Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in
accordance with the Resolution of the Board of Trustees adopted at the meeting held on January 15,2025,and
in consideration of application fee in the sum of$1,250.00 paid by CREDIT SHELTER TRUST&THE
MILLICENT TUFANO FAMILY TRUST,c/o EMILIA TUFANO,TRUSTEE and subject to the Terms and
Conditions as stated in the Resolution,the Southold Town Board of Trustees authorizes and permits the
following: `
Wetland Permit to remove and replace in-place existing±10' section of timber bulkhead return
't with vinyl bulkhead return,and construct±20' vinyl return extension beneath existing 935sq.ft.
deck landward thereof(temporarily open and re-close sections of deck surface to allow

splash pad and bulkhead; all as depicted on the site plan prepared by En-Consultants,received
on June 3,2025,and stamped approved on June 5,2025.

TERMS AND CONDITIONS
The Permittee CREDIT SHELTER TRUST&THE MILLICENT TUFANO FAMILY TRUST,
c/o EMILIA TUFANO, TRUSTEE, 2482 Camp Mineola Road,Mattituck New York as part of
the consideration for the issuance of the Permit does understand and prescribe to the f9llowing:
1. That the said Board of Trustees and the Town of Southold Are released from any and all,
damages, or claims for damages,of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will,at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 36 months,which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant,request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with.the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice,to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,'title,
or interest in real or personal property held or vested in a person not a party to the permit.

Dear Mr. Herrmann:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, January 15, 2025 regarding the above matter:
WHEREAS, En-Consultants on behalf of CREDIT SHELTER TRUST &THE MILLICENT
TUFANO FAMILY TRUST, c/o EMILIA TUFANO, TRUSTEE applied to the Southold Town
Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the
Wetland Ordinance of the Town of Southold, application dated October 29, 2024, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
and to the Local Waterfront Revitalization Program Coordinator for their findings and
recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be found
Consistent with the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
January 15, 2025, at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the proposal complies with the standards set forth in Chapter 275 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent with the
Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees APPROVE the application of CREDIT SHELTER
TRUST &THE MILLICENT TUFANO FAMILY TRUST, c/o EMILIA TUFANO, TRUSTEE to
remove and replace in-place existing ±10' section of timber bulkhead return with vinyl bulkhead
return, and construct±20' vinyl return extension beneath existing 935sq.ft. deck landward
thereof(temporarily open and re-close sections of deck surface to allow construction access);
install approx. 24 linear feet of 1.5' to 2.5' diameter stone rip rap from extended bulkhead return
to west property line, along seaward edge of Rosa rugosa, to retain remaining buffer vegetation
being lost to erosion; backfill proposed return extension, and restore ±8' wide area of washed
out grade landward of existing return and bulkhead with approx. 35 cubic yards of clean sandy
fill to be trucked in from an approved upland source; install 5'wide, 25 to 75 pound stone splash
pad along landward edge of bulkhead; reset/replace (in-kind, in-place), existing 14'x15' loose
paver patio landward of bulkhead; remove existing dilapidated walkway, and construct 4'x1.0'
wood landing and 4'x8' stair adjacent to return; establish and perpetually maintain a 10'
vegetated non-turf buffer landward of the established splash pad and bulkhead; all as depicted
on the site plan prepared by En-Consultants, received on June 3, 2025, and stamped approved
on June 5, 2025.
Permit to construct and complete project will expire three years from the date the permit is
signed. Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

10-foot wide vegetated non-turf buffer landward of the bulkhead, excluding/allowing for the
maintenance of the approved stone splash pad and patio areas.

Here are a few bits of information in response to your query about the deck:
1) The deck itself is not being removed and replaced as indicated in your email below. As described in the project
description and plans,the contractor will need to remove/replace certain sections of the deck surface/decking to
allow for access through/beneath it during construction.
2) Attached are copies of the C/O issued for the house and deck in 2002 and the deck plans from the same Building
Dept.file. Thus,it does appear the deck was added to the building permit application and approved by the
Building Dept.subsequent to issuance of Wetlands Permit#4881.
3) The total area of the attached deck is approximately 935 sf.
4) Finally,it is worth noting the deck was present and appears on the survey and plans associated with Wetlands
Permit#8101 issued in 2013.

I am putting together the Tufano application and found that the existing wood deck that is proposed to be temporarily
removed and re-set/replaced was never permitted by the Trustees. When the house Wetland Permit was issued, no
decking was proposed to either this office or initially to the Bldg. Dept. (not sure if during construction it was added to
Bldg. Permit but not to this office). Unfortunately I need the approx.square footage of the existing wood deck that
wraps around from the west to the south as soon as possible so that I can add it to the written project description.

