WITNESSETHw-
WHEREA%DECLARANTS are the owners of certain real property located at 3693 pine Neck Load;
Town of Southold,County of Suffolk, State of New York,described in the Suffolk County Tax Map as District
1000, Section 70, Block 6, Lot 25,which is;more particularly bounded and described as set forth in Schedule
"A" annexed hereto,hereinafter referred to as the Property; and
WHEREAS;the Property is situated on lands within the jurisdiction of the Board of Trustees of the
Towti of Southold(hereinafter the"Trustees")pursuant to Chapter 275 of the Town Code of the Town of
Southold or its successor,and various activities conducted upon the property may thus be subject to the
regulation and approval of the Trustees prior to being conducted;and
AREAS,the I)ECLARANTS therefore made application to the Trustees for a permit pursuant to the
Wetlands Law of the Town of Southold to undertake certain regulated activities;and
WHEREAS,the DECLARANTS subsequently made applications to admmi isrmtively amend said permit
pursuant to the Wetlands Law of the Town of Southold to modify the approved activities;and
WHEREAS,on January 15,2025,the Trustees approved the application and issued a permit with terms and
conditions;and
WWMRE-AS;on April 16,2025,the Trustees approved the application and issued an adtiiinistrative
amendment to the permit and
WHEREAS,the originally issued permit,terms and conditions of the permit,and the Administrative Permit
Amendment;as well as the site most recently revised site plan prepared by Nathan Taft Corwin III; Land Surveyor,
last dated Februsry 18,2.025,and stamped approved on April 16,2025,upon which the Administrative Amendment
is based;are filed in the Office of the Town of Southold Board of Trustees as Permit No. 10737,and annexed hereto
as Schedule"W'and
WHEREAS,as a condition of the granting of a Wetlands Permit to undertake such regulated activities,
the Trustees required that a vegetated"non-turf buffer"be established and perpetually maintained seaward of the
existing wood retaining wall("wood tie wall"),between the retaining wall and the previously covenant non-turf
buffer, as depicted on the site plan prepared by Nathan Taft Corwin I11, Land Surveyor, last dated February 18,
2025,and stamped approved on April 16,2025;and
WHEREAS,the DECLARANTS have considered the foregoing and have determined that the same will
be in the best interests of the DECLARANTS and subsequent owners of the Property;
NOW, THEREFORE,the DECLARANTS do hereby covenant and agree as follows:
1) Upon the substantial completion of the aforementioned permitted activities there shall be
perpetually maintained seaward of the existing wood retaining wall("wood tie wall"),between
the retaining wall and the previously covenanted non-turf buffer,a vegetated"non-turf buffer"as
defined by Chapter 275 of the Town Code,as depicted on the site plan prepared by Nathan Taft
Corwin III, Land Surveyor,last dated February 18,2025,and stamped approved on April 16,2025.
2) The DECLARANTS shall at all times comply with the Terms and Conditions of the permit, a
copy of which is filed in the office of the Town of Southold Board of Trustees,and attached hereto
as Schedule`B."
3) These covenants shall run with the land and shall be binding on the DECLARANTS,their heirs,
assigns,purchasers,or successors in interest and may be modified only upon resolution of the
Board of Trustees.

particularly bounded and described as follows:
COMMENCING at a at a monument set at the southeasterly corner of the premises herein to be described and
which point lies on the westerly line of the premises of R.F.Landherr, distant 195.00 feet northerly from the

existing 5'x56' seaward edge of block pool patio and replace with 5' x 56' pool patio with a

TERMS AND CONDITIONS
The Permittee Gerard& Bethanne Rieger,3693 Pine Neck Road Southold New York as part of
the consideration for the issuance of the Permit does understand and prescribe to the following:
l. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit,and the said Permittee will,at his or her own
expense,defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 36 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should.be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained..
4. That the work involved will be subject to the inspection and approval of the Board or its
agents,and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice,to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to.
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.
1]. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, April 16, 2025:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Administrative
Amendment to Wetland Permit #10737, as issued January 15, 2025, to reduce the size
of the previously approved 5' x 56' patio area to be removed and replaced with a
minimum 1-foot wide gravel trench drain and plantings to a 2.5' x 56' area to be
removed and replaced with a minimum 1-foot wide gravel trench drain and plantings;
and as depicted on the site plan prepared by Nathan Taft Corwin III Land Surveyor,
received on March 14, 2025, and stamped approved on April 16, 2025.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, April 16, 2025:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Administrative
Amendment to Wetland Permit#10737, as issued January 15, 2025, to reduce the size
of the previously approved 5' x 56' patio area to be removed and replaced with a
minimum 1-foot wide gravel trench drain and plantings to a 2.5' x 56' area to be
removed and replaced with a minimum 1-foot wide gravel trench drain and plantings;
and as depicted on the site plan prepared by Nathan Taft Corwin III Land Surveyor,
received on March 14, 2025, and stamped approved on April 16, 2025.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

