Present were: Carol Brown, Chairperson John Chandler, Member- Via Zoom Shannon Wright, Member Inga Van Eysden, Member -Via Zoom Nancy May, Member Maggie Merrill, Member Yan Albaladejo, Student Member—Via Zoom Brian Mealy, Town Board Liaison Lauren Standish, Secretary Guest: Anne Murray Absent: Jocelyn Kaelin, Student Member Liz Gillooly, Trustee Liaison Moved by Maggie Merrill, seconded by Shannon Wright it was RESOLVED to appoint Carol Brown as the Chairperson of the Conservation Advisory Council, and be it further RESOLVED to appoint Inga Van Eysden and the Deputy Chairperson of the Conservation Advisory Council, effective immediately. Vote of Council: Ayes: All Motion Carried 2 Chairperson Carol Brown called the meeting to order at 4:30pm. ANNOUNCEMENTS Carol Brown welcomed Yan Albaladejo, as the newly appointed student member to the Conservation Advisory Council. Shannon Wright announced the NYSDEC will be having a tree sale in January. She will send the link to all of the members. There will be a Composting Event at the Southold Town Landfill — date TBD. Councilman Brian Mealy updated the CAC on the Tree Code. The draft will be presented at the next Town Board work session scheduled for Tues., November 19tn REPORTS Carol Brown attended the Board of Trustees meeting on October 16, 2024 and reported the meeting was business as usual. The application made on behalf of an applicant in Peconic, who applied to construct stairs on the bluff, was denied due to the history of erosion in the area. UPDATES/OLD BUSINESS/NEW BUSINESS Carol Brown asked the group to review the draft homeowner's guide and the draft mission statement for a final discussion in December. CLIMATE SMART COMMUNITIES Inga Van Eysden reviewed the pledges and noted that a lot of the pledges require Town Board approval. The CAC will have to figure out what they can do now, without too much difficulty. Maggie Merrill has a spreadsheet of projects that qualify for points. Carol Brown mentioned that Elizabeth Hornstein and Andrew Manitt would be willing to come to a future meeting, however it was then decided that Inga and Carol would meet with them via Zoom in,advance of the next monthly meeting. APPROVAL OF MINUTES Moved by Shannon Wright, seconded by Maggie Merrill to Approve the Minutes of October 15, 2024. RECOMMENDATIONS —WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Shannon Wright, seconded by Carol Brown, it was RESOLVED to NOT SUPPORT the application of MARIA & TONY KOSTOULAS to install 51 If. of rock revetment consisting of boulders at a maximum of 2.5 tones per linear foot along toe of bluff; re-vegetate bluff area with beach grass plugs 12" on center; install 2"X 12" terrace boards every 10' along disturbed bluff face. Located: 1035 Aquaview Ave., East Marion. SCTM#21-2-13 3 Inspected by: Shannon Wright The CAC does Not Support the application based on the fragility of this bluff and the neighboring properties. There was a concern with how the boulders would be brought on site. The CAC recommends this property and the neighboring properties be reviewed at the same time, using a different method. Vote of Council: Ayes: All Motion Carried Moved by Shannon Wright, seconded by Maggie Merrill, it was RESOLVD to NOT SUPPORT the application of DAVID VOGEL to construct a new two- story residence with 1,785 sf. on first floor and 1,563 sf. on second floor with 1,009 sf. of raised deck with 421 sf. of that total deck under porch roofs. A hot tub will be added to the west deck. Install a new I/A sanitary system more than 100' from bulkhead on the canal. Install three window wells to accommodate the egress windows in the basement. Install 518 sf. of eco-permeable pavers in gravel beds. Construct an 8'X 5' outdoor shower attached to the side of the house. Install gutters to leaders to onsite drywells to contain roof run-off. Place approx. 250 cy. of fill to raise to center of property. Install approx. 1,620 sf. of pervious driveway. Establish a temporary barrier of staked hay bales with a silt retention fence during construction and install and maintain 15' wide, naturally vegetated buffer along the landward side of the bulkhead. Located: 230 Wiggins Lane, Greenport. SCTM#35-4-28.41 Inspected by: Shannon Wright The CAC does Not Support the application because the proposed project is within a flood zone and located 58.7' from the wetlands. Vote of Council: Ayes: All Motion Carried Moved by Shannon Wright seconded by Maggie Merrill, it was RESOLVED to NOT SUPPORT the application of MICHAEL GULIZIO & STEVEN CORDOVES to demolish the existing shed, front wood deck and steps, enclosed porch, rear wood deck and steps, stone/gravel walkway and existing frame dwelling. Construct a new two-story dwelling, attached pool with integrated hot tub, front porch and steps, attached rear deck and steps with integrated pool; modify the existing gravel driveway, install an I/A septic system, and proposed Cultec stormwater chambers in rear yard. Located: 525 Island View Lane, Greenport. SCTM#57-2-26 Inspected by: Shannon Wright The CAC does Not Support the application because most of the construction is located within a moderate wave action FEMA flood zone, and doesn't meet the setbacks in accordance with Ch. 275. 