BOND RESOLUTION OF THE TOWN OF SOUTHOLD, NEW
YORK, ADOPTED DECEMBER 17, 2024, AUTHORIZING THE
ISSUANCE OF BONDS IN A PRINCIPAL AMOUNT NOT TO
EXCEED $150,000 TO FINANCE THE PREPARATION OF
PRELIMINARY PLANS AND SPECIFICATIONS IN
CONNECTION WITH THE PROPOSED RENOVATIONS OF
THE BARRACKS LOCATED ON FISHERS ISLAND, TO BE
USED FOR POLICE PURPOSES, STATING THE ESTIMATED
MAXIMUM COST THEREOF IS $150,000 AND
APPROPRIATING SAID AMOUNT FOR SUCH PURPOSE
THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF
SUFFOLK, NEW YORK, HEREBY RESOLVES (by the favorable vote of not less than two-
thirds of all the members of said Town Board) AS FOLLOWS:
Section 1. The Town of Southold, in the County of Suffolk, New York (herein
called the "Town"), is hereby authorized to issue bonds in a principal amount not to exceed
$150,000 pursuant to the Local Finance Law, constituting Chapter 33-a of the Consolidated
Laws of the State of New York (herein called the "Law"), to finance the preparation of
preliminary plans and specifications in connection with the proposed renovations of the barracks
located on Fishers Island, to be used for police purposes.

Section 2. The estimated maximum cost of the project described herein, including
preliminary costs and costs incidental thereto and the financing thereof, is $150,000 and said
amount is hereby appropriated for such purpose. The plan of financing includes the issuance of
bonds in a principal amount not to exceed $150,000 to finance said appropriation, the levy and
collection of taxes on all the taxable real property in the Town to pay the principal of said bonds
and the interest thereon as the same shall become due and payable.
Section 3. The following additional matters are hereby determined and declared:
(a) The period of probable usefulness applicable to the object or purpose for
which said bonds are authorized to be issued, within the limitations of Section 11.00 a. 62 of the
Law, is five (5) years.
(b) The proceeds of the bonds herein authorized and any bond anticipation
notes issued in anticipation of said bonds may be applied to reimburse the Town for expenditures
made after the effective date of this resolution for the purpose for which said bonds are
authorized. The foregoing statement of intent with respect to reimbursement is made in
conformity with Treasury Regulation Section 1.150-2 of the United States Treasury Department.
(c) The proposed maturity of the bonds authorized by this resolution will not
exceed five years.
Section 4. Each of the bonds authorized by this resolution and any bond
anticipation notes issued in anticipation of the sale of said bonds shall contain the recital of
validity as prescribed by Section 52.00 of the Law and said bonds and any notes issued in
anticipation of said bonds shall be general obligations of the Town, payable as to both principal
and interest by a general tax upon all the taxable real property within the Town. The faith and
credit of the Town are hereby irrevocably pledged to the punctual payment of the principal of
and interest on said bonds and any notes issued in anticipation of the sale of said bonds, and
provision shall be made annually in the budget of the Town by appropriation for (a) the
amortization and redemption of the bonds and any notes in anticipation thereof to mature in such
year and (b) the payment of interest to be due and payable in such year.
Section 5. Subject to the provisions of this resolution and of the Law and
pursuant to the provisions of Section 21.00 of the Law relative to the authorization of the
issuance of bonds with substantially level or declining annual debt service, Section 30.00 relative
to the authorization of the issuance of bond anticipation notes and Section 50.00 and Sections
56.00 to 60.00 and 168.00 of the Law, the powers and duties of the Town Board relative to
authorizing bond anticipation notes and prescribing the terms, form and contents and as to the
sale and issuance of the bonds herein authorized, and of any bond anticipation notes issued in
anticipation of said bonds, and the renewals of said bond anticipation notes, and as to executing
contracts for credit enhancements and providing for substantially level or declining annual debt
service, are hereby delegated to the Supervisor, the chief fiscal officer of the Town.
Section 6. The validity of the bonds authorized by this resolution, and of any
notes issued in anticipation of the sale of said bonds, may be contested only if-
(a) such obligations are authorized for an object or purpose for which the
Town is not authorized to expend money, or
(b) the provisions of law which should be complied with at the date of the
publication of such resolution, or a summary thereof, are not substantially
complied with,

