Any other activity within 100' of the wetland boundary requires a permit from this office. This is not a determination from any other agency. SCTM# 1000-55-3-30 Dear Mr. Price, Based on the information you have submitted, the Department of Environmental Conservation has determined that the property landward of the 10 foot contour line, as shown on the survey prepared by John T. Metzger dated 1/24/2017, is beyond Tidal Wetlands Act (Article 25)jurisdiction. Therefore, in accordance with the current Tidal Wetlands Land Use Regulations 6NYCRR Part 661.4 (iii) no permit is required for existing structures above the 10 foot contour line, and we do not issue permits for already built structures that are located below the 10 foot contour line. (DEP-ARNO) Be advised, no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a permit. It is your responsibility to ensure that all precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Article 25 jurisdiction which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and your project (i.e. a 15' to 20'wide construction area) or ere^tong a temporary fence, barrier, or hale bay berm. One seems to add an additional 4'to the"right"side of the deck beyond the 22'.5"you list. On the"left"side of the deck you seem to be removing the existing steps and replacing them in a new location that also seems to increase the length of the existing deck. That increased distance must be noted as well; 3) Based on the drawings, it appears work is being done on the exterior of the house as well, such as relocating doors or windows. If so,please indicate what kind of work is being done, as it may require a full Wetland Permit instead of just an Administrative Permit.