Dear Mr. Goldsmith:
Pursuant to my preliminary discussion with the Board last month,please find enclosed an
application to administratively amend the wetlands permit for the above referenced property to
reduce the size of the 5' x 56' patio area to be t x 56 removed area to be removed and rep a ec d with a
wide gravel trench drain and plantings to a 2 S
minimum 1-foot wide gravel trench drain and plantings.
A 5-foot wide removal area would leave an area of patio on the seaward side of the pool just
narrow enough to become unusable and physically separated from the existing access steps.
.Whereas removing a 2.5'-wide section of patio would keep the patio seaward of the pool usable;
align its seaward edge with the landward edge of the steps; and align the new plantings area with
the existing planter.
As discussed,to mitigate the decreased patio removal,the covenanted non-turf buffer landward
of the lower retaining wall, which is currently comprised only of sand,would be planted with
Cape American beach grass, all as depicted on the survey/site plan prepared by Nathan Taft
Corwin III Land Surveyor, last dated February 18, 2025,three (3) copies of which are enclosed
herewith.

Pursuant to the conditions of permit issuance adopted by the Board during the January 15, 2025,
public hearing on the above referenced application,please find enclosed three (3) copies of a
survey/site plan prepared by Nathan Taft Corwin III Land Surveyor, last dated February 15, 2025,
which has been revised a follows:
1) The most seaward 1' x 56' patio area proposed to be removed and replaced with a gravel
trench drain has been expanded to a 5' x 56' area to be removed and replaced with a
minimum 1-foot wide gravel trench drain and plantings.
2) The area of loose brick, slate and patio block on the east side of the patio is labeled to be
removed and restored as a non-turf buffer area.
3) The area between the top of bank/upper retaining wall and covenanted non-turf buffer is
labeled to be maintained as a vegetated non-turf buffer.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, January 15, 2025 regarding the above matter:
WHEREAS, EN-Consultants on behalf of GERARD & BETHANNE RIEGER applied to
the Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated October 29, 2024, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: issuing a Wetland Permit; and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on January 15, 2025, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the project complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and'based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees APPROVE the application of GERARD &
BETHANNE RIEGER for the as-built structures, including approx. 2,116sq.ft. grade-
level masonry block pool patio constructed in place of previously existing brick patio
(including irregularly shaped northwesterly extension and masonry fire pit); approx.
506sq.ft. grade-level stone patio constructed in place of previously existing stone patio
(including irregularly shaped easterly extension); as-built generator, two above ground
liquid propane tanks, and as-built structures in stone patio, i.e. 7.5'x7.6' hot tub, 3'x15'
stone bench and 3.3'x7.8' stone bbq counter; remove existing 5'x56' seaward edge of
block pool patio and replace with 5' x 56' pool patio with a minimum 1' wide gravel
trench drain with native plantings leading to a drywell; and install an 8'x4' pool drywell;
with the condition that the area on the east side of the property labeled "loose brick,
slate and patio block" be removed and replaced by a mulch non-turf buffer area;
establish and perpetually maintain a vegetated non-turf buffer seaward of existing wood
retaining wall; and as depicted on the site plan prepared by Nathan Taft Corwin III Land
Surveyor, on March 14, 2025, and stamped approved on March 21, 2025.
Permit to construct and complete project will expire three years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

TERMS AND CONDITIONS
The Permittee Gerard&Bethanne Rieger,3693 Pine Neck Road Southold New York as part of
the consideration for the issuance of the Permit does understand and prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages,of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit,and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 36 months,which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal,and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice,to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

