Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board Finds the following facts to be true and relevant and makes the following findings: 1, lown_Law§267-b 3)Lb lj� Grant of the variances will not produce an undesirable change in the character of L -IL the neighborhood or a detriment to nearby properties. The neighborhood is an older neighborhood which consists of single-family homes on non-conforming sized lots and with non-conforming setbacks and lot coverage. The legally existing side yard setback of 5.3 feet is for a screened porch that is being renovated in place and in kind maintaining the same setback and on the same foundation.The side yard setback is closest to an accessory structure on the adjacent property. The proposed non-conforming lot coverage is for a proposed in-ground swimming pool. The adjacent home also has a pool in a similar location.The applicant testified that the pool will be screened from the neighbor's view by a solid fence and the house will block the view of the pool from the street. Granting of the variance will not have any detrimental impact to the character of the neighborhood. 2. Town Law 267-bQ1)LtJL2L._The benefit sought by the applicant for the non-conforming side yard setback cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The existing house has a non-conforming side yard setback. Any alterations on the western side of the house will require the benefit of variance relief. The benefit sought by the applicant for the swimming pool can be achieved by building a smaller swimming pool and remove an existing wood deck on the rear of the dwelling and replacing it with at grade pavers. However, the removal of the deck is financially impractical for the applicant, unnecessary when the deck already exists, and the proposed pool is not unreasonably large in size- In addition,the applicant is removing an existing deck attached to the existing screened porch 3. Town Law V67-b(3)(b)(3). The variances granted herein for the non-conforming side•yard setback is mathematically substantial, representing 47%relief from the code, however, it already exists. The variance granted herein for the non-conforming lot coverage is mathematically substantial representing 11.5%relief from the code. However,the lot is a small lot that is located in a neighborhood where non-conformities are common. 4. Town Law §267-b(3)(hI41. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. i'rown Law §267-bQj(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law V67-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool and screened porch while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
