RELIEF STED: The applicant requests variances to 1)locate a swimming pool in a side yard location where town code requires swimming pools to be located in a rear yard location. 2)The additions propose a rear yard setback pf 13 feet 11 inches where town code requires a minimum 35-foot rear yard setback. 3)the site plan calculates a total lot coverage of 23A percent where town code permits a maximum lot coverage of 20%4)The proposed gross floor area is 3,236 square feet where town code permits a maximum gross floor area of 2,568 square feet on this size parcel,exceeding the maximum by 668 square feet. Page 2,August 17,2023 #7813,Provenzano SCTM No. 1000-15-7-10 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 3,2023 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Taw -b I ffiLI). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The parcel is a single-family residential neighborhood. Two story homes are characteristic of this neighborhood. The parcel is burdened by two front yards therefore the non- conforming rear yard setback is actually for an architectural side yard, and the non-conforming pool location is actually an architectural rear yard location. The excessive lot coverage is for a swimming pool which will not be visible from the street.Due to extensive mature landscaping and solid wood fencing.The non-conforming gross floor area is 668 square feet over the code permitted maximum. The applicant testified that the house was designed prior to the new Gross Floor Area requirements and the 668 square feet does not affect the character of the neighborhood. 2. Town Law§267 1fb 2I. The benefit sought by the applicant for the non-conforming pool location cannot be achieved by some method,feasible for the applicant to pursue, other than an area variance. The parcel is burdened by having two front yards and there is not a code conforming location to build a swimming pool. The applicant could meet the rear yard setback requirements, lot coverage requirement, and GFA requirement, however, the applicant designed the house and placed the swimming pool in the least obtrusive location so as to screen it from the street and the neighborhood,and is maintaining the existing footprint by adding livable space over the existing attached garage. 3. Town 1iw _ The variance granted herein for the non-conforming pool location is mathematically substantial,representing 100%relief from the code. The variance granted herein for the non-conforming rear yard setback is mathematically substantial, representing 60%relief from the code. The variance granted herein for the non-conforming lot coverage is mathematically substantial, representing 17% relief from the code. The variance granted herein for the non-conforming gross floor area is mathematically substantial,representing 26% relief from the code. however,the lot is a comer lot burdened by two front yards,the applicant eliminated a shed and some decking to reduce the excessive lot vcaused by the proposed pool which is also as small in size as possible, and the proposed second story additions, alterations and accessory swimming pool are all characteristic of the residential properties in this neighborhood. 4. Towu Law §Z67 )JbJf!L No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. Also, the applicant proposes a new Innovative AIteriative wastewater treatment sanitary system 5. Town Law§26 (3)(bW_ The difficulty for the pool location, rear yard setback, and lot coverage has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. The difficulty for the non-conforming Gross Floor Area is not self-created because the GFA requirements were added to the code after the home had been designed based on the code that was current at the time and submitted to the ZBA for variance relief. 6.Town Law §26 b. Grant of the requested relief is the minimum action necessary and adequate)to enable the applicant to enjoy the benefit of a renovated home with swimming pool while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community.
