Box 1179 Eric Sepenoskiiii Southold, New York 11971 Liz Gillooly cos Telephone(631) 765-1892 Elizabeth Peeples Fax(631) 765-6641 c®U ,� January 24, 2025 BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD David Bergen Sol Searcher Consulting PO Box 1008 Cutchogue, NY 11935 RE: PATRICIA MELE & CHERYL CHRISTIANO 1140 DEEP HOLE DRIVE, MATTITUCK SCTM# 1000-115-12-16 Dear Mr. Bergen: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, January 15, 2025 regarding the above matter: WHEREAS, Sol Searcher Consulting on behalf of PATRICIA MELE & CHERYL CHRISTIANO applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated November 4, 2024, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application to remove and replace in place ±50' long wood bulkhead; add a 12' northern return; remove and replace 16' southern return; raise the elevation of the bulkhead and two returns 12 inches higher than existing elevation; bulkhead and returns to be constructed using vinyl sheathing with 10" diameter pilings 6' on-center, 6"x6"whalers, and tie-rods leading to a backing system consisting of helix screws and a fiberglass grated cap; remove existing permitted fixed catwalk and construct new 19'x4' catwalk using Thru- Flow decking supported by 10" diameter pilings; re-install existing permitted ramp to 6'x20' floating dock be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the LWRP Coordinator recommended that the proposed application for the as-built 13'x13' stone and brick patio be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered the Local Waterfront Revitalization Program policy 6 to the greatest extent possible through the imposition of the following 2 Best Management Practice requirements: the large bluestone within the 14' buffer area be removed to only have pea gravel; and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on January 15, 2025, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVES the application of PATRICIA MELE & CHERYL CHRISTIANO to remove and replace in place ±50' long wood bulkhead; add a 12' northern return; remove and replace 16' southern return; raise the elevation of the bulkhead and two returns 12 inches higher than existing elevation; bulkhead and returns to be constructed using vinyl sheathing with 10" diameter pilings 6' on-center, 6"x6" whalers, and tie-rods leading to a backing system consisting of helix screws and a fiberglass grated cap; remove existing permitted fixed catwalk and construct new 19'x4' catwalk using Thru-Flow decking supported by 10" diameter pilings; re-install existing permitted ramp to 6'x20' floating dock; as-built 13'x13' stone and brick patio; and to establish and perpetually maintain the existing 14' wide non-turf buffer located along the landward edge of the bulkhead; with the condition that the large bluestone within the 14' buffer area be removed to only have pea gravel; and as depicted on the site plan prepared by Dave Bergen and Ken Quigley, received on January 24, 2025, and stamped approved on January 24, 2025. Please be advised that DEC has documented the summer occurrence of the Northern Long.-Eared Bat (NLEB) (Myotis septentrionalis), a species listed as "threatened"by both New York State and the US Fish &Wildlife Service, within 1.5 miles of your property. A 98% decline in the abundance of NLEB has been observed since 2006. The Northern Long Eared Bat Story - Habitat and Decline Northern long-eared bats (NLEB), also known as northern Myotis, are primarily forest-dependent insectivores. Bats consume approximately 3,000 insects per day, including mosquitos and crop pests. They use a variety of forest habitats for roosting,foraging and raising young. In general, any tree large enough to have a cavity or that has loose bark may be used by the bats for roosting or rearing young. This species is listed as threatened because of a dramatic population decline throughout most of its range. This decline has been caused by white-nose syndrome (WNS) a disease caused by an invasive fungus that ultimately causes affected hibernating bats to starve to death over the winter. DEC has determined that tree cutting at your property between March 1 and November 30 of any calendar year may impact the bats in your area, and may result in the direct killing or injury of individual members of this protected species, interference with critical breeding,foraging, migratory or other essential behaviors, or adverse modification of the species' habitat (these activities are defined as a "take" by the Environmental Conservation Law). The "take" of a species listed as endangered or threatened is prohibited in the absence of a permit from this Department. In order to avoid the possibility of an Endangered Species"take," no tree cutting activities should be conducted at your project site between the dates of March 1 and November 30 of any calendar year. Depending on site conditions, it is possible that future projects on your property will not require adherence to this restricted timeframe. In some situations, an individual tree or very small trees may be cut at any time of the year without resulting in a "take" of endangered /threatened species or their habitat.
