Woychuk, last revised May 30, 2023, is beyond Article 25 (Tidal Wetlands)jurisdiction. Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661), no)permit is required under the Tidal Wetlands Act to conduct regulated activities landward of that line. In addition, DEC has determined that the portion of the project located seaward of the 10-foot contour line, as shown on the plans prepared by Giuseppe R. Adragna, dated July 26, 2023, is more than 75 feet from DEC-regulated tidal wetland boundaries and is listed in the Tidal Wetlands Land Use Regulations (6NYCRR Part 661.5 #50) as a use not requiring a permit. Therefore, no permit is required under the Tidal Wetlands Act of the Environmental Conservation Law for this portion of the project. Please be advised, however, that no other construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetland jurisdictional boundaries, as indicated above, without a permit. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction which may result from your project.
