En-Consultants on behalf of WARREN W. JACKSON 2017 IRREVOCABLE TRUST requests a Wetland
Permit to install stone rip-rap on filter cloth above Mean High Water along eroding shoreline; construct a low-
sill vinyl bulkhead and low-sill bulkhead return approximately along location of Mean Low Water; backfill low-
sill bulkhead and plant with Spartina alterniflora to create approximately 1,488sq.ft. of vegetated intertidal
marsh between low-sill bulkhead and Mean High Water/proposed rip-rap; backfill and plant voids between rip-
rap and top of shoreline slope as needed; and to establish and perpetually maintain a 10' wide vegetated non-
turf buffer area adjacent to top of shoreline slope. Located: 300 Deep Hole Drive, Mattituck. SCTM# 1000-
115-12-4
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based
upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as
well as the records available to me, it is my recommendation that the action is INCONSISTENT with the
LWRP Policy 6.
1. Vegetation appears to be stabilizing the shoreline.
2. The rate of erosion is low—and does not look like it warrants hardening the shoreline in
this area.
3. The seaward projection of the bulkhead appears to be a land grab.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
l , All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion-Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its si nificant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

The proposed project is intended to prevent the further landward recession of a gradually and chronically
eroding shoreline, using a combined structural and non-structural/vegetative erosion remediation design.
Specifically,to stabilize the upper edge of the shoreline and prevent further recession of the adjacent upland,
stone rip-rap is proposed seaward of the top of slope/erosion escarpment,above mean high water.To soften
the slope of the shoreline and create a stable edge for the creation of a vegetated intertidal marsh area
seaward of the rip-rap, which in addition to its ecological benefits would provide natural flood and erosion
protection, a low-sill bulkhead is proposed along the location of mean low water, in line with the adjacent
conventional bulkhead to the south. Voids between the proposed rip-rap and top of slope would be
backfilled and revegetated as needed,and a vegetated non-turf buffer would be established landward of the
top of slope.The proposed rip-rap has been designed to the minimum scale necessary and will terminate to
the south against an adjacent bulkhead return and to the north in the middle of the property, well to the
south of the adjacent northerly property,thus avoiding the potential for any impacts on either neighboring
property. Elevated at least 6 inches below mean high water and also terminating against the adjacent
bulkhead and middle of the property, the low-sill bulkhead would have no adverse effects on neighboring
properties or natural coastal processes and resources, consistent with the permitting standards of Chapter
275 and LWRP Policy 4 goals of minimizing loss from flooding and erosion. Further,the low sill-bulkhead
would allow for the creation of almost 1,500 sf of vegetated intertidal marsh and its associated functions
and values, e.g., marine food production, habitat creation, and filtering potential runoff contaminants,
consistent with the LWRP Policy 5 and 6 goals of protecting water quality and restoring the quality and
functions of Town of Southold ecosystems. Therefore, the project should mitigate ongoing shoreline
erosion without adverse impacts while enhancing the environmental condition of the property.
