(signed) Adele Payne, Notary Public. The next paper in the file is a report to the To~n Board from the Southold Town Planning Board which is as follows= June 8, 1960 Report: Southold Town Board Southold, New York Gentlemen~ This is to certify that the following action was taken by the Southold Town Planning Bard at its meeting on June 7, 1960= In the matter of the petition of Mary Doroski and Theodore Doroski for a change of zone from "A" Residential and Agricultural District to "B" Business District on certain real property situated at Cutchogue, New York, and more particularly bounded and described as follows= The legal description is identical to the one I read in the legal notice. The report goes on to say: RESOLVED that the Planning Board recommend to the Town Board that the change from "A" Residential and Agricultural District to "B" Business District be made on the aforementioned propery. Some of the members of the Planning Board are familiar with the operation. They have been packing potatoes for at least one of their neighbors for many years prior to zoning and for the past two years they have been buying substantial quantities of potatoes. In addition to that we feel that an 5 additional independent outlet for Long Island Potatoes is probably an asset to the community. Finally, this property is adjacent to a "B" Business District and not too far distant from an additional "B" Business District on the same side of the Street. Respectfully submitted, Xsigned) John Wickham John Wickham, Chairman Southold Town Planning Board We also have a petition in the file to the Town Board of Southold stating that Mary Doroski and Theodore Doroski, both residing at Cutchogue, Suffolk County, New York, the undersigned, are the owners of certain real property situated at Cutchogue, N.Y. and more particularly bounded and described as follows: and the legal description is the same as the one read previously. The petition states they are petitioning so that the aforesaid premises be changed from to "B" Business District. Such request is made for lying immediately to the west are already in District and are used for commercial purposes "A" Residential and Agricultural District the following reasons: The lands "B" Business - namely, as a garage. A gasoline station is being operated about 560 feet to the east. The character of the neighborhood is therefore already partially "B" Business in character. The premises have been used, in part, for grading of potatoes grown on the adjoining lands. The owner and tenant 6 desire that same be used henceforth for grading potatoes commercially, and wi~ to have said business operations in compliance with the Zoning Ordinance. This pertition is signed by Mary Doroski and Theodore Doroski. I wish to say before anybody speaks, please give your name and address to Mrs. Boken so she may record it for the record. Is there anyone who wishes to speak in favor of said change of zoning? GORDON M. LIPETZ, 175 Griffing Avenue, Rlverhead, New York: I appear in behalf of Mary Doroski and Theodore Doroski, her son. There is little I can add to what is in the petition. The son, Theodore Doroski, wants to raise potatoes. I was informed by the Building Inspector he cannot grade potatoes commercially unless there is a change to Business. The potatoes that had been graded in the past were potatoes grown on their own land. They want to be in compliance with the Ordinance. There will not be any disruption of the neighborhood if the potato plant is located some distance from the road. They intend to purchase potatoes from other farmers that will be graded. If there are any questions I will be glad to answer them. The basic story is contained in the petition. Are there any questions? COUNCILMAN ALBERTSON~ Not at this moment. Possibly later Oho 7 Is there anyone else who wishes to speak SUPERVISOR TUTHILL: favor of this change of zoning? MR. ADAM ZAVESKI, Main Road, Pe~onic, New York: I am a I would like to speak not I feel he is very important. I have sold to Mr. Doroski for two years. There were times when a lot of dealers would not take potatoes but Mr. Doroskl%ould. I also bought fertilizer and seed from him to help him out. I feel he is very important to us in that section over there. SUPERVISOR TUTHILL: to speak MR. want to supplement Mr. Zaveski's statement, carted as yet, but I intend to this summer. is just asking for something that he are doing now. MR. JOHN BAUER, Main Road, Peconic, New York: Is there anyone else who would like in favor? GEORGE STELZER, North Road, Peconic, New York: I just and as I have not I feel Mr. Doroski intends to do and what others We have not sold any potatoes to Mr. Doroski, but of course we are pretty big operation. I go along with what George and Adam said and I feel we can not have too many outlets and I can not see any reason why it should not be rezoned. MR. JOSEPH PONTINO, Indian Neck Lane, Peconic, New York: I would like to speak in favor of Mr. Doroski's request for a change of zone. I think it is a good thing. MR. ALBERT ORLOWSKI, Sterling Lane, Cutchogue, New York: I am very much in favor. I have had Mr. Doroski grade potatoes. farmer on the Main Road in Peconic. as much for Mr. Doroski as myself. 