Box 1179 Eric Sepenoski J�i Southold,New York 11971 Liz Gillooly Telephone(631) 765-1892 Elizabeth Peeples �® • a� Fax(631) 765-6641 MUlilT`1,�c� BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD February 26, 2025 En-Consultants 1319 North Sea Road Southampton, NY 11968 RE: FRANK DIGREGORIO & ROSEMARY MAURI KNISE 5765 STILLWATER AVENUE, CUTCHOGUE SCTM# 1000-137-4-5.1 Dear Mr. Herrmann: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, January 15, 2025 regarding the above matter: WHEREAS, EN-Consultants on behalf of FRANK DIGREGORIO & ROSEMARY MAURI KNISE applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated October 2, 2024, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 6 & 9 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the proposed project has no negative impact on navigability; issuing a permit; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on January 15, 2025, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the project complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVE the application of FRANK DIGREGORIO & ROSEMARY MAURI KNISE to construct a fixed timber dock with water and electricity consisting of a 4'x44' fixed timber catwalk constructed with open- grate decking, a 3'x14' ramp, and a 5'x12' floating dock secured by two (2) 10" diameter pilings; with the condition to establish and perpetually maintain a 5' vegetated non-turf buffer; and as depicted on the site plan prepared by EN-Consultants, received on February 19, 2025, and stamped approved on February 25, 2025. Permit to construct and complete project will expire three years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of$50.00 per inspection. (See attached schedule.) That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 11. Due to the location and configuration of the property, and the locations and encroachments of the immediately adjacent docks to the north and south,the dock is positioned according to the "long lake/pie" method of establishing the limits of riparian rights set forth by 9 CRR-NY 274.5, as required by Section 275- 11(C)(2)(a)(5)of the Town Code.The dock is proposed almost entirely within the applicant's area of riparian rights,except that to maximize its separation distance from the adjacent dock to the south,as recommended by the Trustees during a pre-submission site inspection on May 9,2024,the float would encroach slightly on the riparian rights of the adjacent property to the north. The owner of that property has reviewed the proposed dock plans and issued a letter consenting to the encroachment; and the Trustees have the discretion to approve such an adjustment for"navigational or other reasons,"pursuant to Section 275-11(C)(2)(a)(5)of the Town Code.The dock is otherwise consistent with the 'construction and operation standards" for docks set forth by Town Code Section 275-11(C)(2); and consistent with "Best Management Practices,"the catwalk would be elevated at least 4 feet above wetlands grade and constructed with light-penetrating open-grate decking to allow for continued vegetation growth beneath it. The owners of that property have reviewed the proposed dock plans and issued a letter consenting to the encroachment;and the Trustees have the discretion to approve such an adjustment pursuant to Section 275-11(C)(2)(a)(5)of the Town Code. Due to the location and configuration of the property, and the locations and encroachments of the immediately adjacent docks to the north and south,the dock is positioned according to the "long lake/pie" method of establishing the limits of riparian rights set forth by 9 CRR-NY 274.5, as required by Section 275- 11(C)(2)(a)(5)of the Town Code.The dock is proposed almost entirely within the applicant's area of riparian rights,except that to maximize its separation distance from the adjacent dock to the south, as recommended by the Trustees during a pre-submission site inspection on May 9,2024,the float would encroach slightly on the riparian rights of the adjacent property to the north. Thus,the project is consistent with the objectives of LWRP Policy 6 and would not create a "fragmentation of ecological communities" along the developed shoreline; result in the physical loss, degradation,or functional loss of ecological components; or otherwise adversely impact the quality or function of the adjacent tidal wetlands or waters of Eugene Creek.
