(631) 765-1809 Southold Town C!C k ' FINDINGS,DELIBERATIONS AND DETERMINATION MEETING OF DECEMBER 19, 2024 ZBA FILE: #7962 NAME OF APPLICANT: Church of the Redeemer PROPERTY LOCATION: 13225 Sound Avenue,Mattituck,NY SCTM No. 1000-141-4-27 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 11 category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. " LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject parcel is a 10,464.74 sq. ft. non-conforming lot located in a Hamlet Business (FIB) Zoning District. The westerly property line measures 149.50 feet fronting the Westphalia Road, the southerly property line measures 70 feet fronting Old Sound Avenue, the easterly property line measures 149.50 feet, and the northerly property line measures 70 feet. The property is improved with a one- and two-story church building,all as shown on survey prepared by Kenneth M. Woychuk,LLS, dated February 12,2024. BASIS OF APPLICATION: Request for a Variance from Article X, Section 280-46 and the Building Inspector's May 31, 2024 Notice of Disapproval based on an application for a permit to construct an addition to an existing religious building/house of worship; at; 1)less than the code required minimum side yard setback of 10 feet; located at: 13225 Sound Avenue,Mattituck,NY. SCTM No. 1000-141-4-27. RELIEF REQUESTED: The applicant requests a variance to construct an addition to the religious building/place of worship having a 7-foot setback from the side yard facing Westphalia Road, instead of the code required 10 foot minimum. FINDINGS OF FACT/REASONS FOR BOAReACTION: The Zoning Board of Appeals held a public hearing on this application on December 7,2024 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: Page 2,December 19,2024 #7962,Church of the Redeemer SCTM No. 1000-141-4-27 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject church building is located on a corner lot facing both Westphalia and Old Sound Avenue. It has existed in its current location for decades. The property is surrounded by a parking lot and three streets. Commercial shops, a community theater and dwellings are part of the larger subject neighborhood. The principal entrance to the church faces Old Sound Avenue. The small addition and updated entry are proposed in the architectural side yard of the church facing Westphalia.On the opposite side of Westphalia there is a single family dwelling whose side elevation faces the street and church. The proposed addition will maintain the church's existing non-conforming setback except for a cantilevered bay window which will enhance the architectural appearance of the church.Therefore,there will be no adverse impact to the character of the neighborhood 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The building already exists with a non-conforming side yard setback which will be maintained by the entirety of the proposed addition other than for a cantilevered bay window. To construct the addition with a conforming setback would result in an activates room that measures 12.4 feet by 24.75 feet which would make the space extremely cramped and unsuitable for church gatherings. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 30%relief from the code. However,other than for a new cantilevered bay window,the non-conforming setback of the existing church building will be maintained, the proposed activity room addition will not be used full-time and will be designed to improve the appearance and public accessibility to an upgraded meeting space on the ground floor for quiet church related gatherings for activities such as bible study,coffee hour and meditation. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has not been self-created. The subject church building predates the Zoning Code. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition to the religious building, while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13,motion was offered by Member Weisman(Chairperson),seconded by Member Planamento, and duly carried,to GRANT the variance as applied for,and shown on the Site Plan and Architectural Plans(Sheets SP-1,A-1 &A-2) prepared by David Bruce Mann,Architect, last revised July 17,2024. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. IMPORTANT LDIITS ON THE APPROVAL(S)GRANTED HEREIN Please Read Carefully Any deviation from the survey,site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals.
