Main Rd. &Youngs Ave.) �c G Telephone: 631 765-1938 Southold, NY 11971 ® �® C4Um�� LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Glenn Goldsmith, President Town of Southold Board of Trustees From: Mark Terry, AICP LWRP Coordinator Date: May 14, 2024 Re: LWRP Coastal Consistency Review for FTKS HOLDINGS, LLC SCTM# 1000-38-7-7.1 Costello Marine Construction Corp. on behalf of FTKS HOLDINGS, LLC requests a Wetland Permit and a Coastal Erosion Permit to remove 423 linear feet of existing failed Navy construction timber bulkhead by cutting sheathing at mud line, remove all piles, tie rods, and deadmen located on Gardiners Bay below APHW in intertidal zone; remove all concrete debris and miscellaneous debris above SPHW; remove all concrete below SPHW manually; all debris to be removed to an approved NYSDEC SWMF; install new 423 linear feet of Navy construction vinyl sheathing bulkhead one foot landward (upland) of APHW(March 7, 2022), with up to 300 cubic yards of clean upland fill as backfill in upland area with top of new bulkhead at elevation 7.9 NAVD; remove 628 linear feet of existing timber bulkhead in channel and boat basin area and install in-place, in same location 628 linear feet of Navy construction vinyl sheathing bulkhead; backfill with 700 cubic yards of clean upland fill as backfill in upland area with top of bulkhead at 7.9 NAVD. Located: 2835 Shipyard Lane, East Marion. SCTM# 1000-38-7-7.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that: Dredged Basin -The action to remove 628 linear feet of existing timber bulkhead in the channel and boat basin area and install in-place, in the same location, 628 linear feet of Navy construction vinyl sheathing bulkhead; backfill with 700 cubic yards of clean upland fill as backfill in an upland area with top of the bulkhead at 7.9 NAVD. the as-built structures are recommended as CONSISTENT with LWRP Policies and with the LWRP provided: 1. The bulkhead would support water-dependent use, such as docking vessels for commercial fishing or aquaculture supporting Policy 10 Protect the Town of Southold's water-dependent uses and promote siting of new water-dependent uses in suitable locations. 2. The use of chemically or CCA-treated materials is avoided. The dredged basin does not flush. Gardiners Bay Shoreline—The action to remove 423 linear feet of existing failed Navy construction timber bulkhead by cutting sheathing at mud line, remove all piles, tie rods, and deadmen located on Gardiners Bay below APHW in intertidal zone; remove all concrete debris and miscellaneous debris above SPHW; remove all concrete below SPHW manually; all debris to be removed to an approved NYSDEC SWMF; install new 423 linear feet of Navy construction vinyl sheathing bulkhead one foot landward (upland) of APHW(March 7, 2022), with up to 300 cubic yards of clean upland fill as backfill in upland area with top of new bulkhead at elevation 7.9 NAVD is recommended as INCONSISTENT with Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. 3. The proposed action does not restore.or preserve the function of the beach and littoral zone. 4. The existing structure is non-functional, and the erosion rate is low due to the beach slope and composition. 5. Aerial photos reveal that since 2001,.the area of the beach has been stable—no moderate to large erosion has occurred. 6. The filling behind the bulkhead would result in a land grab and physical loss of the beach zone and habitat. The plans are not clear. 7. The installation of a bulkhead would interrupt sand longshore drift and most likely result in no beach area in front of the bulkhead. 8. A natural vegetation restoration of the littoral zone is not proposed. Pursuant to'Chapter'268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A _.proposed_.action will be evaluated as to its significant beneficial and adverse effects.upon the coastal area(which includes all of Southold.Town). 1 If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law.