4 Vote of Council: Ayes: All Motion Carried Moved by'Shannon Wright, seconded by Carol Brown, it was RESOLVED to NOT SUPORT the application of ANNA M. TEN NAPEL to construct a one-story addition 9'X 17' at the rear of the house, remove existing pavers and relocated stairs to the side of the deck. Conventional septic system will be upgraded to a new I/A septic system. Remove existing tree near the driveway and preserve all other trees on the property. A silt fence will be installed around the site to ensure proper erosion control until the area is fully stabilized. Located: 320 Glenn Road, Southold. Existing rear deck will be demolished and a new deck at 660.5' will be constructed at the first-floor elevation of the existing residence; new double stairs to provide access from the new deck to existing lower grade; and construction of a hot tub at 64 sf. within the new decking. SCTM#87-3-44.1 Inspected by: Carol Brown Vote of Council: Aye: All Motion Carried 5 Moved by Carol Brown, seconded by Nancy May, it was RESOLVED to NOT SUPPORT the application of WALTER GLESS ON BEHALF OF HIMSELF, AMY FEULNER, CHRISTOPHER GILLANDERS, GARY GILLANDERS, KEITH GILLANDERS, LAREN STRUNK, PAUL GILLANDERS, BRIAN SINCLAIR AND SUZANNE CALTAGIRONE for the replacement of existing bulkhead with 83 If. vinyl low sill bulkhead with 15' return on south side. Proposed dock with 4'X 10' ramp to grade landward of low sill bulkhead, 56' catwalk with thru flow decking, 3'X 14' aluminum ramp, and 6'X 20' floating dock in a "T" configuration. Rope handrail to be on one side of catwalk per owner's discretion. Existing ramp and float to be removed. Disturbed area behind low sill bulkhead to be planted with Spartina patens, Baccaris halimifolia, and Ivy frutescens. Phragmites to be cut to height of 12" two times per year, using hand tools, and 40' wide non-turf buffer along the landward edge of wetlands previously approved by the Board under Permit#10527. Located: 800 Koke Dr., Southold. SCTM#87-5-7 Inspected by: Carol Brown The CAC does not Support the application because the proposed dock was not staked, and questioned if the height of the dock would be above MHW, and what effect the bulkhead return would have on the neighboring property. There was also a concern with the 200 sf. hole in the rear of the property, which appeared dangerous. Vote of Council: Ayes: All Motion Carried ROBERT, PAUL, MARILYN, RICHARD, KATHLEEN, JOAN, NANCY, PETER & JOHN MAY, BARBARA MAHONEY & SUZANNE MAY WEST to remove and replace existing timber bulkhead with 100' new vinyl bulkhead in same location as existing, and remove and replace existing 3.5'X 7.5' steps to beach in same location as existing. Located: 1340 Cedar Beach Drive East, Southold. SCTM#92-1-5 RECUSED: Nancy May Inspected by: Carol Brown A quorum was not present, however the members were in agreement to support the application with retractable steps parallel to the shoreline, with the trees on the east side to remain, and to establish a 20' non-turf, vegetated buffer. ROGER D. TODEBUSH FAMILY TRUST for the removal of existing damaged 3'X 8' steps, 4'X 35' fixed dock and 3'X 4' fixed stairs. Replace in same location with new fixed dock extending 4'X 61' with steps to new 5'X 20' T-section and 3'X 4' steps on all sides. All decking on main portion of dock to be thru-flow. Existing permitted 12.2'X 12.4' upper deck to remain. Located: 1130 West Creek Ave., Cutchogue. SCTM#103-13-9 Application Tabled until December. 6 LAWRENCE TUTHILL to install a 150' rock revetment along the toe of the bank to protect the property and marina access road. Proposed revetment to consist of first course 1000- 1500 lbs. stones placed over filter cloth and buried below grade, with upper levels to consist of 500-1000 lb. stones, placed no more than 4' higher at an angle resulting in 6' width. Total weight of stone not to exceed 2 tons per If. Height of 115' of revetment will be approx. 