Located: 1645 Calves Neck Road, Southold. SCTM# 1000-63-7-38 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the LWRP policies and, therefore, INCONSISTENT with the LWRP. A Wetland Permit for a 110' long dock was issued in 1985 (2079)'and a 4' x 105' dock was issued in 1993 (63-7-38) authorizing access to public waters. In 2022 the Board approved a 121' long dock under permit 1950C. This action will add 9' feet to the seaward limit of the dock. The applicant fails to prove that the action meets the following requirements as outlined in § 275-11 Construction and operation standards-C. 2 (d) of the Southold Town Code: (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: r V 17 Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts. • The dock does not meet the 1/3 rule and will further encroach into public waters on public lands and'is inconsistent with policies 6.3 and 9. • In addition, Chapter 275 requires that the determination of the length of the dock must include the dimensions of the vessel. The dimensions of a vessel are not specified. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Cc: Honorable Lori M. Hulse, Attorney J f t7 ' Town of Southold RECEIVE LWRP CONSISTENCY ASSESSMENT FORM AUG 04 2024 South I Town A. INSTRUCTIONS Planning Board 1.
