A Local Law entitled, "A Local Law in relation to Amendments to Chapter 197 Peddlers, Solicitors, Loitering
and Transient Retail Merchants"
Be it enacted the Town Board of the:

I. PURPOSE
To include loitering into the Town of Southold Code. The Chapter 197 shall be renamed"Peddlers, Solicitors,
Loitering and Transient Retail Merchants".
II. AMENDMENT
§ 197-1. Legislative intent.
The purpose of this chapter is to prevent practices of peddlers, solicitors, loitering, and transient retail
businesses from existing in the Town of Southold with certain exceptions, as otherwise provided herein, by
providing for the registration and regulation of the conduct of certain peddlers, solicitors, loitering and
canvassers and otherwise eliminating such practices.
§ 197-2. Definitions.
As used in this chapter,the following terms shall have the meanings indicated:
LOITERING - Encompasses one or more of the following acts:
A. Obstructing, molesting or interfering with any person lawfully upon the street, sidewalk, park or
other public place.
B. Remaining in a public place for the purpose of annoying or harassing any person lawfully upon any
street, sidewalk,park or other public place.
PUBLIC PLACE-Any place to which the public is invited,including the quasi-public area in front of or adjacent
to or within any store, shop,restaurant,bar, luncheonette or other place of business, and also any parking lots or
other private or public property not owned by or under the dominion of the person charged with a violation of
this chapter.

§ 197-13. Loitering prohibited.
No person shall loiter in any way upon any street or in any public place in the Town of Southold.
§ 197-14. Public urination prohibited.
No person shall urinate in any public place, other than within restroom facilities, or in public view within the
Town of Southold.
§ 197-15. Public defecation prohibited.
No person shall defecate in any public place, other than within restroom facilities, or in public view within the
Town of Southold.
§ 197-16. Penalties for offenses.
Any person required by this chapter to procure a license who violates its terms or who violates any of the
provisions of this chapter shall, upon conviction thereof, forfeit and/or pay not less than $250 or more than
$2,500 for the first offense and no less than$500 or more than$5,000 for the second or any subsequent offense.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid,the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

section (36)(37) of the Municipal Home Rule Law, and having received the affirmative vote of a majority of the qualified
electors of such city voting thereon at the(special)(general) election held on 20 ,
became operative.

of the County of State of New York, having been submitted to the electors
at the General Election of November 20 , pursuant to subdivisions 5 and 7 of section 33 of the

general election,became operative.

II. AMENDMENT
§ 197-1. Legislative intent.
The purpose of this chapter is to prevent business practices of peddlers, solicitors, loitering, and
transient retail businesses from existing in the Town of Southold with certain exceptions, as
otherwise provided herein, by providing for the registration and regulation of the conduct of
certain peddlers, solicitors, loitering and canvassers and otherwise eliminating such practices.
§ 197-2. Definitions.
As used in this chapter,the following terms shall have the meanings indicated:
LOITERING -Encompasses one or more of the following acts:
A. Obstructing, molesting or interfering with any person lawfully upon the street,
sidewalk, park or other public place.
B. Remaining in a public place for the purpose of annoying or harassing any
person lawfully upon any street, sidewalk, park or other public place.
PUBLIC PLACE-Any place to which the public is invited,including the quasi-public area
in front of or adjacent to or within any store, shop, restaurant, bar, luncheonette or other
place of business, and also any parking lots or other private or public property not owned
by or under the dominion of the person charged with a violation of this chapter.

No person shall loiter in any way upon any street or in any public place in the Town of
Southold.
197-14. Public urination prohibited.
No person shall urinate in any public place, other than within restroom facilities, or in
public view within the Town of Southold.
197-15. Public defecation prohibited.
No person shall defecate in any public place, other than within restroom facilities, or in
public view within the Town of Southold.
197-16. Penalties for offenses.
Any person required by this chapter to procure a license who violates its terms or who
violates any of the provisions of this chapter shall, upon conviction thereof, forfeit and/or
pay not less than $250 or more than $2,500 for the first offense and no less than $500 or
more than $5,000 for the second or any subsequent offense.
III. SEVERABILITY
If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid,the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.