Statement of Effect
The subject property has been maintained and protected from erosion by bulkheading since prior to 1977,
and the bulkhead and returns were reconstructed pursuant to Wetlands Permit 8101 in 2013 after suffering
storm damage during Superstorm Sandy. Over the course of the past several years, increased erosion has
resulted in the loss of approximately 8 feet of Rosa rugosa and other buffer vegetation upland of the beach,
between the return and the west property line(see Figures 7 &8). Ongoing erosion is also occurring around
the landward end of the west return, extending beneath the existing deck attached to the house and behind
the return, causing washed out upland soils landward of the return and bulkhead. Erosional soil loss is
evidenced by exposed tie rods and deck footings beneath the deck (see Figure 3), and by subsiding
vegetation and collapse of a loose paver patio behind the return and bulkhead (see Figures 4 and 10).
The application therefore proposes an approximately 201f extension to the existing vinyl and wood return
(as well as in-place replacement of the most landward wood section of the existing return with vinyl) to
prevent continued erosion from occurring around the landward end of the existing return and consequent
loss of soils and vegetation,and potential structural damage;placement of clean sandy fill to restore washed
out grades behind the existing return and bulkhead; and installation of stone rip-rap along the seaward edge
of the remaining Rosa rugosa to stem the ongoing loss of buffer vegetation between the return and west
property line.
Without an extension of the bulkhead return beneath the existing deck, upland soils landward of the return
and bulkhead will continue to wash out,erode and drop in elevation, allowing a continued imminent risk of
structural damage both to the deck and home. As the extended return will be located entirely in the upland
area beneath the existing deck, its only impact will be the intended stabilization of soils under the deck and
adjacent to the house; it will have no adverse impacts on the surrounding beach, vegetation, or adjacent
property. Without placement of the stone rip-rap, the existing Rosa rugosa and other buffer vegetation in
the vegetated area upland of the beach will continue to erode and be lost. Based on the still visible roots
where the shrubbery previously existed and a review of aerial images from 2019 and 2024 (see Figures 5
& 6), an approximately 10 to 15-foot deep area of buffer vegetation has been lost or severely compromised
during the past 5 years. The rip-rap would stem this continued loss of vegetation without inhibiting any
potential recovery of the beach or vegetation on its seaward side.
The project is therefore consistent with the construction and operation standards set forth in Section 275-
11(B) and the standards for permit issuance set forth in Section 275-12. And consistent with Policies 4 and
6 of the LWRP, respectively, the proposed structural remedies would serve their intended purpose of
providing protection for and minimizing flood and erosion damage to existing structures,soil and vegetation
without adversely impacting the quality or function of the beach, vegetation or tidal waters associated with
the surrounding Great Peconic Bay ecosystem.

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in

2. Before answering the questions in Section C, the preparer of this form should review the exempt

LWRP Policies 4 & 6
The subject property has been maintained and protected from erosion by bulkheading since prior to 1977,
and the bulkhead and returns were reconstructed pursuant to Wetlands Permit 8101 in 2013 after suffering
storm damage during Superstorm Sandy. Over the course of the past several years, increased erosion has
resulted in the loss of approximately 8 feet of Rosa rugosa and other buffer vegetation upland of the beach,
between the return and the west property line(see Figures 7& 8). Ongoing erosion is also occurring around
the landward end of the west return, extending beneath the existing deck attached to the house and behind
the return, causing washed out upland soils landward of the return and bulkhead. Erosional soil loss is
evidenced by exposed tie rods and deck footings beneath the deck (see Figure 3), and by subsiding
vegetation and collapse of a loose paver patio behind the return and bulkhead(see Figures 4 and 10).
The application therefore proposes an approximately 20 if extension to the existing vinyl and wood return
(as well as in-place replacement of the most landward wood section of the existing return with vinyl) to
prevent continued erosion from occurring around the landward end of the existing return and consequent
loss of soils and vegetation,and potential structural damage;placement of clean sandy fill to restore washed
out grades behind the existing return and bulkhead; and installation of stone rip-rap along the seaward edge
of the remaining Rosa rugosa to stem the ongoing loss of buffer vegetation between the return and west
property line.
Without an extension of the bulkhead return beneath the existing deck, upland soils landward of the return
and bulkhead will continue to wash out, erode and drop in elevation, allowing a continued imminent risk of
structural damage both to the deck and home. As the extended return will be located entirely in the upland
area beneath the existing deck, its only impact will be the intended stabilization of soils under the deck and
adjacent to the house; it will have no adverse impacts on the surrounding beach, vegetation, or adjacent
property. Without placement of the stone rip-rap, the existing Rosa rugosa and other buffer vegetation in
the vegetated area upland of the beach will continue to erode and be lost. Based on the still visible roots
where the shrubbery previously existed and a review of aerial images from 2019 and 2024 (see Figures 5
& 6), an approximately 10 to 15-foot deep area of buffer vegetation has been lost or severely compromised
during the past 5 years. The rip-rap would stem this continued loss of vegetation without inhibiting any
potential recovery of the beach or vegetation on its seaward side.
The project is therefore consistent with the construction and operation standards set forth in Section 275-
11(B) and the standards for permit issuance set forth in Section 275-12. And consistent with Policies 4 and
6 of the LWRP, respectively, the proposed structural remedies would serve their intended purpose of
providing protection for and minimizing flood and erosion damage to existing structures,soil and vegetation
without adversely impacting the quality or function of the beach, vegetation or tidal waters associated with
the surrounding Great Peconic Bay ecosystem.