8 I do not think we can ever have to many outlets in Southold Town. I do not think we should turn down anything which gives employment to people. MI~. PETER KUJAWSKI, Bay Avenue, Peconic, New York: I am in favor with what the other farmers have said. MR. BYRON E. HORTON, New Suffolk Avenue, New Suffolk, New York: I am in favor of the change. MR. ADAM V. DOROSKI, Bay Avenue, Peconic, New York: I also am in favor of him grading potatoes there. SUPERVISOR TUTHILL: I was talking to several people in Cutchogue this afternoon. They decided not to come down tonight and they wished me to record their names as not being against a change of zoning as far as this property being used for grading potatoes. The five individuals are: John Pletrowicz, Albert Pietrowicz, Felix Doroski, Leander Glover and Leander Glover, Jr. MI~. STELZER: I understood they were the ones that objected to this. What is the issue here? SUPERVISOR TUTHILL: I believe they objected to a labor camp, but they have no objection to this property being rezoned. They called me up and I explained it to them as I know it and they had no objection to this property being rezoned, as far as present who wishes to speak in favor the petition goes. Is there anyone else of this change of zoning? MR. JULIUS KRUPSKI, Main Road, Peconic. New York: favor of it. I am in SUPERVISOR TUTHILL: Anybody else? (There was no response.) SUPERVISOR TUTHILL: Is there anyone present who wishes to speak against this particular petition? (There was no response.) MRS. THEODORE DOROSKI: When will a decision be made on this application. We will be grading potatoes the first of August. We will want to hear by then. COUNCILMAN ALBERTSON: We will make a decision within the next 15 minutes. SUPERVISOR TUTHILL: Do any members of the Town Board have any questions or anything to say? COUNCILMAN ALBERTSON: Mr. Stelzer says what is the issue here. I would like to explain for the benefit of those who have never attended one of these hearings before, that it lsnecessary, according to law, to have a hearing and hear everybody in favor of or against such petition. In many instances nobody is opposed to it. SUPERVISOR TUTHILL: If there is nothing more to be said I will call this hearing adjourned. Hearing adjourned at 7:45 P.M. 10 Moved by Councilman Albertson, seconded by Justice Tuthill: WHEREAS, Mary Doroski and Theodore Doroski by petition verified the 6th day of June, 1960, petitioned the Town Board for a change of zone of certain real property described in said petition from "A" Residential and Agricultural District to "B" Business District and for W~EREAS the said petition was referred to the Planning Board its official report and recommendation; and WHEREAS the Town Board pursuant to due notice thereof, held District to "B" Business District the following described property: All that certain tract or parcel of land situated at Cutchogue, in the Town of Southold, Suffolk County, New York, and more particularly bounded and described as follows: Beginning at a point on the northwesterly line of the Main Road, which point is about 535 feet measured southwesterly along said northwesterly line from Cox's Lane, said point of beginning being the southwesterly corner of land of John Pietrowicz and the southeasterly corner of land of Theodore Doroski, from said point of beginning running southwesterly along said northwesterly line of the Main Road, 207 feet, more or less, to land of Felix a hearing on said petition on July 5, 1960, at which time all interested persons were given an opportunity to be heard, NOW, THEREFORE BE IT RESOLVED that the Southold Town Build- ing Zone Ordinance, including the Southold Town Building Zone Maps, be amended by changing from "A" Residential and Agricultural Doroski; thence northwesterly along said land of Felix Doroski (Being along the existing "B" Business District) and continuing along land of Mary Doroski, 340 feet; thence northeasterly along said land of Mary Doroski, 185 feet, more or less, to land of John Pietrowicz~ thence southeasterly along said land of John Pietrowicz, 340 feet to the point of beginning.
