Located: 1070 The Strand, East Marion. SCTM# 1000-30-2-77 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The proposed action is recommended as INCONSISTENT with the below-listed policies and LWRP. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The Applicant currently enjoys access to the Long Island Sound Beach. The Planning Board designed Open Space Area E (SCTM lot#21-5-10) in the Pebble Beach Farms subdivision, located east of the property, to provide access to Long Island Sound, a bathing beach, a parking area, and a path to the beach. The area is maintained by a Homeowners Association, as per the Covenants and Restrictions dated May 14, 1975. Therefore,the proposed action is not permissible pursuant to Chapter 275-11, B. 0)which states: "Individual residential stairs are prohibited on bluffs if the property is part of an association that maintains a common stairway within a reasonable distance."
