BOUNDARY LINE AGREEMENT
This Agreement, made the Jff day of dam, 2022, between HOUND'S TREE ESTATE
LLC, a New York limited liability company, residing at 12950 Oregon Road, Cutchogue, New /
York 11935 (hereinafter referred to as "Parcel A Owner"), and GORDON R. HEINS, an
individual, residing at 2200 Oregon Road, Mattituck, New York 11952 (hereinafter referred to as
"Parcel B Owner");
WHEREAS, Parcel A Owner is the owner in fee simple of certain real property with an address
of 2600 Oregon Road, Mattituck, New York (District 1000.00, Section 100.00, Block 04.00, and
Lots 005.003 and 005.004) on the Tax Map for the County of Suffolk, State of New York and as
more particularly described on Schedule A attached hereto and made part hereof (hereinafter
"Parcel A,'); and
WHEREAS, Parcel B Owner is the owner in fee simple of certain real property with an address
of 2200 Oregon Road, Mattituck, New York (District 1000.00, Section 100.00, Block 04.00 and
Lot 005.002) on the Tax Map for the County of Suffolk, State of New York and as more
particularly described on Schedule B attached hereto and made part hereof(hereinafter "Parcel
B"); and
WHEREAS, Parcel A adjoins Parcel B; and
WHEREAS, a survey of Parcel A has been prepared by JM Land Surveying, dated May 11, 2022
(hereinafter the "Survey"), a copy of which is attached as Exhibit 1. The Survey shows, among
other things, (i) a fence which runs along or nearby the north line of Parcel A and the south line
of Parcel B, but is situate up to 7.0 feet inside Parcel A, and (ii) a fence which runs along or
nearby the east line of Parcel A and the west line of Parcel B, but is situate up to 30.4 feet inside
Parcel A; and
WHEREAS, the parties desire to fix and definitely establish the boundary line between the two
parcels mentioned above respectively owned by them without resort to litigation; and
NOW, THEREFORE, in consideration of the mutual promises and conveyances herein
contained, and other good and valuable consideration, the receipt of which is hereby mutually
acknowledged, the parties hereto for themselves and their heirs, legal representatives, successors
and assigns, covenant and agree as follows:
That irrespective of the placement of the fences between Parcel A and Parcel B, (i) the common
boundary line between the parcels shall be deemed the northern boundary of the property owned
by Parcel A Owner and the southern boundary of the property owned by Parcel B Owner, and(ii)
the common boundary line between the parcels shall be deemed the eastern boundary of the
property owned by Parcel A Owner and the western boundary of the property owned by Parcel B
jOwner, each as described as follows:
Said lines being the division lines as crosshatched on Exhibit 1 attached hereto.

Parcel A Owner does hereby remise, release and quitclaim unto Parcel B Owner, its successors
and assigns, all of its right, title and interest in and to any land lying to the north of the said
division line so established, and Parcel B Owner does hereby remise, release and quitclaim unto
Parcel A Owner, its successors and assigns, all of its right, title and interest in and to any land
lying to the south of the said division line so established,
The parties further agree and acknowledge that any use by Parcel A Owner, their heirs, legal
representatives, successors and assigns, of any portion of Parcel B lying north of the division
line, is permissive and not hostile to or with any claim of right against Parcel B Owner, their
heirs, legal representatives, successors and assigns;
Parcel A Owner does hereby remise, release and quitclaim unto Parcel B Owner, its successors
and assigns, all of its right, title and interest in and to any land lying to the east of the said
division line so established, and Parcel B Owner does hereby remise, release and quitclaim unto
Parcel A Owner, its successors and assigns, all of its right, title and interest in and to any land
lying to the west of the said division line so established, and
The parties further agree and acknowledge that any use by Parcel B Owner, their heirs, legal
representatives, successors and assigns, of any portion of Parcel A lying west of the division line,
is permissive and not hostile to or with any claim of rights against Parcel A Owner, their heirs,
legal representatives, successors and assigns.
IT IS MUTUALLY AGREED AND COVENANTED that this agreement shall run with the land
and inure to the benefit of and be binding upon the parties hereto and their respective heirs, legal
representatives, successors and assigns.
