Howard Ruben on behalf of LESTER& ETHNA LAY requests a Wetland Permit to replace existing wood
bulkhead (±178'total including returns)with a new vinyl bulkhead using Helix anchors along 81' of the eastern
section of bulkhead (due to close proximity of dwelling) and using a tieback/deadmen system for the western
67' section of bulkheading; new bulkhead to be 1.5' higher than existing; bulkhead to have a straighter±30'
west return, which is also the east wall of the ramp; increase ramp surface by 62sq.ft. for a new total of
274sq.ft. and replace exiting boat ramp planking; install a French drain at top of ramp to mitigate run-off into
the buffer area; remove existing upper retaining wall and not replace; remove existing lower and construct a
138' long retaining wall using 4"x4" treated lumber with a deadman system and raised an additional 1.5' in
height with a±12' long west return and a±12' long buried east return; approximately 557 cubic yards of soils
will be excavated and replaced during construction; approximately 135 cubic yards of additional clean fill from
an approved upland source will be placed landward of the bulkhead line to raise the existing grade; and to
establish and perpetually maintain a 10'wide non-turf buffer area along the landward edge of the bulkhead.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based
upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as
well as the records available to me, it is my recommendation that the action is CONSISTENT with LWRP
Policy 6 and, therefore, CONSISTENT with the LWRP provided the following is considered:
1. Turbidity controls compliant with Chapter 275.
Pursuant to`Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

Lay Bulkhead Replacement Project
Sumary project description proposed bulkhead replacement, Lay property at 370 Williamsburg
Rd in Southold NY. (0.5510 ac). Site conditions include: residential wood frame house and
attached garage as well as a a covered porch and a covered brick patio, lawns and shrubs.
Replace old wood bulkhead with vinyl sheathing bulkhead along canal adjoining Corey Creek
(Approximately 178' includes returns (See site plan). The new bulkhead plan requires Helix
anchors where excavation was considered too close to the residence (eastern 81' of
replacement bulkhead). A tieback/deadmen system will be used for the western 67' run of the
bulkhead. See X section plans.
Replace boat ramp planking, straighten return, increasing ramp surface by 62 sq ft, new total
274 sq ft. A French drain will be installed at top of ramp to funnel turf runoff into the proposed
adjacent buffer area.
Remove upper retaining wall. The old lower retaining wall will be removed and rebuilt using
4"X4"treated lumber with a deadman system. Bulkhead and lower retaining wall will be raised
by 1.5' and backfilled to accommodate elevation increase.
Work will be conducted both landward and waterward of the bulkhead line. To minimize
sedimentation, excavation will occur prior to dismantling the old bulkhead wall. All old
bulkhead, ramp and retaining wall debris will be properly disposed of.
Approximately 557 cubic yards of soils will be excavated and replaced during construction
(disturbed area @0.056 ac, @ 10%of the project area ). To accommodate the higher bulkhead
and retaining wall, and the 10' buffer creation, @ 135 CY of additional fill will be placed
landward of the bulkhead line. All additional fill materials will come from an approved source.
Please note that the reconstructed landward retaining wall's new elevation will be @ 7'(1988
NAVD). This is about the same elevation as the highest stone terrace of the neighboring
(Groenfeld)property to the east(see photo).
There no wetlands within the immediate project activity area. Construction activities can be
scheduled to minimize temporary impacts to water quality by utilizing periods around low tide
to the extent possible.

Lay Bulkhead Replacement Project
Southold Town
Detailed Project Description Board of Trustees
The following project is proposed at the Lay property(0.5510 ac) located at 370 Williamsburg
Rd in Southold NY. Project: replace old wood bulkhead with vinyl sheathing bulkhead along
canal adjoining Corey Creek. Install about 178' of new bulkhead of which about 30 ft are returns
(See site plan). Site conditions include: residential wood frame house and attached garage as
well as a a covered porch and a covered brick patio, lawns and shrubs . At the southwest
terminus of the bulkhead is a wooden boat ramp. Bulkhead replacement includes
straightening the eastern ramp return increasing ramp surface by 62 sq ft,total ramp surface
becoming 274 sq ft. relocating this return increases the mouth of the ramp by about 3'. At the
top of the ramp a "French drain"will be installed to funnel turf runoff into the adjacent buffer
area. Other project site changes include: raising the entire bulkhead 1.5 , and adding an
additional 1.5' of backfill elevation to support the higher bulkhead. A 10'wide non-turf surface
buffer (0.04 ac)will be established landward of all bulkhead structures (includes east side of
ramp return). The existing upper(most landward)wood retaining wall will be removed. The
lower retaining wall will be removed and rebuilt using 4"X4"treated lumber and a deadman
system The rebuilt retaining wall will also be raised 1.5' with an appropriate amount of back
fill. These coinciding increases in elevation are essential to stabilizing the new, higher
bulkhead and retaining wall. The new bulkhead plan calls for Helix anchors excavation was
considered too close to the residence (eastern 81' of bulkhead). A tieback deadmen system will
be used for the western 67' run of the bulkhead and includes the approximate 30' of the east
ramp return. See X section plans.
Project Action: Work to be conducted both landward and waterward of the bulkhead. To
minimize sedimentation into the canal, all excavation, including removal of both landward
retaining walls, will occur prior to dismantling of the old bulkhead wall. All dismantled
materials will be properly disposed of. Construction materials include 18'vinyl C-lock sheet
pile,wood piles (10" butt x 24' piles) and 6"X 6" wood whalers.
The new bulkhead occupies the same location as the bulkhead with the exception of the
change to the boat launch as described above. Project actions involve excavation and
replacement of a total of @ 557 cubic yards of soils (disturbed area @0.056 ac, about 10%of
the project area ). To accommodate the 1.5' increase in elevation of the replacement bulkhead
and the rebuilt lower retaining wall, and the construction of the non turf buffer, @ 135 CY of
additional fill will be needed. All additional fill soils and surface buffer materials will come from
an approved source. The buffer will be planted with appropriate non turf plant species post
construction. Please note that the reconstructed landward retaining wall's new elevation will be
@ 7'(1988 NAVD). This is about the same elevation at the highest terrace of the neighboring
(Groenfeld)property to the east(see photo).
There no wetlands within the immediate project activity area. With the appropriate Best
Management Practices (silt curtain/boom) it is unlikely that any significant impacts to any
adjacent tidal marsh will occur during construction. Project actions will create minor,
insignificant disturbances to the water column and to benthic areas immediately adjacent to
the bulkhead construction zone. Construction activities can be scheduled to minimize
potential impacts by utilizing periods around low tide to the extent possible.