and an action, suit or proceeding contesting such validity is commenced within twenty days after
the date of such publication, or
(c) such obligations are authorized in violation of the provisions of the
constitution.
Section 7. This bond resolution shall take effect immediately, and the Town
Clerk is hereby authorized and directed to publish a summary of this bond resolution, together
with a Notice attached in substantially the form prescribed by Section 81.00 of the Law in the
official newspaper of the Town, having a general circulation within said Town and hereby
designated the official newspaper of said Town for such publication.
LEGAL NOTICE
The resolution, a summary of which is published herewith, has been adopted on December 17,
2024 and the validity of the obligations authorized by such resolution may be hereafter contested
only if such obligations were authorized for an object or purpose for which the Town of
Southold, in the County of Suffolk, New York, is not authorized to expend money or if the
provisions of law which should have been complied with as of the date of publication of this
Notice were not substantially complied with, and an action, suit or proceeding contesting such
validity is commenced within twenty days after the publication of this Notice, or such
obligations were authorized in violation of the provisions of the constitution.

WHEREAS, the Town Board of the Town of Southold has been advised by the Southold Town
Police that the conditions presently existing at the police barracks at Fisher's Island are
unsuitable for continued habitation by members of the Police as the structure requires certain
rehabilitation, including, among other work, asbestos abatement and a new HVAC system; and
WHEREAS, the Board recognizes the essential public purpose of the police barracks and the
Town's paramount obligation to provide for adequate police services to the residents of Fisher's
Island; and
WHEREAS, in determining the resources available to accommodate temporary housing of police
officers during the pendency of the work required, the Board has identified the residence at 357
Whistler Avenue to be best suited for this purpose; and

legislation establishing the Fishers Island Ferry District(FIFD) (Chapter 699 of the law of 1947,

Town assets to the FIFD remains subject to Town Board approval; and
WHEREAS, in prioritizing the stated needs of the Town and the FIFD on this issue, the Board
considers the need to accommodate Police officers, to ensure the continuation of police services,
to be superior to the asserted desire of the FIFD to provide for private leasing of the premises for
profit motives, or to accommodate its own employees, when said need can satisfied by the FIFD
at its newly acquired facility purchased from the US Coast Guard, located immediately adjacent
to the existing FIFD dock facility.
NOW, THEREFORE,be it resolved, that the Town Board of the Town of Southold temporarily
revokes the permission previously granted to the FIFD permitting the use, supervision and
control of the premises known as 357 Whistler Avenue, Fishers Island, effective immediately;
with the intention to renew said permissions at the conclusion of the rehabilitation of the existing
police barracks; and be it further
RESOLVED, that the Town Board of the Town of Southold hereby authorizes the Town
Supervisor to execute all documents and, further, authorizes the Town Attorney to take all action
necessary, to effectuate the stated intention of this resolution.

WHEREAS the Town Board of the Town of Southold held a public hearing on the aforesaid
Local Law at which time all interested persons were given an opportunity to be heard, now

RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed Local
Law entitled, "A Local Law in Relation to Amendments to Chapter 280, Technical
Consultant Fee Reimbursement" reads as follows:
LOCAL LAW NO. 2024
A Local Law entitled"A Local Law in Relation to Amendments to Chapter 280, Technical
Consultant Fee Reimbursement"
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose- The purpose of this local law is to allow for Reimbursement to the Town for
Technical Consultant Fees. This amendment is enacted by local law pursuant to the authority of
the New York Municipal Home Rule Law Section 10. To the extent that Town Law, including
Town Law §§274-a, 276, 277 and 278, does not directly authorize the Town, including the Town
Planning Board, to require reimbursement to the Town of reasonable and necessary legal,
engineering and other professional consulting fees, expenses and costs incurred by the Town in
connection with engineering, scientific, land use planning, environmental, legal or other similar
professional reviews/assessment/advice concerning the adequacy,procedural or substantive
aspects of applications or of the issues raised during the cost of review/consideration of such
applications, including for site plan approvals, subdivision approvals or for any other land use or
development permits or approvals required by the Town Planning Board. It is the express intent
of the Town to change and supersede such statutes to permit the same. Moreover, to the extent
that such statutes do not authorize the withholding of acceptance, issuance or approvals in the
event such fees, expenses and costs are not paid to the Town, it is the express intent of the Town
to supersede such laws to empower the Town to require such payment as a condition to such
acceptance, issuance or approvals.
IL Chapter 280 of the Code of the Town of Southold is hereby amended to include the
underlined words and remove the struck through words as follows:
III. § 280-131. Review procedure.
N. Review by independent technical consultants:
(1) The Planning Board may determine that a referral to an independent
technical consultant(s)is deemed necessary to complete their review of an
application, with the technical consultants'fees to be reimbursed by the
applicant.Where the determination will result in total expenditures
exceeding SEQRA regulations, such determination shall also require
approval by the Town Board. Any such consultant shall be engaged in
accordance with the Town's Procurement Policy.
(2) Technical consultant fees (or "Fees") are those reasonable and necessary
legal, engineering and other professional consulting fees, expenses and costs

incurred by the Town in connection with engineering, scientific, land use
planning, environmental, legal or other similar professional
reviews/assessments/advice/services concerning the adequacy, procedural or
substantive aspects or applications or issues addressed during the course of
decision making/review/approval/inspection function(s) of the Town
Planning Board and rendered relative to and in connection with a particular
application, including site plan approvals, subdivision approvals, or for any
other land use or development permits or approvals required by the Town.
(3) Reimbursement Process:
(a) Estimate of Costs: Upon determining the need for technical assistance,
the Planning Board shall provide the applicant with an estimate of the
costs for hiring the necessary consultants and experts.
(b) Deposit: The applicant shall deposit the estimated amount with the Town
Clerk prior to the commencement of the review.
(c) An escrow account for the applicant shall be established with the Town
Comptroller's office. Said escrow account shall be established prior to the
Town's referral of the application to its consultant(s). Said escrow
account shall be funded by the applicant in an amount to be determined
by the Planning Board. The Planning Board may suspend its review of
the application until an escrow account is established and funded.
(d) Withdrawals from said escrow account may be made from time to time to
reimburse the Planning Board for the cost of its consultant(s')
professional review services actually incurred. Whenever the balance in
such escrow account is reduced to 1/4 of its initial amount, the Planning
Board shall notify the applicant; thereafter, the applicant shall deposit
additional funds into such account so as to restore its balance to 1/2 of the
initial deposit or to such sum as deemed necessary by the Planning Board.
If such account is not replenished within 30 days after the applicant is
notified in writing of the requirement for such additional deposit, the
Planning Board may suspend its review of the application.
(e) Adiustment: If the actual costs exceed the initial estimate, the applicant
shall be responsible for the additional costs. Conversely, if the actual costs
are less than the estimate, the remaining balance shall be refunded to the
applicant.
(f) The consultant(s) will work under the direction of the Town Planning
Director or designee. Copies of the consultant(s') qualifications, findings
and reports will be provided to the applicant.
(4) Failure to Reimburse Consultant Fees:
(a) Application approvals shall not be issued unless the applicant is in
compliance with this Chapter.
(b) There may be an instance where Consultant Fees have been incurred
by the Town but not vet billed to the applicant, or where fees have
been billed but are not vet past due by the applicant, but where the
Planning Board is ready for approval of an application. In such case,
the Planning Board may condition approval on compliance with this

Chapter prior to issuance of any buildin!permit associated with such
application.
(c) In Addition to any other remedy herein or otherwise, should an
applicant or owner fail to reimburse Consultant Fees in accordance
with this Chapter, regardless as to whether the subject application
was ultimately approved or otherwise, the Town may seek recovery
thereof in a Court of competent jurisdiction.
IV. SEVERABILITY
If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
V. EFFECTIVE DATE
This Local Law shall apply to all new and pending applications for site plan before the Southold
Town Planning Board and shall take effect immediately upon filing with the Secretary of State as
provided by law.
