The Southold Town Board of Appeals issued a positive determination for the action in January 2023, finding it
consistent with the LWRP. New construction must be FEMA compliant.
En-Consultants on behalf of SHEILA STOLTZ requests a Wetland Permit to demolish existing two-story
dwelling and appurtenances, and construct a new 2.5-story, single-family dwelling with a front porch; rear
porch; covered walk; outdoor shower over grade-level deck and piped to a drywell; install new gravel
driveway in place of existing; new public water service; new I/A sanitary system; install stormwater drainage
system; and to perpetually maintain as a vegetated non-turf buffer the existing vegetation located within 100
feet of the limit of beach adjacent to Hog Neck Bay (allowing for the maintenance of the existing sand
footpath). Located: 2025 Smith Road, Peconic. SCTM# 1000-98-4-19.2
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based
upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as
well as the records available to me, it is my recommendation that the action is CONSISTENT with the LWRP
Policy 6 provided the following is required.
1. Retain all vegetation seaward of the"Limit of Natural Vegetation" on the survey and in a
covenant and restriction.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1, All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this,form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its si nificant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

Consistent with Policies 5 & 6, the proposed project would replace an existing 2-sty
dwelling with a new 2.5-sty dwelling situated in the most environmentally sensitive
location practicable, which together with the proposed mitigation measures will ensure the
protection and improvement of groundwater quality and supply, as well as the quality and
function of the surrounding ecosystem associated with the offsite freshwater wetlands to
the west and tidal wetlands associated with Hog Neck Bay to the east. Specifically, the
proposed dwelling would be located no farther seaward and more than 200 feet from the
wetlands boundary associated with Hog Neck Bay, and the entire Chapter 275/Wetlands-
jurisdictional area adjacent to Hog Neck Bay will remain undisturbed, with the 100-foot
jurisdictional area upland of the limit of beach remaining as a vegetated non-turf buffer.
Although a small increase in wetlands setback would be achieved, the dwelling would
unavoidably remain within the 100-foot jurisdictional area associated with the offsite
freshwater wetlands to the southwest, which are located on the opposite side of Smith
Road. Therefore, to further mitigate any potential project impacts and in fact improve the
environmental condition of the property, a stormwater drainage system will be installed to
collect and recharge roof runoff; and a new I/A sanitary system located at least 100 feet
from freshwater wetlands and almost 300 feet from the surface waters of Hog Neck Bay
will be installed in place of an existing conventional septic system located less than 60 feet
from freshwater wetlands.
