box 2124 Greenport, NY 11944 RE: JOSEPH & CAROLYN FERRARA OFF OSPREY NEST ROAD, GREENPORT SCTM# 1000-35-7-12 Dear Ms. Costello: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, January 15, 2025 regarding the above matter: WHEREAS, EN-Consultants on behalf of JOSEPH & CAROLYN FERRARA applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated October 24, 2024, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 6 & 9 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: dialing dock back approximately 10' to confirm with existing pier line; establish and perpetually maintain a 10' wide non-turf buffer; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on January 15, 2025, at which time all interested persons were given an opportunity to be heard, and, 2 WHEREAS, the Board members have personally viewed and are familiar with the premises`in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the project complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVE the application of JOSEPH & CAROLYN FERRARA to remove and dispose of existing dock structure and construct a new 4'x42' fixed catwalk with open-grate decking, and install a ladder; remove and dispose of 20' of existing bulkhead and 3.5' long south return; construct 20' of new bulkhead and 3.5' south return using vinyl sheathing in-kind and in-place, raising height by 14" to match height of south neighbors existing bulkhead; establish and perpetually maintain a 10' wide non-turf buffer landward of bulkhead with a 4' wide walking access path; and as depicted on the site plan prepared by Costello Marine Contracting Corp., received on February 20, 2025, and stamped approved on February 25, 2025. Permit to construct and complete project will expire three years from the date the permit is signed. The dock extends further into an active navigation channel. Future shoaling in the inlet could force the navigation of the channel more east and cause conflicts with longer docks. What is the shoaling and dredge pattern of the inlet? 2. The dock extends past the pier line of existing docks. 3. The distance to other docks could be reduced by larger vessels mooring on the proposed dock due to their location and angles. 4. The dock extension is unwarranted further into public waters —water depth for motorized boats is sufficient at 7.0'. The current water depth at the terminus of the dock is 3.9' at MLW. What type of boat is proposed to be moored? 5. It is recommended that CCA-treated material be minimized in all construction if approved. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
