Based on the information provided on the LWRP Consistency Assessment Form submitted to this department and the records available to -.me, I recommend that the as-built structures be INCONSISTENT with policy 6 and, therefore, the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. INSTRUCTIONS Planning Board I , All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. And the finished condition of the property will need to incorporate the covenanted non-turf buffer adjacent to the bulkhead pursuant to Town Wetlands Permit No. 9786. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable r The project seeks primarily to replace an existing,deteriorating raised wood deck and retaining wall with a grade-level masonry patio and retaining wall farther from wetlands.The presently raised yard area between the existing and proposed walls would be excavated down roughly to the existing lawn elevation on the seaward side of the existing retaining wall.The project would thus completely eliminate the raised deck structure on the waterside of the house and result in the overall landward retreat of elevated yard and structural surfaces on the property.And a proposed grade-level stone paver patio currently approved adjacent to the bulkhead by Wetlands Permit No. 9786 would be relocated to the landward edge of the covenanted 6-foot wide non-turf buffer adjacent to the bulkhead.Thus,consistent with Policy 6,through increased wetland setbacks and the elimination of multiple treated lumber structures,the project would essentially maintain but improve upon the long existing site conditions without adversely impactin the quality or function of the adjacent tidal wetland ecosystem.
