Southold, New York 11971 Liz Gillooly Telephone(631) 765-1892 Elizabeth Peeples Fax(631) 765-6641 ®1yCOU BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD January 8, 2025 Anthony Portillo AMP Architecture PO Box 152 Mattituck, NY 11952 RE: HC NOFO, LLC, c/o TODD FEUERSTEIN 6370 SKUNK LANE, CUTCHOGUE SCTM# 1000-104-5-3.3 Dear Mr. Portillo: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, December 18, 2024 regarding the above matter: WHEREAS, AMP Architecture on behalf of HC NOFO, LLC, c/o TODD FEUERSTEIN applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated September 24, 2024; and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations; and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP as the proposed pool is located within a FEMA Flood Zone and structure should be minimized in these areas; and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to'said application on December 18, 2024, at which time all interested persons were given an opportunity to be heard; and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area; and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application; and, 2 WHEREAS, the proposal of HC NOFO, LLC, c/o TODD FEUERSTEIN seeks to construct a pool within a FEMA Flood Zone; and, WHEREAS, the Conservation Advisory Committee resolved to not support the application or any activity seaward of the dwelling, which is in a FEMA Flood Zone and floods regularly; and, WHEREAS, the Southold Board of Trustees noted that the property is extremely low lying with wetlands on the majority of the property. The creek is high with standing water all around and has been steadily encroaching on the dwelling over the years; and WHEREAS, the proposed activity is in a FEMA Flood Zone; and WHEREAS, the property is already overbuilt in proximity to natural features; and, WHEREAS, the existing dwelling is very close to the wetlands and adding structure seaward will have an adverse effect on the wetlands; and, NOW THEREFORE BE IT RESOLVED, for the foregoing reasons, and based upon the application's failure to meet the standards contained in Chapter 275-12 (a), (b), (d), and (e) of the Town Code, that the proposed project is Inconsistent with the Local Waterfront Revitalization Program pursuant to Chapter 268 of the Southold Town Code, and the Conservation Advisory Committee resolved to not support the application, BE IT FURTHER RESOLVED, that the Board of Trustees DENIES the application of HC NOFO, LLC, c/o TODD FEUERSTEIN to excavate approximately 1,200 cubic feet of soil to be removed from site; install a 12'x20' gunite salt water heated pool (5' continuous depth), with 2'xl2' automatic cover and 8" coping (320sq.ft. total); install a 560sq.ft. at grade pool patio; install 312 linear feet of 4' high pool enclosure fencing; install pool equipment area, a drywell for pool, and two 120 gallon above ground propane tanks; and as depicted on the survey prepared by AMP Architecture last dated December 4, 2024; and, This determination should not be considered a determination made for any other Department or Agency, which may also have an application pending for the same or similar project.
