The following action was taken at the Southold Town Board of Trustees regular meeting held on
Wednesday, May 15, 2024:
RESOLVED, that the Southold Town Board of Trustees APPROVE the request for a One (1)
Year Extension to Wetland Permit#10187, as issued on July 13, 2022, and
BE IT FURTHER RESOLVED, that the Southold Town Board of Trustees APPROVE the
Amendment to Wetland Permit#10187 to modify the proposed by renovating the existing
1.155sq.ft. one &two story dwelling without raising the dwelling by approximately 2.8 feet;
construction of a 471 sq.ft. (instead of 459sq.ft.) second floor addition over existing one-story
portion of dwelling and covered porch; construction of 2'x16' steps (instead of 6'x6' steps) to
5.1'x18.5' extension of covered porch; construction of a 4,5'x7' covered front entry porch below
4'XI2' roof over"ang with 2'x7' steps (instead of a 5'x13.5' covered front entry porch with 6'x5'.
steps and.4'x13' pergola); and installation of a newly proposed 12'x16' masonry patio and 2'
wide stepping stone path to existing foot bridge, and as depicted on the site plan prepared by

York as part of the consideration for the issuance of the Permit does understand and prescribe to
the following.
l. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this pennit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 24 months,which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation, the said Permittee will be required,
upon due notice, to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety (90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

Your recent request to modify the above permit has been reviewed pursuant to 6 NYCRR Part
621 (Uniform Procedures Regulations). It has been determined that the proposed modification
will not substantially change the scope of the permitted actions or permit conditions. Therefore,
the permit is modified to authorize the following changes.
The dwelling will not be raised. Install a 2-foot wide stepping stone path to the existing foot bridge,
a 12' x 16' bluestone patio on grade, covered porch, wood steps, and I/A OWTS. All work for this

We are in receipt of your correspondence, dated March 28, 2024, requesting a de minimus approval
related to ZBA determination 47636, dated June 16, 2022, in which variance relief was granted to
construct additions and alterations to a single family dwelling, upon the above referenced premises.
In your letter, you explain that the owners have previously obtained approvals from the Southold Town
Board of Trustees and Suffolk County Department of Health Services, and that the elevation of the
dwelling was to achieve FEMA compliance. Because of escalating costs of construction, your clients
wish to modify the architectural design by not elevating the structure. Fttirthertore, they propose a 472
sq. ft. 2nd story addition, instead of the previously approved 459 sq. ft. 2nd floor addition, which is an
increase of 12 sq. ft.
I have reviewed your request, the Site Plan last revised March 14, 2024, prepared by Brendan M.
Maloney, R. A., and have determined that the revised design, as depicted, is de minimus in nature,
subject to the approval of all involved agencies.
Please be advised that all conditions of approval will still apply. Also, submit to our office an additional
original, signed and sealed Site Plan and two sets of signed and sealed Architectural Plans depicting the

Dear Ms. Weisman:
The above referenced Board determination, which was approved for filing on.Jun 17, 2022, granted the variance
approval necessary to construct.a 459 sf2nd story addition over a 1-story portion of an existing dwelling and porch,
with a 5.d' x 18.5' addition to the existing covered porch (with a 2"d floor deck above it). Relief was required to
maintain the existing 6.4-ft side setback where a minimum setback of 15 is required. Although not believed to be
a substantial renovation, the applicants were also voluntarily proposing to raise the altered dwelling to achieve
FEMA compliance.
Although the owners also obtained the additionally necessary approvals from the Town Trustees and Suffolk
County Department of Health Services, it became apparent that the quickly escalating costs of construction were
going to impact their ability to voluntarily elevate the renovated dwelling. Therefore, they have since modified
the architectural design to propose nearly identical additions, again maintaining the existing 6.4-foot side setback,
but without elevating the house. Specifically, now proposed in the same location is a 471 sf 2nd story addition
over a 1-story portion of an existing dwelling and a 5.1' x 18.5' addition to the existing covered porch(with a 2nd
floor deck above it), as depicted on the enclosed site plan prepared by Draft Design Architecture& Interiors, last
dated March 14, 2024. The slight increase in the square footage of the addition results from retention of the
chimney that was to be removed under the prior design, which in turn creates the need for 12 additional square
feet of interior space to provide adequate access to the addition. This increase in footprint of the 2"d story addition
is gained through an equal decrease in the footprint of the 2nd floor deck above the covered porch addition.
Therefore,pursuant to the Board's"right to substitute a similar design that is de minimus in nature for an alteration
that does not increase the degree of nonconformity," I am writing to respectfully request that the Board issue a
"de minimus letter"to authorize the revised site plan because a)the previously proposed elevation of the dwelling
did not itself trigger the need for variance relief, b) it could be argued that the variance was granted despite the
raising of the dwelling, as the Board determined"while the raising of the house to meet current FEMA regulations
will change the character of the neighborhood,the proposed additions and alterations which require variance relief
will not change the character of the neighborhood;" c) except as described above, the proposed additions and
alterations requiring variance relief are otherwise identical to those currently approved; and d) the
existing/proposed side setback of 6.4 feet remains unchanged.
