McLean Associates on behalf of EAST END SEAPORT MUSEUM & MARINE FOUNDATION, LONG BEACH BAR BUG LIGHTHOUSE requests a Wetland Permit and a Coastal Erosion Permit to construct a new pier by saw-cutting and removing existing concrete within footprint of proposed timber pier, remove±148' of existing timber pier and replace with an 8'x40.75' (±322sq.ft.)greenheart timber pier, stepping down to an 8'x16.4' (132sq.ft.) fiberglass-grating pier at lower elevation and situated in an "L" configuration; install 94 linear feet of timber railing around the perimeter of the pier, 40' long fender pilings evenly spaced around the perimeter of the pier, and three (3) aluminum marine ladders; replace four(4) two-pile dolphins while shifting them slightly to the east to accommodate the new locatiorrof the pier; install one(1) five-pile dolphin; install a new 19.5'wide wave screen using 10' long 3"xl0" greenheart timber boards connected to three (3) 8"x8" greenheart timber wales and (3) 12" long steel brackets, and then fastened to 35' long HP 14x102 steel piles, placed at 6' on center; and to construct a new walkway path around the existing building with approximately 113 cubic yards of heavy granite stone over an area of 787sq.ft.; the stone will lay flat and will allow the visitors to walk around the lighthouse. Located: Off End of Long Beach Bar in Gardiners Bay, Orient. SCTM# 1000-132-1-31 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal is INCONSISTENT with LWRP Policies 6.3 (below) and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations asset forth in Trustee permit conditions. The proposal does not meet Chapter 111. Coastal Erosion Hazard Areas of the Southold Town Code. a. No development is permitted in natural protective feature areas, except as specifically allowed under the relevant portions of 6 NYCRR 505.8. The pier is within the Coastal Erosion Hazard Area (CEHA). All development is prohibited in the nearshore area pursuant to § 111-11. unless specifically provided for by Chapter 111, COASTAL EROSION HAZARD AREAS. Pursuant to § 111-6, allowable activities in these areas may include open timber piles or other similar open work supports with a top surface area of less than 200 square feet which are removed in the fall of each year. Therefore, the pier, as proposed, is prohibited in the nearshore area pursuant to Chapter 111, COASTAL EROSION HAZARD AREAS as it is greater than 200 square feet and not removable. It is recommended that the Board consider the water-dependent nature of the proposal and the need for safe access. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other'ministerial permits not located within the Coastal Erosion HazardArea. 2 Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area(which includes all of Southold Town). 3. If any question in Section C on this form is answered "yes",then the proposed action may affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, the action should be analyzed in more detail and, if necessary; modified prior to making a determination that it is consistent to the maximum extent practicable with the LWRP policy standards and conditions. The new pier would be larger,an increase from 148 SF t 453 SF owever, 132 SF of the proposed pier will be fiberglass grating,which will still allow natural light to pass through. See attached project description for more details. Project Description for Long Beach Bar Bug Lighthouse, Orient, NY The purpose of the proposed work is to remove and replace the existing timber pier located on - the east side of the Long Beach Bar Bug Lighthouse. It is proposed to remove the existing 148 SF existing timber pier and replace with a new 453 SF pile supported pier. The new pier will consist of the following sections: • 40.75'x8' (322±SF) greenheart timber pier(Elevation 6.68±) • 16.4'x8' (132±SF)fiberglass-grating pier at lower elevation (Elevation 4.68±) The shape of the new pier will form an "U. The higher section of the pier will be used to offload passengers from the Peconic Star which runs tours to the Lighthouse. The lower section of the pier will be used for docking of smaller recreational vessels.. The revised pier configuration will provide increased accessibility to the cruises and tours offered by the East End Museum to Bug . Lighthouse and to provide safety for pedestrians. The lower section of the pier will provide a safer environment for boaters so that they do not need to climb a high ladder to access the pier. The additional square feet of pier will provide greater levels of both safety and accessibility for those who traverse the island. Approximately 132 square feet of the proposed ±453 square feet pier is to be constructed from fiberglass grating, which will allow natural light to pass through to the wetlands that it is encroaching into. The intent is to make'a necessary increase in the accessibility for recreatio al boaters while minimizing the impacts to the wetlands. The new timber ier� 'ill consist of 4"x8" greenheart "er stringers, 3"x10" gree heart timber girders, 3"x8" gr en"eart timber decking and 35-ft Ion timber piles. A new railing VII be added around this pier. ►he fiberglass-grating pier will have the same substructure as th 6 ber pier and 40-ft long fender piles evenly spaced around the perimeter of the pier. It is also proposed to construct a new timber wave screen on the south side of the pier to protect and mitigate the actions of waves generated by east and southeast with fetches between 8 and 18 miles. This new 19.5' wide wave screen will be constructed with'10-ft'long 3"x10" greenheart timber boards connected to (3) 8"x8" greenheart timber wales and (3) 12" long 8x6x.5/- steel brackets, and then fastened to 35-ft long HP 14x102 steel piles, placed at 6-ft on center. It is proposed to replace four existing 2-pile dolphin structures. The locations of the 2-pile dolphins will be shifted slightly east to accommodate the new location of the pier. It is also proposed to install one 5-pile dolphin directly south of the new wave screen to provide protection from ice flows. It is proposed to construct a new walkway path around the existing building with approximately 113 CY of heavy granite stone over an area of 787 SF. The stone will laid flat and will allow the visitors to walk around the lighthouse. All requirements of the NYSDEC, ACOE, DOS and Town of Southold permits will be adhered to.