Pursuant to the conditions of permit issuance adopted by the Board during the January 15, 2025,
public hearing on the above referenced application, please find enclosed three (3) copies of a
survey/site plan prepared by Nathan.Taft Corwin III Land Surveyor, last dated February 15, 2025,
which has been revised a follows:
1) The most seaward l' x 56' patio area proposed to be removed and replaced with a gravel
trench drain has been expanded to a 5' x 56' area to be removed and replaced with a
minimum 1-foot wide gravel trench drain and plantings.
2) The area of loose brick, slate and patio block on the east side of the patio is labeled to be
removed and restored as a non-turf buffer area.
3) The area between the top of bank/upper retaining wall and covenanted non-turf buffer is
labeled to be maintained as a vegetated non-turf buffer.
Although I trust the Town Wetlands Permit can now be issued in accordance with these revised
plans, please let me know if you have any questions or require anything further,

Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

STATEMENT OF EFFECT
The application seeks approval for as-built structures that were constructed without the
benefit of a wetlands permit, primarily a masonry block pool patio that was constructed
in place of a brick patio with a lateral extension at its northwest corner prior to 2017. The
existing patio was thus present when the Trustees reviewed an application for a retaining
wall in 2017, and aerial images showing the brick patio in 2015 and current patio in 2016
are contained in the records associated with Wetlands Permit No. 8999. Nevertheless,
permitting of the patio appears not to have been addressed at that time. Subsequent to
issuance of that permit, a smaller section of previously existing stone patio at the
southeast corner of the pool patio was replaced; extended laterally around a stone
barbeque counter also built prior to 2017; and improved with the existing hot tub and
stone bench. A generator and two above-ground LP tanks were installed during the
Covid-19 pandemic more than 100 feet from wetlands but within 100 feet of the bank.
Building Permit No. 45507 was issued for the generator in 2020 but no wetlands permit
was requested or obtained. Except for the patio corner extensions, installation of the
current pool patio essentially replicated a site condition that dates back to at least 2001
and likely much longer ago, as the existing swimming pool was issued Certificate of
Occupancy No. Zl 1662 in 1983. But to provide potential runoff mitigation that likely
would have been required had the patio replacement been reviewed by the Trustees, the
1' x 56' seaward edge of the patio is proposed to be removed and replaced with a gravel
trench drain. And to capture backwash from the existing swimming pool and hot tub, a
currently lacking pool drywell is proposed outside Chapter 275 jurisdiction more than
100 feet from the top of bank. Al covenanted non-turf buffer on the landward side of the
retaining wall authorized by Wetlands Permit 8999 is being maintained and is depicted
on the survey submitted herewith. Therefore, approval and maintenance of the existing
structures will not cause any significant adverse impacts on the adjacent wetlands or tidal
waters of Jockey Creek.

proposed actions that are subject to the Town of Southold Waterfront Cons istencyReview Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt

beneficial and adverse effects upon the coastal area (which includes all of Southold Town).

LWRP Policies 5 & 6
The application seeks approval for as-built structures that were constructed without the
benefit of a wetlands permit,primarily a masonry block pool patio that was constructed
in place of a brick patio with a lateral extension at its northwest corner prior to 2017. The
existing patio was thus present when the Trustees reviewed an application for a retaining
wall in 2017, and aerial images showing the brick patio in 2015 and current patio in 2016
are contained in the records associated with Wetlands Permit No. 8999. Nevertheless,
permitting of the patio appears not to have been addressed at that time. Subsequent to
issuance of that permit, a smaller section of previously existing stone patio at the
southeast corner of the pool patio was replaced; extended laterally around a stone
barbeque counter also built prior to 2017; and improved with the existing hot tub and
stone bench. A generator and two above-ground LP tanks were installed during the
Covid-19 pandemic more than 100 feet from wetlands but within 100 feet of the bank.
Building Permit No. 45507 was issued for the generator in 2020 but no wetlands permit
was requested or obtained. Except for the patio corner extensions, installation of the
current pool patio essentially replicated d site condition that dates back to at least 2001
and likely much longer ago, as the existing swimming pool was issued Certificate of
Occupancy No. Z11662 in 1983. But to provide potential runoff mitigation that likely
would have been required had the patio replacement been reviewed by the Trustees,the
1' x 56' seaward edge of the patio is proposed to be removed and replaced with a gravel
trench drain. And to capture backwash from the existing swimming pool and hot tub, a
currently lacking pool drywell is proposed outside Chapter 275 jurisdiction more than
100 feet from the top of bank. A covenanted non-turf buffer on the landward side of the
retaining wall authorized by Wetlands Permit 8999 is being maintained and is depicted
on the survey submitted herewith. Therefore, maintenance of the existing structures will
be consistent with the Policy 5 goal of protecting water quality and the Policy 6 goal of
protecting the quality and function of the adjacent tidal wetland ecosystem associated
with Jockey Creek.