1' higher than road elevation. Height of northern most 35' elevation to be tapered down to 1' in height. Area in back of revetment to be filled with clean sand and planted with Cape American beach grass plugs one foot on center. Existing deck and beach stairs to be removed Existing road to be restored with gravel/stone mixture. Located: 945 Orchard Street, New'Suffolk. SCTM#117-5-46.4 RECUSED: Maggie Merrill A quorum was not present, however the members were in agreement to support the application, as submitted. Moved by Nancy May, seconded by Carol Brown, it was RESOLVED to NOT SUPPORT the application of WILLIAM E. GOYDAN, AS TRUSTEE OF THE WILLIAM E. GOYDAN REVOCABLE INTER VIVOS TRUST AND KAREN B. GOYDAN AS TRUSTTEE OF THE KAREN B. GOYDAN RECOVABLE INTER VIVOS TRUST for the demolition of the existing residence located 30' from the wetland limit, detached garage and other surfaces on the residential zoned property. Construct a new two-story single-family residence with swimming pool, pool patio and detached garage, gravel driveway and parking area and I/A septic system. Located: 1645 Marratooka Rd., Mattituck. SCTM#123-3-2.1 Inspected by: Carol Brown, Nancy May The CAC does Not Support the application because the proposed dwelling is too close to the wetlands, the pool is too close to the hillside and there is a concern with run-off, as a well as depth to groundwater. Vote of Council: Ayes: All Motion Carried Moved by Carol Brown, seconded by Nancy May, it was RESOLVED to NOT SUPPORT the application of JSK PARK AVENUE LLC upon merger of the lots 9&10, demolish two existing single-family dwellings and appurtenances, and construct 32' farther from bulkhead, partially within Ch. 275, a two-story 2,670 sf. single- family dwelling with a 562 sf. roofed-over unenclosed masonry patio, 462 sf. raised uncovered masonry patio, and a 141 sf. grade-level masonry patio with outdoor kitchen; construct an 18'X 50' saltwater filtration swimming pool (including 5'X 10' spa), and a 872 sf. grade-level masonry patio; install a pool drywell, 4' high pool enclosure fencing, and a 113 sf. grade-level pervious gravel pad; remove existing septic system and install a new 7 I/A sanitary system outside Ch. 275 jurisdiction; install stormwater drainage system; and establish and perpetually maintain a 20' wide vegetated non-turf buffer landward of top of bank, allowing for two 3' wide stepping stone paths to existing steps. SCTM#123-8-9&10 Inspected by: Carol Brown, Nancy May The CAC does Not Support the application because the dwelling and swimming pool are too close to the bluff. The CAC recommends the proposed structures are located beyond 100' from the top of the bluff. Vote of Council: Ayes: All Motion Carried Moved by Nancy May, seconded by Carol Brown, it was RESOLVED to SUPPORT the application of BARBARA LASKIN REVOCABLE TRUST C/O BARBARA LASKIN for a small expansion of the living room onto deck. Located: 480 North Oakwood Road, Laurel. SCTM#127-8-8.5 Inspected by: Carol Brown, Nancy May Vote of Council: Ayes: All Motion Carried Moved by Carol Brown, seconded by Nancy May, it was RESOLVED to NOT SUPPORT the application of YASMINE LEGENDRE & COREY WORCESTER to construct a new swimming pool at 56'5" from the top of the bluff, spa at 88' and new proposed decking/patio located 487' from top of bluff where prior decking was approved at 50'9" and a walkway at 44' from top of bluff by Town Trustees. Proposed accessory structure swimming pool and spa on the seaward side of the residence and detached garage on the landward side of the residence will be located within the side yard of the principa] residence. Proposed project will be conducted on landward side of CEHA and landward of erosion control silt fencing. Located: 4355 Aldrich Lane Ext., Mattituck. SCTM#112-1-13 Inspected by: Carol Brown, Nancy May The CAC does Not Support the application because the proposed structures do not meet the setbacks in accordance with Ch. 275. Due to the existing erosion on the bluff, the CAC recommends a 20' vegetated buffer planted with native vegetation. Vote of Council: Ayes: All Motion Carried 1 1 1 8 Moved by Nany May, seconded by Carol Brown, it was RESOLVED to SUPPORT the application of RICHARD & AMY BRAUNSTEIN for the installation of an 80 If. rip-rap shoreline stabilization in same location as previously installed coir logs and plantings, which have been eroded, and non-sustainable in this location due to wave energy and erosion due to storms and boating activities. Located: 1885 Point Pleasant Road, Mattituck. SCTM#114-1-7.2 Inspected by: Carol Brown, Nancy May The CAC Supports the application and recommends a repair of the living shoreline. The applicant should consider consulting with Cornell Cooperative Ext. on how to grow a marsh in this location. Vote of Council: Ayes: All Motion Carried Nancy May will attend the Board of Trustees meeting scheduled for Wed., November 13, 2024. The next meeting of the Conservation Advisory Council is scheduled for Wed., December 11, 2024 at 4:30PM in the Conference Room.
